SHRC orders 5L relief for medical negligence

Chennai: State human rights commission (SHRC) has directed state govt to pay 5lakh as relief to a woman who delivered a stillborn baby due to an alleged delay in medical attention at Murukkeri primary health centre (PHC) in Villupuram. SHRC member V Kannadasan passed the order on a complaint moved by the woman's mother, K Devamani, alleging medical negligence and inhumane treatment at the PHC, which led to the stillbirth of her daughter Subbulakshmi's baby. According to the complaint, Subbulakshmi, who was eight months pregnant, experienced heavy bleeding and was admitted to the PHC on Apr 26, 2021. She contracted COVID-19 during treatment and experienced severe physical and mental distress. Opposing the plea, the PHC's medical officer, Dr K Varadaraj, and auxiliary nurse midwife (ANM) Prabavathi denied instructing the complainant to clean the blood stains. They also denied negligence and emphasised timely medical response and referral to a higher facility. Recording the submissions, the commission found that delay in shifting the patient contributed to the death of the baby. "It was established that a worker, Muthulakshmi, was responsible for instructing the complainant to clean the delivery area, which caused the delay. The worker was later dismissed from service on Nov 6, 2022," SHRC said. The commission also noted the director of public health and preventive medicine failed to include critical documents, including statements from the victim, in the enquiry report submitted to the commission. While dismissing the complaint against the medical officer and ANM on duty for lack of direct evidence, SHRC held govt liable and ordered the relief for violation of the fundamental right to timely medical care under Article 21 of Constitution. SHRC also recommended that govt increase the number of doctors, nurses, and medical staff in PHCs, especially in rural areas, and improve ambulance services with a focus on maternal care.

Officials of Hindu Religious and Charitable Endowment had tough time when they tried to seal a marriage hall allegedly built on the temple land in Palayamkottai on Tuesday. According to the official of HR and CE Department, a marriage hall and around 200 houses have been built on a portion of the 38 acres of land belonging to Venkatachalapathi Temple at Thimmarajapuram in Palayamkottai. As most of the houses on this land were reportedly built before 1960s and the dwellers are paying the taxes payable to the government, the dwellers refused to move away from the land even though the HR and CE issued eviction notice to them. The HR and CE court that delivered a judgment in this connection on April 24 last asked the dwellers to move out while giving them 60 days to appeal before the Commissioner, HR and CE. Against this backdrop, the HR and CE officials led by Assistant Commissioner Subbulakshmi and the police came to seal the marriage hall on Tuesday. A group of people living in the houses built on the temple land resisted it. They argued that the officials, after sealing the marriage hall, would also seal all their houses built on the land parcel having the same survey number. Even as heated argument was going on between the public and the officials, one of them poured kerosene on himself and also on some of the officials. However, the immolation bid was foiled by pouring water on the individual and the officials. AIADMK Tirunelveli district secretary Thatchai N. Ganesa Raja, party office-bearers Sudha Paramasivan, Bharani Sankaralingam and K.J.C. Gerald, Tamilaga Vetri Kazhagam's Tirunelveli North joint secretary Maria John came to the spot and held talks with the officials on behalf of the public, who demanded 3 days for vacating the marriage hall. They also said they had appealed before the Commissioner, HR and CE against the HR and CE court verdict. Even though the officials could not seal the marriage hall, they said they would file a complaint with the police as the government officials were prevented from discharging their duty and were threatened by pouring kerosene. Trichy: Two drunk men stopped a private bus after it overtook a funeral procession at Soorakottai in Thanjavur district on Friday evening and created a ruckus. They also verbally abused a female police head constable who confronted them. Police said the bus was plying between Thanjavur and Pattukottai. At Soorakottai, the driver repeatedly honked at a funeral procession to make way and overtook it after some time. When the bus was making its return journey, around five people parked their motorcycles on the road and stopped it. The bus driver and some passengers asked the group to move their motorcycles out of the way. Police head constable Subbulakshmi, attached to the Orathanadu police station, was returning home after duty in the bus. She confronted the troublemakers while filming them with her mobile phone from inside the bus. However, two men S Rahul Gandhi, 40, and K Panneerselvam, 43, in the group abused Subbulakshmi and threatened her with dire consequences. One of them entered the bus and tried to snatch her phone. The group eventually dispersed as more people joined in chorus against them. Superintendent of police R Rajaram formed a team that launched a manhunt for the absconding suspects. On Saturday, police arrested Rahul Gandhi and Panneerselvam. They were produced before a magistrate, who remanded them in judicial custody.
