‘State can't object if families agree': SC grants bail to man arrested after inter-faith marriage

The Supreme Court has granted bail to a Muslim man who was arrested by the Uttarakhand Police in December under the state's anti-conversion law after he married a Hindu woman. 'State cannot have any objection to the appellant and his wife residing together inasmuch as they have been married as per the wishes to their respective parents and families,' said a bench of Justices BV Nagarathna and SC Sharma in a judgement delivered on May 19. The bench was hearing a petition by a man named Aman Siddiqui, who was arrested under the 2018 Uttarakhand Freedom of Religion Act and sections of the Bharatiya Nyaya Sanhita for allegedly concealing his religious identity and marrying a Hindu woman under Hindu religious customs, the Hindustan Times reported. Siddiqui was in jail for nearly six months. Siddiqui was booked on December 12, two days after his wedding, on a complaint filed by his wife's cousin, who claimed the family discovered the groom's religious identity only after visiting his home in Delhi. In February, Siddiqui's bail application was rejected by the Uttarakhand High Court, which accepted the prosecution's claim that the man and his family had intentionally concealed their religious identity. It took note as evidence an affidavit submitted by Siddiqui the day after the marriage, wherein he pledged not to force his wife to convert and to respect her religious freedom. The High Court had also stated that the marriage was not conducted under the Special Marriage Act, which is typically followed in interfaith unions. Siddiqui then approached the Supreme Court.

The assaults happened multiple times from January to March this year, police said. Police have confirmed that all three have been arrested, and has been booked under different sections of the POCSO Act and the BNS, including gang rape. According to the police, the minor was gang-raped several times by her mother's boyfriend and his aide, both of whom are in their thirties, in Haridwar, Agra and Vrindavan between January and March this year. The men perpetrated the crime with her mother's consent and in her presence, the police said, adding that they also threatened to kill the minor's father if she disclosed it to anyone. On Wednesday, the Uttarakhand Police arrested Anamika Sharma and her boyfriend, Sumit Patwal, from a hotel in Haridwar after a medical examination confirmed that her minor daughter had been sexually assaulted. Haridwar SSP Pramendra Dobhal also confirmed that Patwal's accomplice, Shubham, was also arrested late on Wednesday night from Shahpur, Meerut. The matter came to light on Tuesday when the minor told her father about her ordeal, following which he lodged a police complaint. A case was registered against the trio under BNS Sections 70 (2) (gang-rape), 351(3) (criminal intimidation), 3(5) (criminal act) by several persons in furtherance of common intention) and relevant sections of the POCSO Act. Sharma was stripped of the party's primary membership once her name surfaced in the case. However, BJP sources in Haridwar claim that she has not held any party post since August 2024, PTI reported. U'khand police cautions against fraudulent donation links for Op Sindoor

Dehradun: The cybercrime unit of Uttarakhand Police issued an advisory on Saturday, warning citizens about fraudulent links being circulated by scammers under the pretext of seeking donations for armed forces personnel involved in Operation Sindoor . The advisory was released after the unit received reports of such links being sent to individuals in the state via messages from unknown numbers. Deputy superintendent of police (DSP) of state cyber crime unit and Special Task Force (STF) Ankush Mishra said that no cases related to this scam have been reported in the state so far. "It has come to light that cyber fraudsters are trying to deceive people on the pretext of Operation Sindoor conducted by the armed forces against Pakistan-based threats. The fraudsters pose as members of the armed forces or govt officials and solicit donations by sharing a link, claiming it is for the welfare of armed personnel involved in the operation. These links are entirely fraudulent and have no association with the armed forces or any official govt platform," he said. He further advised the public not to click on such links. "If someone falls victim to this scam, they should immediately report it by calling the cyber helpline at 1930 or by visiting the nearest police station," he added.
