The Porsche crash case took a new turn on Wednesday after advocate Sudhir Shah told the court that Dr Ajay Taware, who has been accused of swapping blood samples, was not present at the hospital when the 17-year-old was brought in for medical examination following the accident. The minor, allegedly intoxicated at the time, had driven a Porsche into two young IT professionals - Aneesh Awadhiya and Ashwini Koshta - hailing from Madhya Pradesh, killing them instantly in the Kalyani Nagar area. (HT FILE) Shah argued that the charges related to forgery, criminal conspiracy, and destruction of evidence under the Indian Penal Code (IPC), hence, do not apply to his client. Dr Taware, former head of the Forensic Medicine department at Sassoon General Hospital, has been accused of tampering with blood samples to shield the juvenile involved in the fatal May 19 crash. The minor, allegedly intoxicated at the time, had driven a Porsche into two young IT professionals - Aneesh Awadhiya and Ashwini Koshta - hailing from Madhya Pradesh, killing them instantly in the Kalyani Nagar area. The prosecution has maintained that DNA evidence proves the accused's blood sample was swapped with that of his mother to conceal alcohol consumption, and that the act was part of a coordinated attempt to destroy crucial evidence. Dr Taware, along with nine others, has been charged under multiple IPC sections, including Section 467 (forgery of valuable security), Section 464 (making a false document), Section 120B (criminal conspiracy), and Section 201 (causing disappearance of evidence). However, Shah contended that no direct evidence links Dr Taware to any conspiracy. 'There is no material to show his involvement in the sample swap or any act of forgery,' he said, urging the court to drop the charges under Sections 467, 464, 120B, and 201. Meanwhile, co-accused, Ashpak Makandar, has filed a discharge application, while another accused, Ashish Mittal, has moved the court seeking copies of relevant case documents. Special public prosecutor Shishir Hiray refuted the defence's arguments, stating that the state has technical and scientific proof, including DNA reports, to substantiate the allegations of conspiracy and deliberate evidence tampering. Draft charges have been filed under several IPC sections, including 304 (culpable homicide not amounting to murder), 279 (rash driving), 338 (causing grievous hurt by act endangering life), 213 and 214 (bribery to screen offenders), 466 (forging public documents), 468 and 471 (forgery for purpose of cheating and using forged documents), 109 (abetment), as well as relevant provisions of the Motor Vehicles Act and the Prevention of Corruption Act. The court has scheduled the next hearing for July 8, when defence lawyers for the other accused will continue their arguments. Separately, the prosecution has intensified its push before the Juvenile Justice Board (JJB), urging it to try the 17-year-old accused as an adult, citing the 'heinous' nature of the crime. The application for an adult trial was filed over a year ago by Pune Police, but the matter has seen multiple delays, including procedural adjournments and pending assessments.

Maharashtra Deputy Chief Minister Ajit Pawar won an easy victory from the seat he was contesting from for the post of directorship of the Malegaon Cooperative Sugar Mill in Baramati. Till 10 pm on Tuesday, besides Ajit Pawar's seat, leads of 12 others of the 21 seats were available with Ajit Pawar's Neelkantheshwar panel leading in 11. A cooperative election veteran and Ajit Pawar's arch rival Chandanrao Taware's Shetkari Sahakar Bachav panel was leading in the other seat. The election for the Malegaon Cooperative Sugar Mill has been the talk of the town — and the state — as Ajit Pawar took on his uncle Sharad Pawar and cousin Supriya Sule. Taware, who has long fought what he calls the 'hegemony of the Pawars' in Baramati, had fielded his panel comprising local farmers. While both the Pawars were on opposite ends of the electoral battle, the Tawares are BJP supporters, which did not deter Ajit Pawar to stand against the Tawares or to declare that he would be the chairman of the mill if he gets elected. Counting for the 21 seats started on Tuesday morning but due to extensive cross-voting between panels, it was off to a slow start. By 10 pm, leads in 13 seats were available. Ajit Pawar won his seat with a thumping majority, which was a foregone conclusion. In the other 12 seats, which included seats reserved for women, OBC and other categories, Ajit Pawar's panel was leading in 11 though by a slender margin. Taware's panel was lead in the other seat. Voting for cooperative bodies are carried out using ballot papers, which are then counted manually. Trends showed over 19,000 voters have voted across panels, which slowed down the counting process. The Sharad Pawar-supported panel, it seems, has not been able to make an impact with the voters with the fight mainly between the Ajit Pawar-led panel and the one led by the Tawares. Going by the trends, Ajit Pawar is expected to win majority of the seats.

Pune: There is sufficient evidence relating to criminal conspiracy to prove the involvement of Dr Ajay Taware, suspended head of Sassoon General Hospital's forensic science department, in the Porsche Taycan car crash case, the prosecution told a special court on Thursday. Opposing Taware's discharge plea, special public prosecutor Shishir Hiray argued that the doctor claimed he was on leave on the day of the incident, but an examination of his call detail records showed that he was in touch with the suspended employees and influenced them to manipulate the blood alcohol tests of the three at the behest of their parents. Hiray submitted that witnesses gave statements and recorded confessional statements under section 164 of the Criminal Procedure Code (CrPC) before a magisterial court and these showed that Taware played a key role in the conspiracy. On the claims made by Taware that his arrest was illegal, the prosecution said that the chargesheet, remand reports, and case diary showed that he was communicated the reasons behind his arrest in writing and that his signature was also obtained on the arrest memo. The investigating officer, at the time of arresting the doctor, complied with the mandatory provisions of CrPC, he said. Judge K P Kshirsagar posted the hearing on June 10 when Taware's lawyer will argue the matter. Taware was also arrested in the kidney swab transplant case on May 28, the prosecutor told the court, adding that the state health department and Sassoon hospital received complaints against him.

Pune: A court on Wednesday rejected the prosecution's plea to extend by seven days the police remand of Dr Ajay Taware, suspended head of Sassoon General Hospital's forensic science department, in connection with the kidney transplant case. He was arrested in relation to the 10 kidney swap transplants that were cleared by the regional authorisation committee for organ transplant, which he headed in 2022. Assistant public prosecutor Nitin Adagale told the court that the investigating officer, ACP (crime) Ganesh Ingale, in the remand report cited several reasons for Taware's questioning as the investigations had made sufficient progress. Probe found discrepancies in the information provided by the donors and recipients as well as in the video recordings of their interviews conducted before the authorisation committee, Adagale said. Police aimed to determine if Taware received any pecuniary benefits from the crime, he said. Judicial magistrate first class S R Badve, in his order, said, "The grounds mentioned in the remand report are not well-founded and justified with respect to the accused. Custodial interrogation of the accused is not necessary." The court remanded Taware in magisterial custody till June 17. Pune: The prosecution on Monday told a magisterial court that police needed sufficient time to question Dr Ajay Taware, the suspended Sassoon General Hospital doctor, in custody in relation to the 10 kidney swap transplants that were cleared by regional authorisation committee for organ transplant in 2022 when he was heading it. Assistant commissioner of police (crime) Ganesh Ingale and his team produced Taware before the court at the end of his initial police remand. Prosecutor Digambar Khopade submitted that police had already secured the relevant papers, video evidence of interviews of donors and receivers in these 10 transplant cases from Sassoon hospital, bank details, and related documents. Taware has so far not cooperated with police, he said. Defence lawyer Sudhir Shah said that his client had been wrongly implicated in the case. After hearing both sides, judicial magistrate first class S R Badave extended Taware's police custody till June 4. They could not provide satisfactory replies to the questions posed by the committee, he submitted. There were discrepancies in the statements of a man and a woman, who were shown as organ donor and recipient, pertaining to the sale of their agricultural land, the prosecutor said. Police are in the process of analysing Taware's bank accounts to determine if he received any pecuniary benefits from the crime. His call detail records are also being analysed for the purpose of collecting evidence, he added.
