Guv remembers Birsa Munda, urges youths to fight against social evils
Patna: Recalling legendary Birsa Munda 's fight against the colonial rule and his valuable contributions in India's freedom struggle, governor Arif Mohammad Khan on Monday called upon the modern youths to always fight for the cause of their nation. Inaugurating a two-day national seminar on "Decolonising the Janjatiyas (Tribes): Birsa Munda in the Ulgulan" organised by local Ganga Devi Girls' College in collaboration with the Indian Council of Social Science Research (ICSSR), the governor justified the theme of the seminar and connected Munda's fight for freedom as a motivation for the present generation to fight against various social evils. ICSSR's member secretary Dhananjay Singh talked about the genealogy of tribal culture and urged the students to work for preservation of indigenous culture. National Commission for Scheduled Tribes (NCST) member Asha Lakra pleaded for protecting the rights of the people, particularly women, belonging to various tribes of India, including Uraon, Bhills, Gonds, etc. Director of Tata Institute of Social Sciences (TISS)'s director Badri Narayan Tiwari highlighted the plights of tribal people in the face of globalisation and modernisation. Others who participated in the seminar included JNU's Phirmi Bodo, Delhi University's Nirmal Kumar, and LNMU's retired history professor Ratneshwar Mishra. HC: Admitting photocopy of signed agreement without original improper
Raipur: The Chhattisgarh High Court quashed a trial court order that accepted a photocopy of an 'Ikrarnama' (agreement) as evidence during the cross-examination of a prosecutrix. The High Court ruled that the document, marked as an exhibit, was admitted without proper procedure and in violation of the Indian Evidence Act, 1872. "Unless it is established that the original document is lost or destroyed or is being deliberately withheld by the party, secondary evidence in respect of that document cannot be accepted," the court stated. The Division Bench of Chief Justice Ramesh Sinha and Justice Bibhu Datta Guru allowed a criminal miscellaneous petition filed by Vijay Uraon, who sought to quash the trial court's order dated June 20, 2022. The case involves a complaint filed by the prosecutrix on Feb 24, 2022, alleging that Uraon had sexual intercourse with her under the pretext of marriage and later refused to marry her. Police Station Chandrapur, District Janjgir-Champa, registered a case under Sections 376 and 417 of the Indian Penal Code, and Uraon was arrested on Feb 26, 2022. Uraon's counsel, Ravindra Sharma, argued that the photocopy was accepted in gross violation of Section 66 of the Indian Evidence Act, 1872, as no notice was given to produce such a document. He contended that the acceptance of the document would lead to a miscarriage of justice. The High Court observed that the victim had not filed any application to take the document on record and had not mentioned the 'Ikrarnama' during her statements under Sections 161 and 164 of the CPC. The document was not part of the charge sheet and was produced for the first time during cross-examination in the court. The bench cited Supreme Court judgments in Ashok Dulichand v. Madahavlal Dube and Anr. and Rakesh Mohindra v. Anita Beri and Ors., which reiterate that secondary evidence can only be admitted if foundational evidence is provided explaining why the original is not furnished. The High Court concluded that the trial court's acceptance of the photocopy without recording the petitioner's objection and without the original copy being produced was illegal and improper. The court directed the trial court to expedite the trial and conclude it expeditiously.
