KUALA LUMPUR: A soldier was killed when the motorcycle he was riding to perform Friday prayers was involved in an accident at Bandar Baru Mosque in Sungai Buloh yesterday. The incident occurred at 1.35 pm when the victim, who was riding a motorcycle from the Paya Jaras military camp in Sungai Buloh, was hit by a lorry believed to have lost control due to brake failure while turning into a parking area behind the mosque. Sungai Buloh district police chief Superintendent Mohd Hafiz Muhammad Nor said the lorry continued to hit the victim, pinning him underneath, and at the same time crashed into a parked motorcycle, a food stall, and the mosque wall. "The victim, who was trapped under the lorry, was pronounced dead by medical officers at the scene before his body was taken to Sungai Buloh Hospital," he said in a statement yesterday. Hafiz added that the victim's body would be handed over to the Sungai Buloh Armed Forces camp before being taken back to his hometown in Kota Samarahan, Sarawak, for burial arrangements. He also said the case is being investigated under Section 41(1) of the Road Transport Act 1987 for reckless or dangerous driving causing death, and investigations into the 39-year-old lorry driver is ongoing. "Members of the public who witnessed or have information about the incident are urged to assist with the investigation and may contact Traffic Investigating Officer Inspector Che Hassan Ambok at 013-3940423 or the Sungai Buloh police headquarters operations room at 03-61561222."

PETALING JAYA: The Nissan Navara driver who rammed into a motorcycle ridden by a husband and wife, causing them to be thrown off and seriously injured on the North-South Highway near Duta Toll Plaza two weeks ago, has now been sentenced to six months in prison, replacing the original 30-day sentence. The decision was made by Kuala Lumpur High Court judge K Muniandy after reviewing the sentence imposed by the magistrates' court on car accessories salesman K Darmaraju, 32. However, Muniandy maintained the RM12,000 fine and five-year driving license suspension as previously decided. On May 13, magistrate Khairunnisak Hassni imposed a 30-day prison sentence starting from the arrest date on May 11, as well as a RM12,000 fine or 12 months imprisonment if the fine was not paid, after the accused pleaded guilty to reckless driving on the North-South Highway heading toward the city center at around 2.30pm on May 10. 'The RM12,000 fine has already been paid by the accused. The 30-day prison sentence passes in the blink of an eye compared to the suffering of the victims who suffered permanent disabilities and now completely depend on their family and hospital treatment.' 'For the court's information, Suhailiza Shamsudin, 49 (the motorcycle passenger) is still being treated in the Intensive Care Unit (ICU) due to brain hemorrhage,' he said during the court proceedings, today. He also informed that the magistrates' court's failure to consider public interest in sentencing had drawn criticism from the public, who demanded stricter action and heavier sentences be imposed on the Nissan Navara driver. 'The prosecution requests that a deterrent sentence be imposed not only as a lesson to the accused but also to society to not repeat such actions,' he was quoted as saying in the report. Mohd Sabri further said the case should serve as a reminder to the public about the risks, effects, and consequences of reckless driving while emphasising that public interest should be prioritised in such cases. He also asked the court to consider the actions of the accused who drove dangerously by speeding and overtaking the motorcycle from the right side, even though the motorcycle was moving straight in the leftmost lane. 'The accused also left the scene without stopping or providing any assistance after ramming into the motorcycle ridden by the victims.' 'As a result of the collision, motorcycle rider Faizal Mat, 53, suffered a broken collarbone and ankle injuries, while the passenger, Suhailiza, suffered head bleeding, a broken ankle, and fractured right ribs.' 'Both victims were rushed to Sungai Buloh Hospital for further treatment. This incident clearly shows the serious impact of the accused's fast and reckless driving,' he said. He said a witness to the incident also confirmed the accused's behavior based on a one-minute dashboard camera recording showing the Nissan Navara vehicle speeding and hitting the right side of the motorcycle, causing Faizal to lose control while Suhailiza was thrown from the motorcycle. The prosecutor informed that Darmaraju had disregarded the safety of other road users. 'The offense committed by the accused not only caused property damage but also involved two victims who were affected by the accused's reckless driving.' KUALA LUMPUR: The driver of a Nissan Navara involved in a collision with a motorcycle near the Duta Toll Plaza on May 10 will now be behind bars for six months instead of the previously sentenced 30 days. This came after High Court judge K. Muniandy reviewed the magistrate's court's 30-day sentence and increased the jail term against car accessories salesman K. Darmaraju, 32. Muniandy, however, maintained the RM12,000 fine as well as the five-year suspension of his driving license as imposed by the magistrate's court. On May 13, magistrate Khairunnisak Hassni sentenced Darmaraju to 30 days jail from his arrest on May 11 and imposed a RM12,000 fine, in default 12-months imprisonment, after he pleaded guilty to reckless driving on the North-South Expressway towards the city centre at 2.30pm on May 10. Deputy public prosecutor Mohd Sabri Othman today submitted that the 30-day jail term and the RM12,000 fine did not reflect the aim of the law amendments and the commitment of the parliament to protect the rights and safety of road users. "The RM12,000 has already been paid by the accused. The 30-day jail term passes in the blink of an eye, compared to the victims who suffer permanent disability and are dependent on their family's help and hospital treatment. "For the court's information, Suhailiza Shamsudin (who was riding pillion) is still being treated at the Intensive Care Unit (ICU) due to bleeding in her head. "The failure of the magistrate to consider the public interest in this case has led to public criticism, with calls for heavier penalties and stricter action to be taken against the driver of the Nissan Navara. "The prosecution seeks a deterrent sentence to serve as a lesson not only to the accused but to the public who intend to commit the same act. "This case should serve as a reminder to the public on the risks, impact and consequences of driving recklessly, and public interest should be emphasised in such cases," he said. Sabri had told the court to consider Darmaraju's reckless driving as he had driven at high speed and dangerously overtook the motorcycle, which was going straight on the left most lane. He said the accused had immediately left the location without stopping. "As a result of the collision, the rider, Faizal Mat,53, suffered a fractured collarbone and a laceration to the ankle while Suhailiza, 49, who was riding pillion, suffered bleeding in the head, a broken ankle and a fractured right rib. "They were brought to the Sungai Buloh Hospital. This clearly showed the great impact of the accused's driving at high speed at the time," he said. Sabri also said an eye-witness had confirmed Darmaraju's reckless driving as seen in a one-minute dashcam video of the incident, which clearly showed him ramming the right side of the motorcycle, which caused Faizal to lose control of his machine while Suhailiza fell off the machine. The prosecutor said Darmaraju had disregarded the safety of other road users. "The offence by the accused had not only caused property losses, but there were two victims who were affected by the accused's reckless driving. "The commitment to preserve the safety of motorists can be seen in the long imprisonment and high fine as provided in Section 42 of the Road Transport Act. "This shows the commitment of the parliament to protect the rights of road users and to deter inhumane acts against one another," said Sabri. Lawyer S. Vinesh, who represented Darmaraju, requested the High Court not to interfere with the decision made by the magistrate's court. Lawyer T. Daneish also represented Darmaraju, while deputy public prosecutor Harvind Raja Gopal appeared alongside Sabri.

KUALA LUMPUR: City police are looking into claims that the driver of a pick-up truck, which appeared in a viral video sideswiping a couple on a motorcycle in an expressway here, was racing with other pick-up trucks. The driver allegedly fled the scene after causing the motorcycle to crash. As a result, both the rider, 53, and pillion, 49, were injured, with the woman pillion still unconscious in the Intensive Care Unit (ICU) of Sungai Buloh Hospital. Another video footage, believed to be from the dash cam of another vehicle, had since gone viral showing the Nissan Navara chasing after another pick-up truck on the left lane of the North-South Expressway near the Duta Toll Plaza. Seconds later, two other pick-up trucks, believed to be another Nissan Navara and a Mitsubishi Triton, were also seen speeding past the recording vehicle. The video also shows the four vehicles weaving through the lanes as they overtook other vehicles. City police chief Datuk Rusdi Mohd Isa said they were aware of the video footage. "Efforts are being made to identify the other vehicle drivers who netizens claimed were driving recklessly as well. "We urge anyone who has dashcam footage of these other vehicles to come forward immediately," he said. Rusdi said the case was being investigated for reckless driving. The offence is punishable by imprisonment of up to five years and a maximum fine of RM15,000 upon conviction, as well as a suspension of driving licence for at least two years. Rusdi urged those with information on the other pickup trucks to contact the City Police Hotline at 03-2115 9999 or go to the nearest police station.
