KUALA LUMPUR: The Paris Court of Appeal has reserved its decision until Dec 9 on Malaysia's bid to annul the US$14.9 billion (RM70 billion) final award in the arbitration case filed by individuals claiming to be heirs of the defunct Sulu Sultanate. Minister in the Prime Minister's Department (Law and Institutional Reform) Datuk Seri Azalina Othman Said, in a statement, said the court concluded its hearing on the merits for the annulment of the final award in the case. "During the hearing, the claimants attempted to postpone the proceedings to enable them to respond to the written opinion of the Public Prosecutor of France. "However, the court did not allow the motion for postponement and continued with the proceedings," she said. Azalina said Malaysia continues to place its confidence in the French judicial process and hopes the decision will bring a definitive end to what she described as illegal global enforcement attempts by the so-called Sulu claimants. The hearing comes after the French Court of Cassation on Nov 6 last year upheld a previous ruling that denied enforcement of the Partial Award, which had affirmed the arbitrator's jurisdiction in the case. Azalina said the government remains firmly committed to defending Malaysia's sovereignty, sovereign immunity, and national interests against all unlawful challenges. "Malaysia is also working to promote a global framework that places transparency at the centre of third-party litigation funding, to ensure such mechanisms are not misused as instruments of lawfare against sovereign states. "International arbitration must be protected from attempts to extort sovereign states under the guise of arbitration claims," she added. She said the government would continue to take all necessary measures to protect the integrity of international arbitration from exploitation.

KOTA KINABALU: The Sabah Progressive Party (SAPP) is suing DAP's portal Roketkini for allegedly uploading fake images of the 2013 incursion in Lahad Datu. The suit was filed by SAPP president and former chief minister Datuk Seri Yong Teck Lee, historian Stephan Gaimin and activist Asraf Amir on July 10. They are seeking a public apology from DAP and Roketkini over the allegedly fake picture and information, which have been publicly accessible since 2013, and a promise not to upload any fake or misleading content. Yong said that after the suit was filed, they found that the portal had taken down the said material without any apology, correction, or explanation. 'The materials uploaded were fake and misled public understanding about the Lahad Datu intrusion in 2013,' Yong said when contacted on Thursday (July 17). He said he came across the photos and article dated Feb 24, 2013, which were obtained from a separate conflict in the Southern Philippines but used as though it was of the Lahad Datu incident. He said the images induced unnecessary fear among the people and caused confusion during the crisis. Yong said he is unsure if the article and photos were taken down at the instruction of the Malaysian Communications and Multimedia Commission (MCMC) or voluntarily by DAP, and that these details would only come out during litigation. Recalling the International Arbitration Colloquium on the Sulu claim on Sabah, at the Sabah International Convention Centre on July 4, 2023, he said he was shocked to see the photos and articles which were shown by a senior lawyer from Kuala Lumpur. 'The photos... during the presentation (made it seem as if) they were taken during the actual intrusion in Sabah,' he said. Later, when reading a Universiti Malaysia Sabah (UMS) publication on this issue, Yong also saw the same picture reprinted in an academic context. He said such usage of the Roketkini article had turned it into part of the narrative, spreading the damage of the allegedly false information and prompting the need for legal action. 'There may be (others who) mistakenly depended on this DAP propaganda portal, and DAP is the largest government party in Parliament,' he said, adding that merely taking down the content did not excuse the damage that has been done.

Police helicopter 9M-PHG played key role in Lahad Datu, major operations before crash

JOHOR BARU: The police AS355N helicopter bearing registration number 9M-PHG, which recently crashed in Gelang Patah, is being remembered for its extensive service in critical and humanitarian missions. Since news of its crash in Sungai Pulai during a nuclear detection training exercise last Thursday, many have recalled their experiences with the aircraft, whether flying in it or witnessing its role in various operations. Police Air Operation Force commander Datuk Noor Sham Md Jani described the 28-year-old aircraft as 'small but mighty', highlighting its key contribution during the 2013 Lahad Datu intrusion by Sulu militants in Kampung Tanduo, Sabah. Noor Sham, who has logged nearly 7,000 flight hours on the AS355N, said he flew 9M-PHG to evacuate injured General Operations Force (GOF) personnel to hospitals in Sandakan and Lahad Datu during the armed standoff. "From day one of the incident, three AS355N helicopters, including 9M-PHG, and their crews were stationed in Lahad Datu for nearly three weeks before the Royal Malaysian Air Force (RMAF) aircraft arrived," he told Bernama. The helicopter was involved in an accident at 10.15am on Thursday during the Multilateral Nuclear Security Detection Exercise (MITSATOM) 2025 at the Gelang Patah Maritime Jetty. The exercise involved Malaysia, Indonesia, Thailand and Singapore. The Civil Aviation Authority of Malaysia (CAAM) said the helicopter had departed from the Tanjung Kupang police station at 9.51am with five people on board, including the pilot. Noor Sham said 9M-PHG had just participated in the Langkawi International Maritime and Aerospace Exhibition 2025 (Lima '25) and was one of the most frequently deployed aircraft for humanitarian missions, including disaster relief, flood evacuations, as well as traffic and crime surveillance. The aircraft also supported major national operations, such as aerial surveillance during the state visit of Chinese President Xi Jinping in April and during the enforcement of the Covid-19 Movement Control Order (MCO). "Its compact size made it ideal for command-and-control tasks. "We often used it for initial reconnaissance because of its ability to manoeuvre in tight areas, before deploying larger aircraft like the AW139 if needed," he said. In Johor, 9M-PHG was used to airlift three pregnant women, aged 22 to 33, from flood-isolated Orang Asli villages in Kahang, Kluang, to the hospital. Police force currently operates five AS355N helicopters, with two of them in Sabah, one in Sarawak and two in Peninsular Malaysia, including 9M-PHG. – Bernama
