Delhi HC seeks clarity from private schools on pay arrears to teachers

New Delhi [India], July 15 (ANI): The Delhi High Court has directed numerous private schools across the national capital to file affidavits detailing the implementation status of the Sixth and Seventh Central Pay Commission (CPC) recommendations for their teaching and non-teaching staff. A Division Bench comprising Justice Navin Chawla and Justice Renu Bhatnagar issued the directive while hearing a batch of appeals filed by teachers from various private institutions, including DAV Public School, GD Goenka Public School, ASN Sr. Secondary School, St. Margaret Senior Secondary School, and others. The appeals challenge a Single Judge's earlier ruling that, while recognising the teachers' entitlement to revised CPC-scale salaries, had also appointed a committee to examine whether the schools had adequate funds to disburse such salaries, and to assess the eligibility and appointments of the staff. Counsel appearing for the teachers argued that the appointment of such a committee went beyond the scope of the original writ petitions. The teachers had moved court primarily seeking enforcement of salary payments under the Sixth and Seventh CPCs, not a review of their service credentials or school finances. On the other hand, counsels representing the schools submitted that fee hikes have not been permitted by regulatory authorities, leaving them without sufficient funds to fully implement the CPC scales. Some schools claimed to have already adopted the revised pay commissions from various dates and had even cleared partial arrears. To resolve the factual disputes, the Court has now directed each school involved in the appeals to file a single affidavit (not one per case) within four weeks, clearly stating whether they have implemented the Seventh CPC, the date of such implementation (if done), the extent of salary arrears already paid under both the Sixth and Seventh CPC and the amount still pending, if any. The schools are to share copies of their affidavits with the teachers' legal teams. Teachers, in turn, may file responses within two weeks thereafter. The matter is next listed for hearing on September 17, 2025. (ANI)

Delhi HC restrains gurdwara body from two property deals over unpaid school dues

The Delhi high court has restrained the Delhi Sikh Gurdwara Management Committee (DSGMC) from dealing in any manner with its two major properties situated in Haryana and Shahdara to secure payment of unpaid dues to the tune of ₹400 crore for the teachers employed in schools run by Guru Harkrishan Public School (GHPS) society. In its order passed on May 2, a bench of justice Anish Dayal ordered to secure the properties spanning across 307 acres to help shore up dues payable to teachers who have not been paid dearness allowance (DA) as per the Sixth and Seventh Central Pay Commission, that was ordered to be paid by the Delhi high court in November 2021. The order, a copy of which was uploaded recently, said, 'Notwithstanding the undertaking, the court directs that for no reason whatsoever, will these properties i.e. 292 acres of land at Bigar (Haryana) and 15 acres of land at Shahdara (Delhi) be alienated nor any possessory rights be given to any party without prior permission of court.' Further, it directed, 'no encumbrance will be created without any prior permission of the court.' The bench of justice Dayal, observed, 'It is essential to secure these properties since they seem to be of large value and will possibly help in shoring up the dues, amounting to around ₹400 crore, which are owed to the petitioners.' The court recorded in its order that the GHPS society is only paying 2% DA as part of the 7th CPC, which mandates 54% DA. The court's directions came on an application moved by the teachers, who in their petition alleged contempt against DSGMC and GHPS society for failing to comply with the earlier direction of the high court on November 16, 2021. The application further urged the court to attach the two properties registered in DSGMC's name. In February 2024, the court found DSGMC's top officials – president Harmeet Singh Kalka and general secretary Jagdeep Singh Khalon — guilty of intentionally not complying with the ruling. Before ordering their removal, the court appointed an auditor for conducting a forensic account of the accounts of the society and the 12 schools managed by it from April 1, 2020 till December 31, 2023. Expressing displeasure over the officials' failure to comply with the undertaking, the court noted, 'Such undertakings were given merely to buy time. Now the blame is sought to be passed to the previous management. The religion of Sikhism preaches the ideals of honesty, compassion, humanity, humility and generosity in everyday life. While there is no doubt that various philanthropic and charitable causes are being discharged by the community and its leaders, at the same time, it should be kept in mind that charity begins at home.' The 29-page order also directed Nitesh Shrivastava as a valuer for ascertaining the list of the properties provided by the forensic auditor. Both Kalka and Khalon have been asked to appear on the next date of hearing on July 10.

New Delhi, The Delhi High Court has asked the Delhi Sikh Gurdwara Management Committee not to alienate or create third party rights over its properties in Haryana and Shahdara in the capital. Justice Anish Dayal also sought an undertaking from the committee not to put the properties on rental or license. The court passed the order while dealing with a contempt petition over the failure of the DSGMC to make payment of arrears in accordance with the Sixth and Seventh Central Pay Commission aside from other allowances and retiral benefits to the teachers in schools run by Guru Harkrishan Public School Society. The high court had previously held there was wilful disobedience of the order by the DSGMC. "An affidavit will accordingly be filed by the DSGMC through the secretary and the GHPS Society through its secretary, that no third-party rights will be created on this land; no alienation shall happen; and it will not be provided for any purposes of rental or license which will compromise the title or possession of the properties in any which way," said the court on May 2. The verdict further directed, "Notwithstanding the undertaking, the court directs that for no reason whatsoever, will these properties, i.e., 292 acre of land at Bigar and 15 acre of land at Shahdara be alienated nor any possessory rights be given to any party without prior permission of court and further, no encumbrance will be created without any prior permission of the court." The court underlined the important of securing the properties, which seemed to be of large value and would help in shoring up the dues, amounting to around ₹400 crore, owed to the petitioners. It also sought a report of valuation for the two parcels of land and certain other properties belonging to DSGC from a court-appointed valuer by September 7.
