Bengaluru: In a major development, the Special Court for Economic Offences in Bengaluru has granted conditional bail to jailed actress Ranya Rao on Tuesday. The court has also granted relief to the second accused Tarun Raju by allowing his bail petition. The accused have sought bail on the grounds of non-submission of the charge sheet against them by the Directorate of Revenue Intelligence (DRI) even after 60 days. Considering the plea, the court has granted bail. The court has asked the accused not to leave the country without prior permission of the court. The matter has been adjourned to June 2. Senior counsel Girish made submissions for Ranya Rao. The court has directed the accused persons to provide provide surety by two persons and also furnish a bond of Rs 2 lakh each. The court said that the applications filed by accused under the Section 187(3)(ii) of Bharatiya Nagarik Suraksha Sanhita Act were allowed. The court has directed Ranya Rao and Tarun Raju to appear before this court on all the dates of hearing without fail. They are further directed not to tamper or hamper the prosecution witnesses and to co-operate with the Investigating Officer's investigation. Ranya Rao, the stepdaughter of senior police officer Ramchandra Rao, was arrested on March 3 for allegedly smuggling 14.2 kg of gold, valued at more than Rs 12.56 crore. Ranya Rao and the other two accused in the case are currently lodged at the Bengaluru Central Prison. On May 13, the Karnataka High Court directed the Union government to file its objections within two weeks in connection with the petition filed by Ranya Rao, challenging the invocation of the COFEPOSA Act against her in the gold smuggling case. The Conservation of Foreign Exchange and Prevention of Smuggling Activities Act, 1974 (COFEPOSA), has been invoked against Ranya Rao. The Central Economic Intelligence Bureau (CEIB), a nodal agency under the Ministry of Finance, has invoked the COFEPOSA Act against the actress and other accused in the gold smuggling case as per the recommendation of the DRI, probing the case. The bench has asked the Central government to file the objections within two weeks and adjourned the matter to June 3. A vacation bench of Justice H.P. Sandesh and Justice Ramachandra Huddar gave the directions while looking into the petition by Ranya Rao seeking to declare that imposing the COFEPOSA Act against her is illegal and 'void ab initio' (void from the beginning). In legal contexts, 'void ab initio' means that a contract, agreement, or other action is considered invalid and has no legal effect from the moment it was created. Ranya Rao submitted that the constitutional provisions are violated in her case, and the grounds of her detention are erroneous and display a lack of application of mind.

The mother of Kannada film actor Ranya Rao, arrested in a high-profile gold smuggling case, has approached the Karnataka High Court seeking relief from a preventive detention order issued under the stringent Cofeposa Act. HP Rohini, who filed the habeas corpus petition on Thursday, has asked the court to declare that any detention of her daughter under the Conservation of Foreign Exchange and Prevention of Smuggling Activities Act would be legally untenable. The matter came up for hearing before a vacation bench of Justices H P Sandesh and Ramachandra Huddar. 'The Centre is expected to file its response when the case resumes on June 3,' said an official in the know of the development. Ranya Rao was taken into custody on March 3 by the Directorate of Revenue Intelligence (DRI) for allegedly bringing in 14.2 kilograms of foreign-origin gold from Dubai through Bengaluru's Kempegowda International Airport. Officials estimate the value of the seized consignment at ₹12.56 crore and claim that the accused attempted to evade customs duties totalling ₹4.83 crore by taping the gold to her body using bandages. If enforced, the Cofeposa order would allow the authorities to hold Rao and her co-accused in custody for up to one year without regular judicial proceedings, even if they were to be granted bail. Earlier in April, the karnataka high court issued a notice to the Directorate of Revenue Intelligence (DRI) over the bail application filed by Kannada actor Ranya Rao, who is currently in judicial custody for her alleged involvement in a gold smuggling case. Ranya Rao, listed as the first accused in the case, was arrested on March 3 at the Kempegowda International Airport in Bengaluru. DRI officials claimed to have seized 14.2 kilograms of gold bars valued at ₹12.5 crore from her possession upon her arrival from Dubai. The agency said the gold, if imported legally, would have attracted import duties worth ₹4.83 crore under the current 38.5% rate. Her alleged accomplice, Telugu actor Tarun Konduru Raju, also remains in custody after his bail plea was rejected. According to the DRI, both actors were in the UAE at the same time, but Raju returned to Hyderabad while Rao landed in Bengaluru, where the smuggling was detected. Following her arrest, two other individuals have also been taken into custody in connection with the case—Tarun Raju, identified as the second accused, and Sahil Jain, listed as the third accused. All three are presently under judicial custody, with their remand extended until April 21. The development comes as on Monday, a Bengaluru Sessions Court also denied bail to Tarun Raju, upholding the earlier decision of the Magistrate Court. His plea was filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, but the court found no justification to overturn the previous order. Raju was arrested on March 10, a week after Rao's arrest, with officials confirming that he had accompanied her on a trip to Dubai prior to the alleged smuggling attempt.

Officials recovered 14,213.05 grams of gold, valued at Rs 12,56,43,362, concealed around her waist and calf muscles using crepe bandages and tissues. The DRI informed the High Court that since 2023, Ranya Rao and Tarun Raju had traveled to and from Dubai 34 times. Regarding the arrest memo, the agency told the court that it was handed over to Ranya Rao's husband, Jatin, and it contained the grounds of arrest, reasons to believe, and the necessity for arrest. During arguments, counsel for Ranya Rao alleged that the DRI manipulated the documents presented before the courts, claiming that different sets of documents were produced. He further contended that the offences are compoundable as the maximum sentence does not exceed seven years. Meanwhile, a detention order under the Conservation of Foreign Exchange and Prevention of Smuggling Activities Act (COFEPOSA) was passed against Ranya Rao by the Central Government on April 22.
