Appeal filed by Maulana Arshad Madani before IB Ministry seeking halt of 'Udaipur Files'
New Delhi [India], July 15 (ANI): A petition was filed by Jamiat Ulema-e-Hind President Maulana Arshad Madani before the Delhi High Court seeking a ban on the Hindi movie 'Udaipur Files', which is based on tailor Kanhaiya Lal Teli's murder in Udaipur. The film was scheduled to be released on July 11. A day before its release, the Delhi High Court stayed the release of the film 'Udaipur Files' till the Centre decides the revision plea of the petitioners, including that of Jamiat Ulema-e-Hind President challenging the grant of the Central Board of Film Certification (CBFC) certification. Following the High Court's direction to file an appeal regarding the stay on the screening and reconsideration of the certificate issued by the Censor Board, Maulana Arshad Madani's lawyers on Monday submitted an appeal before the Ministry of Information and Broadcasting. It is expected that the Ministry may hold a hearing on this application in the coming days. Meanwhile, the film's producer, Amit Jani has challenged the Delhi High Court's decision in Supreme Court of India. On the request of the film producer's lawyer, Senior Advocate Gaurav Bhatia, Justice Surya Kant and Justice Joymalya Bagchi assured that the petition will be heard. Maulana Arshad Madani also filed a caveat in Supreme Court. Senior Advocate Kapil Sibal, will represent Maulana Arshad Madani in Supreme Court. In the petition submitted to the Ministry of Information and Broadcasting on behalf of Maulana Arshad Madani, it has been stated that films like 'Udaipur Files' promote division within society and that the promotion of such a film will tarnish India's image globally. The petition further states that Hindus and Muslims have lived together peacefully in our country for centuries, and therefore, the screening of such films could pose a serious threat to communal harmony. It is emphasized that the entire film is based on hatred, and its exhibition could disturb the peace and harmony of the nation. The Government of India has also been reminded that in the past, India faced international embarrassment and condemnation due to the remarks made by Nupur Sharma. At that time, the Government of India had issued a diplomatic statement affirming that India respects all religions and communities and removed Nupur Sharma from her position as spokesperson as a consequence of her remarks. It was due to these actions that some of the mistrust toward India on international platforms was reduced, and the country's image saw a relative improvement. The Government of India has also been informed that the past and present conduct of the filmmaker, Amit Jani, is filled with instances of incitement and disruptive behavior. Secondly, the film presents fabricated content that has no connection with reality. It also depicts the character of Nupur Sharma, whose controversial statement sparked nationwide protests and international outcry. The petition further states that despite the removal of 55 scenes, the film still appears largely unchanged. It is argued that the promotion of this film could incite violence in the country. The petition emphasizes that this film is not in the national interest, and therefore, the certificate granted for its screening should be revoked. As per the Delhi High Court's directive, the Ministry of Information and Broadcasting must hear Maulana Arshad Madani's appeal and deliver a decision within one week. In the meantime, the ban on the film's release will remain in effect. (ANI)

SC to hear plea against stay on 'Udaipur Files' release
New Delhi, July 14 (UNI) The producers of the movie 'Udaipur Files' moved the Supreme Court today challenging the Delhi High Court's order staying its release. The matter was mentioned today before a bench comprising Justice Surya Kant and Justice Joymalya Bagchi by Senior Advocate Gaurav Bhatia, seeking urgent listing. The Court agreed to list the case for hearing within a day or two. On July 10, the Delhi High Court had directed the Central government to exercise its revisional powers under Section 6 of the Cinematograph Act to examine the movie. The order was passed on petitions, including one filed by Jamiat Ulema-e-Hind President Maulana Arshad Madani, seeking a ban on the film for allegedly vilifying Muslims. The movie is based on the murder of tailor Kanhaiya Lal Teli in Udaipur and was slated for release on July 11. The High Court bench of Chief Justice DK Upadhyaya and Justice Anish Dayal permitted the petitioners to approach the Central government within two days and stayed the release in the meantime. The Court directed that if approached, the Central government shall decide the revision petition within one week after giving the producer an opportunity to be heard. Earlier, the CBFC had informed the High Court that certain offending portions in the film had been removed. The Court then directed the producer to arrange a screening for Senior Advocate Kapil Sibal, representing Madani, and Additional Solicitor General Chetan Sharma, appearing for CBFC. Following the screening, Sibal submitted before the High Court that he was appalled by the movie content, describing it as 'cinematic vandalism.' After a detailed hearing on July 10, the High Court stayed the release of the film while asking the petitioners to seek further relief from the Central government. The producers have now approached the Supreme Court against the stay order. UNI SNG RN

"We have pleaded": Advocate Pulkit Agarwal on Supreme Court agrees to hear plea of 'Udaipur Files' release
New Delhi [India], July 14 (ANI): The Supreme Court has agreed to hear a plea filed by the producers of the movie 'Udaipur Files: Kanhaiya Lal Tailor Murder' challenging the Delhi High Court's order that stayed its release. The plea was mentioned by Senior Advocate Gaurav Bhatia on behalf of the producer of the movie, who stated that the CBFC has already approved the said film and its non-release is violating his fundamental right. On the Supreme Court agreeing to hear the plea against the stay on the release of 'Udaipur Files: Kanhaiya Lal Tailor Murder', Advocate Pulkit Agarwal told the media, 'We have pleaded that the High Court's order, which has stayed the release of the movie, needs to be set aside. We have prayed to the Supreme Court to grant the release of this movie. Senior Advocate Gaurav Bhatia mentioned the matter on behalf of the producer. The court observed orally that the matter would be listed within 2-3 days...' The Delhi High Court recently stayed the release of the movie one day before its official release date. The Delhi High Court on Thursday, July 10, ordered a stay on the release of the film. The stay will remain in effect until the Central Government decides on the revision application filed by Jamiat Ulema-i-Hind against the certification granted by the Central Board of Film Certification (CBFC). A Division Bench of Chief Justice Devendra Kumar Upadhyaya and Justice Anish Dayal passed the interim order while hearing two petitions, one by Jamiat Ulema-i-Hind and another by journalist Prashant Tandon, challenging the CBFC's decision to grant certification to the film. The petitioners argued that the film's release could disturb communal harmony and pose a serious threat to public order, given the sensitive nature of the subject. The Court observed that since the petitioners had been relegated to invoke the revisional remedy under the Cinematograph Act, 1952, the release of the film must remain stayed until a decision is made on their application for interim relief. 'We provide that till the grant of interim relief is decided, there shall be a stay on the release of the film,' the bench stated. 'Udaipur Files' is based on the 2022 murder of Kanhaiya Lal, a tailor in Udaipur, Rajasthan, who was brutally killed in broad daylight by two men allegedly angered by a social media post in support of former BJP spokesperson Nupur Sharma. The incident had triggered national outrage and raised serious concerns about radicalisation and communal violence. The petitioners contended that the film sensationalises the incident and may further inflame tensions. They also raised concerns over the timing of the release, just ahead of upcoming elections in several states. The Court, while not going into the merits of the film itself, held that the legal procedure for challenging CBFC certification must be followed and ensured that no irreparable damage occurs in the interim. New Delhi: Uncertainty over the release of the film 'Udaipur Files' continues as the producers have moved to the Supreme Court challenging the Delhi High Court, which ordered a stay, while the petitioners against the release today presented their case before the Centre. Mr Bhatia told the court that the theatres were set to screen the film on Friday, but the court stayed the release on Thursday at 8 PM. The petitioners had contended before the high court that the sole purpose of the film is to vilify one particular (Muslim) community, and it is the worst form of hate speech. He further informed the court that a partial working day bench of the top court has refused to grant an urgent hearing to stay the release and yet the high court stayed the release. The Delhi High Court last week had stayed the release of the movie till Monday, which is said to be based on the brutal murder of a tailor from Udaipur over a post he shared on social media. While directing the Centre to decide the matter in one week, the high court said that the petitioners can also press the Centre for further stay beyond Monday. The high court, while granting a stay, noted that the producer's reply included an admission that a teaser of the movie was released without certification. "It is thus apparent that the producer has admitted uploading a teaser which contained even portions of the film that were ordered to be taken down," the bench said.
