Kerala high court refuses to quash cheating case against ‘Manjummel Boys' producers
Kochi: High court has dismissed the petitions filed by actor Soubin Shahir , his father Babu Shahir and Shawn Anthony, producers of the hit Malayalam film 'Manjummel Boys', seeking to quash a cheating case registered in connection with the movie's production. The case originated from a complaint filed by Siraj Valiyathara of Aroor before the judicial first-class magistrate court, Ernakulam. Siraj alleged that Parava Films LLP, owned by the petitioners, had approached him for investment in the movie. Pursuant to an agreement dated Nov 30, 2022, he claimed to have invested Rs 7 crore in multiple instalments. Despite the film becoming a commercial success, Siraj alleged that he was not paid the agreed share of profit. Based on the magistrate court's direction, the Maradu police registered a case. In their petitions, the producers countered that it was Siraj who had breached the agreement by failing to invest the promised amount on time, which disrupted shooting schedules and caused significant financial loss. They contended that Siraj was, therefore, not legally entitled to a share of the profits. Manjummel Boys was released on Feb 22, 2024, and went on to become a blockbuster. by Taboola by Taboola Sponsored Links Sponsored Links Promoted Links Promoted Links You May Like [Ativar Agora] - Licença de antivírus para PC Clique aqui Undo During the hearing, HC noted that in a pre-arrest bail plea related to the case, the investigating officer had submitted that Rs 18.65 crore was spent on the film's production and a portion of Siraj's investment had been diverted to the personal account of one of the accused. The officer also stated that, unlike other investors and financiers, Siraj alone had not been repaid. Considering these facts, the bench emphasised that the cheating case against the petitioner cannot be quashed, since the consideration at this stage is limited to whether the allegations in the FIR disclose the commission of a cognizable offence. Accordingly, the court dismissed the petitions.
