Publishing traffic violators' names on portal invades privacy: Ferreira

Aldona MLA Carlos Alvares Ferreira on Monday said publishing the names of traffic violators online invades their privacy, and that if a violator isn't prosecuted before the end of six months of being issued a challan, it is the fault of the transport department.
'Issues related to payment of (transport department) portal does not work. When a person tries to pay an old fine that is now notified, it does not allow payment. If it (the fine) is fresh, it allows payment. This is the reason for the long queue seen in Panaji for payment of fines,' Ferreira said.
'There is another thing. A person was issued a challan of Rs 13,500 based on CCTV footage. There is no time and date, but five to six offences are listed against him, one contradicting the other.
When I asked one of your officers, he said let him visit the office, and if he has not violated, we will challan the rest of the violations. This is not the way,' the MLA said.
'There is another matter which I think is of very serious concern regarding publishing data of traffic violators on the portal. This, according to me, is an invasion of privacy,' he said. 'The law is very simple. You need to file a complaint in the court within six months if it is only fines, as per the Code of Criminal Procedure.

If you don't file within six months or file even one day after six months, I can say that your case is time-barred.
If your proceeding itself lapsed after six months, how can you show the person on your website as a defaulter? It is your fault for not initiating prosecution.'
Ferreira further said that there is no proper bus stop in the state and no signage at bus stands. Lack of signage leads to people sitting at the bus stand for hours without knowing when the bus will arrive, he said.
