Kochi: A person who merely possesses the property of a childless senior citizen has no maintenance obligation unless that person is the legal heir or relative of the senior citizen, the high court has held. Only the legal heirs/relatives, as defined under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, are responsible for maintaining an elderly person who has no children, a bench of Justices Satish Ninan and P Krishna Kumar clarified. The court was considering an appeal filed by S Sheeja from Thiruvananthapuram challenging a single bench order that upheld the maintenance appellate tribunal's decision directing her to maintain an elderly woman, on the ground that she was in possession of land the woman had gifted to her nephew, who was Sheeja's late husband. The elderly woman had executed the gift deed in favour of her nephew in 1992, as she had no children. The nephew died in 2008, and the property devolved on his wife, Sheeja. The senior citizen then claimed that Sheeja was bound to maintain her under Section 4(4) of the Act, leading to the litigation. Both the tribunal and appellate tribunal accepted the senior woman's contention, and the single bench also upheld that decision. The division bench, however, noted that under the Act, the maintenance obligation of a childless senior citizen lies with their 'relative', defined as a legal heir who must have sufficient means to maintain the senior citizen and must be in possession of the senior citizen's property or stand to inherit it. The court clarified that a person who is not a legal heir of the senior citizen cannot be treated as a 'relative' under the Act merely because they are in possession of the property. In this case, the bench found that Sheeja was not a legal heir/relative of the senior citizen and therefore had no maintenance obligation under the Act. Accordingly, the orders of the tribunal, appellate tribunal and single bench were quashed. However, HC left it open to the senior citizen to pursue any other remedies available under law for an alleged violation of the terms of the gift deed. THIRUVANANTHAPURAM: Four members of a family, including a father, mother and their two sons were found hanging at their home in Vakkom on Tuesday. Police suspect they committed suicide. Findings of a preliminary inquiry suggest a financial crisis could be the reason for the family taking the extreme step, police sources said. The deceased were identified as Anil Kumar, 55, his wife Sheeja, 50, and their sons Ashwin, 25, and Akash, 22. According to ward member Santhamma S, Sheeja had often spoken about the family's mounting debts. The financial strain began after they took a large home loan from a nationalised bank to renovate a house purchased a few years ago. "Matters worsened in 2019 when Ashwin was seriously injured in an accident, resulting in multiple fractures. He spent six months in the hospital, and the family incurred heavy medical expenses, adding to their already growing debt," she said. Neighbours last saw the family around 5pm on Monday. On Tuesday morning, the house remained closed until a neighbour noticed the front door open around 10am. A family of four, including the father, mother and their two children, were found hanging in their house in Kerala's Vakkam on Tuesday, police officials said. The deceased have been identified as 55-year-old Anilkumar, his 50-year-old wife Sheeja, and their two sons, both in their twenties, according news agency PTI. Chilling details emerge Police stated that, prima facie, the incident appeared to be a suicide, adding, 'It is suspected that Anilkumar was facing financial issues. An investigation is underway. No suicide note has been recovered from the house thus far." The incident came to light after neighbours entered the house, as none of the family members had been seen outside. The Kerala incident comes a day after, seven members of a family that hailed from Uttarakhand's Dehradun died by suicide inside a car in Haryana's Panchkula. The family was found dead at around 10 pm on Monday in the city's Sector 27 area, after they had attended a spiritual event by Bageshwar Dham's Baba Dhirendra Shastri. While six of them were declared dead on arrival, the family's head was found alive and was referred to another hospital. However, he passed away soon afterwards. The police recovered a two-page suicide note from the vehicle, written by the family's patriarch, stating that they were taking the extreme step because they had gone bankrupt due to debt. He also wrote that everything that had happened was his fault and urged people to not trouble his father-in-law. The man added that all last rites and rituals would be performed by his maternal uncle's son. Discussing suicides can be triggering for some. However, suicides are preventable.
