Oreo maker Mondelez sues Aldi, alleging grocery chain copies its packaging to confuse customers

Snack food maker Mondelez International is suing the Aldi supermarket chain, alleging the packaging for Aldi's store-brand cookies and crackers "blatantly copies" Mondelez products like Chips Ahoy, Wheat Thins and Oreos. In a federal lawsuit filed Tuesday in Illinois, Chicago-based Mondelez said Aldi's packaging was "likely to deceive and confuse customers" and threatened to irreparably harm Mondelez and its brands. The company is seeking monetary damages and a court order that would stop Aldi from selling products that infringe on its trademarks. Aldi didn't respond to messages seeking comment. The U.S. branch of Aldi, which is based in Batavia, Illinois, was named in the lawsuit. In the lawsuit, Mondelez displayed side-by-side photos of multiple products. Aldi's Thin Wheat crackers, for example, come in a gold box very similar to Mondelez's Wheat Thins. Aldi's chocolate sandwich cookies and Oreos both have blue packaging. The supermarket's Golden Round crackers and Mondelez's Ritz crackers are packaged in red boxes. Aldi, which was founded in Germany, keeps prices low by primarily selling products under its own labels. It's one of the fastest-growing grocery chains in the U.S., with more than 2,500 stores in 39 states. On Friday, the company announced that its current chief operating officer, Atty McGrath, would become Aldi's U.S. CEO on Sept. 1. The chain has faced lawsuits over its packaging before. Last year, an Australian court found that Aldi infringed on the copyright of Baby Bellies snack puffs for young children. In that case, Aldi's packaging featured a cartoon owl and similar colors to the name-brand packaging. Earlier this year, a U.K. appeals court ruled in favor of Thatchers, a cider company, which sued Aldi over design similarities in the packaging of its lemon cider. Mondelez said in its lawsuit that the company had contacted Aldi on numerous occasions about "confusingly similar packaging." Mondelez said Aldi discontinued or changed the packaging on some items but continued to sell others. The lawsuit also alleges that Aldi infringed on Mondalez's trade dress rights for the packaging of Nutter Butter and Nilla Wafers cookies, and its Premium cracker brand.

The Somerset flag has been flown in all corners of the world to celebrate Somerset BBC Radio Somerset presenters were challenged to fly the flag for Somerset in as many breath-taking locations, or as far away from the county, as possible. Presenter Andy Bennett managed to get the flag on to the windows of Dave's Coaches from TV show Gavin and Stacey, while Mel Everett flew in a hot air balloon with the Day is celebrated on 11 May and marks Alfred the Great's call to the people of Somerset to march against the invading Viking army. It is now a celebration of all that is "great" about Somerset. Dave's Coaches, a fictitious company from the TV show Gavin and Stacey, drove the Somerset flag around Barry Island in South Wales. Mel Everett flew the flag on top of Dunkery Beacon in Exmoor. The Somerset Patriots Baseball Team in Somerset County, New Jersey, USA, wished a happy Somerset Day. The flag was flown high into the sky on the Navy Wings aircraft. Cider company Thatchers agreed to fly the Somerset flag on their lorries for the next year. The flag was also displayed on the caves at Wookey Hole. Mel Everett held the flag up while going down the Hangloose Eden Project zip wire. Simon Parkin managed to get the flag to Hollywood and displayed it next to jazz musician Benny Goodman's star on the Hollywood Walk of Fame. Mel Everett flew the flag up into the air on a hot air balloon.

Nature reserve gets apple trees from leading cider maker

A LEADING cider brand has donated apple trees to aid the restoration of an orchard in a local nature reserve. Thatchers have donated apple trees to Saltwells Nature Reserve as part of its Community Orchard Project. Volunteers from the Friends of Saltwells Nature Reserve group planted the trees last weekend (March 15) in the nature reserve's old orchard site that had previously remained unmanaged for over 20 years. The trees planted include a wide range of apple varieties, including the popular eating apple, Katy, and Bramley, a favourite for cooking. It is part of an ongoing project to bring what was the Old Saltwells House site back into the nature reserve as a community space. 'This is one more piece in the puzzle to make the area better for people to visit and to enjoy being outdoors in nature, making a difference to people's wellbeing and improving the environment for the long term.' Fourth generation Thatchers Cider maker, Martin Thatcher, added: 'We are delighted to be donating these apple trees through our Community Orchard Project'. With the new trees, it is hoped the restored orchard will be a longstanding asset to Saltwells Nature Reserve.
