Madras HC slaps Rs 30,000 costs on ED for not filing counter affidavits in Tasmac scam case
CHENNAI: In what is considered to be a first-of-its-kind move, the Madras High Court on Wednesday imposed costs of Rs 10,000 each, for three petitions, on the Enforcement Directorate (ED) for failing to file counter affidavits to the petitions moved by film producer Akash Bhaskaran and businessman Vikram Ravindran over the search and seizure operations held in their offices and residences for money laundering connected to the alleged Tasmac scam. The order imposing costs was passed by a division bench of Justices M S Ramesh and V Lakshminarayanan after taking seriously the failure of the ED to file the counter affidavits despite giving it a last chance. The bench termed it 'unfair' on the part of the central agency for not having come up with the counter affidavit. Special public prosecutor N Ramesh, appearing for ED, submitted that the counter affidavit was being prepared as a comprehensive one encompassing the three petitions and so, it could not be completed on time. He sought more time to file it.

Tasmac to start transfer counselling for 24,000 staff
CHENNAI: For the first time since it became the sole retail vendor of alcohol in the state in 2003, the Tamil Nadu State Marketing Corporation (Tasmac) has commenced work for a state-wide transfer counselling to rationalise the deployment of its roughly 24,000 sales staff in the 4,826 retail outlets it runs. Tasmac officials said the intent behind the move is to streamline the operations through effective deployment of staff based on the sales volume of the outlets and to prevent scope for irregularities, especially by those working in the same outlets for several years. The sales staff include salesmen and supervisors. A senior official told TNIE the shops have been divided into four categories based on their daily sales volume - above Rs 10 lakh, between Rs 5 lakh and Rs 10 lakh, between Rs 2 lakh and Rs 5 lakh, and below Rs 2 lakh. 'So far, staff transfers were done within the same district. But we found that some salesmen have been working in the same shop for over 10 years, mainly due to the influence they wield because of their political or union affiliations. This has led to bribery and favouritism,' the official said. The official said Tasmac has decided to transfer those who have been in the same outlet continuously for more than 10 years. 'We are going to conduct state-wide counselling for staff transfers for the first time since 2003,' the official added. T Dhanasekaran, general secretary of the Tamil Nadu Tasmac Employees Association, affiliated to All India Trade Union Congress, urged the state to first frame service rules before conducting the state-wide counselling. 'We have been working for more than 20 years, but there is no clear service rule, no promotion, proper week-off, medical allowance or regular wage revision,' he said.

Madras HC imposes cost on ED for failure to file counter affidavit
Chennai, Aug 6 (PTI) The Madras High Court on Wednesday imposed a cost of Rs 30,000 on Enforcement Directorate for its failure to file counter affidavit, despite giving two opportunities earlier, to the petitions filed by film producer Akash Baskaran and businessman Vikram Ravindran. A division bench comprising Justices M S Ramesh and V Lakshminarayanan imposed the cost and posted to August 20, further hearing of the case. Originally, Akash and Vikram challenged the action of the ED in conducting search and seizure in connection with the alleged Rs 1,000 crore Tasmac money laundering case. The bench had on June 20 stayed all further proceedings, pursuant to the Enforcement Directorate's authorization to conduct search and seizure, against Akash Baskaran and Vikram Ravindran in the alleged Rs 1,000 crore Tasmac money laundering case. Thereafter, the case came up for hearing twice. On both the occasions, Special Public Prosecutor N Ramesh sought time to file a counter affidavit. When the case came up for hearing on Wednesday, again SPP Ramesh sought time to file a counter affidavit. Following this, the bench imposed a cost of Rs 10,000 each in respect of three petitions filed by Akash and Vikram. Tasmac shops delay digital payment on handheld devices
Chennai: Months after implementing end-to-end computerisation, Tasmac management has not asked its retail vending shops to accept digital payments on the handheld scanner devices. This allows salesmen to charge customers beyond the maximum retail price (MRP). A year ago, Tasmac began end-to-end computerisation of its entire operations. Sources confirm that all 4,787 shops in 38 districts are now covered under the scheme. Each shop has been provided with handheld devicesat least two for each shop and more for the busier one. The device has options to accept payment by cash, cards, and UPI . But since the devices scan only the MRP, salesmen don't use them and instead ask for cash or swipe cards on separate PoS machines, and collect 5 to 20 extra per bottle. Later they manually tally the sales on the server. But some Tasmac supervisors say they did not receive any such instructions. Tasmac employee union general secretary D Dhanasekaran said the digital payment option has not been enabled on the handheld scanners yet. "These devices are slow. We end up staying back in shops till 11pm to submit the stock report. If we were to start accepting payments on the devices, it will delay us further. Tasmac must upgrade these devices before implementing digital cash acceptance," he said. Tasmac officials say they are integrating PoS machines with the handheld devices to curb MRP violations.
