Different directions: on the AIADMK and the BJP

Three months after their uneasy revival of electoral ties, the AIADMK and the BJP are yet to find common ground on the nature of government that would be formed in Tamil Nadu were the National Democratic Alliance (NDA) to win next year's Assembly elections. Union Home Minister and the BJP's principal electoral strategist, Amit Shah, had unilaterally declared in April that a 'coalition government' would be formed — a stance that he has reiterated multiple times — and that the BJP will be a part of such an arrangement. However, the AIADMK leader, Edappadi K. Palaniswami, who passively watched Mr. Shah make the announcement, has yet to endorse the idea. He has maintained that the AIADMK would secure an absolute majority on its own. In an interview with The Hindu, he has argued that the people of Tamil Nadu are averse to coalition governments and that the AIADMK would meet their expectations for single-party rule. Just days ago, he had declared, 'we are not naive' to share power. He has clarified that the remark was made in response to the DMK's 'orchestrated campaign' that portrays the BJP as intent on 'swallowing' up the AIADMK. He has also insisted that efforts to create discord between the BJP and the AIADMK would fail and that the alliance remains 'cent per cent' intact. Historically, Tamil Nadu, unlike the other southern States, has never had a coalition government. The DMK and the AIADMK have relied on allies for vote transfers and electoral victories but have avoided sharing power. In a State where regional parties have effectively curtailed the influence of national parties, voters remain wary of any perceived attempts by national parties to dominate regional parties. Against this backdrop, Mr. Palaniswami's reluctance to endorse power-sharing ahead of the polls is understandable — there is no guarantee that he will maintain this stance later. He has also sent mixed signals. On one occasion, he did not directly rule out parting ways with the BJP were a more electorally viable ally — such as actor Vijay's Tamilaga Vettri Kazhagam — to emerge. But he knows that he cannot dictate terms to the BJP, whose backing for his leadership cannot be taken for granted. Mr. Shah has subtly reflected this uncertainty by shifting his phrasing — from saying that the NDA would fight the election under Mr. Palaniswami's leadership to describing it as under the 'AIADMK's leadership'. Regardless of these evolving political dynamics, effective coordination between the cadres of both parties — essential for voter outreach — cannot be achieved when the leadership appears to be pulling in different directions. It is a recipe for confusion and chaos.

Actor Vijay gets Madras High Court notice over party flag copyright infringement

The Madras High Court on Thursday issued notice to actor Vijay and his political party, Tamilaga Vettri Kazhagam (TVK), in a civil suit alleging trademark and copyright infringement relating to the party's flag to the Bar and Bench, Justice Senthilkumar Ramamoorthy issued the notice on a plea filed by GB Pachaiyappan and the trust he represents, Thondai Mandala Saandror Dharma Paribalana Sabai. The matter has been posted for further hearing on July plaintiffs contend that TVK's flag, which was unveiled in August 2024, is both visually and conceptually similar to their registered trademark. The mark consists of a red-yellow-red tricolour with a central circular motif. According to trademark records, Pachaiyappan applied to register the mark on November 28, 2023 under Class 45, which covers 'personal and social services rendered by others to meet individual needs'. The application was made in his individual capacity through his counsel, Newton Reginald, and includes the device mark with the text 'THONDAI MANDALA SAANDROR DHARMA PARIBALANA SABAI' and the Tamil tagline 'VAAZHGA TAMIL – VALARGA THALAIMURAI'. The English translation reads: 'Thondai Zone Witnesses Virtue Upkeep Council; Long Live Tamil – Grow Up Generation'.The suit states that the plaintiffs have been using the flag since 2023 in connection with personal and social services rendered by the trust. These services include the publication of a Tamil magazine titled 'Saandror Kural' and the operation of a YouTube channel bearing the same name. The mark was officially registered under Class 45 on June 1, 2024, and the plaintiffs further claim that the central design is an original artistic work entitled to copyright plaintiffs allege that TVK's use of a similar flag infringes both their trademark and copyright. Trust moves Madras High Court against party flag of Vijay's TVK

The Madras High Court on Thursday (July 17, 2025) ordered notices to Tamilaga Vettri Kazhagam (TVK) and its president C. Joseph Vijay in a civil suit filed against him for having used a 'deceptively' similar colour combination in his party flag as that of Thondai Mandala Saandror Dharma Paribalana Sabai, a registered trust based in Mylapore, Chennai. Justice Senthilkumar Ramamoorthy called for the response of the actor-turned-politician within two weeks after the plaintiff's counsel Ramesh Ganapathy contended the trust had registered its emblem as a trademark by making an application in November 2023. He said, the mark was registered and a certificate was issued to the trust on June 1, 2024. However, in August 2024, the plaintiff trust was shocked to come across the TVK's flag being 'deceptively' similar to its registered trademark. It claimed to have issued a legal notice to Mr. Vijay on May 13, 2025, and received a response on May 31, 2025, stating the TVK was not involved in business or commercial activities and hence, a trademark dispute would not arise. 'The defendants do not even understand that the trademark and copyright protections are available to service providers as well,' the plaintiff trust, represented by its trustee G.B. Pachaiyappan, said. He contended both the trust as well as the TVK were involved in social service and therefore, the use of 'deceptively' similar identification marks would cause confusion in the minds of the people. The plaintiff trust also stated it had been using its trademark on its promotional materials and that it runs a Tamil monthly magazine titled Saandror Kural with the mark. Further, the trust claimed to have a strong social media presence by running a YouTube channel too, which had gathered a considerable amount of goodwill and reputation for the trademark.] The trust urged the court to grant a permanent injunction restraining the TVK from using the latter's current flag and also sought a similar interim injunction. Stating that the larger question as to whether this dispute would fall under the trademark dispute would have to be examined in detail, the judge said, that issue could be gone into only after the defendants file their response.
