SC upholds Bengal's reclaiming of land allotted to HM
Kolkata: Supreme Court on Wednesday dismissed a Special Leave Petition filed by Hindustan Motors and upheld Bengal govt's taking back of 395 acres of land at Uttarpara. "This marks the culmination of a prolonged legal battle, during which the state successfully demonstrated that the land remained unutilised for several decades and that its resumption was in the public interest and in accordance with the law," said Debanjan Mandal, who appeared for the state. "The verdict reaffirms the commitment of the state to ensuring optimal use of land resources in furtherance of public welfare and industrial development," Mandal said. SC upholds Bengal's takeover of 395 acres from Hindustan Motors at Uttarpara
New Delhi, July 16 (UNI) The Supreme Court today upheld the West Bengal government's decision to reclaim over 395 acres of land earlier allotted to Hindustan Motors in Hooghly's Uttarpara, where the iconic Ambassador car manufacturing plant was located. A Bench of Justice BV Nagarathna and Justice KV Viswanathan dismissed a plea filed by Hindustan Motors challenging the May 2025 judgment of the Calcutta High Court, which had affirmed the State's right to resume the unused land. The Court declined to entertain the company's arguments, observing that it found no ground to interfere with the High Court's reasoning, which was based on the automobile manufacturer's decades-long non-utilisation of the land. This brings an end to the long-standing legal dispute that began when the State issued a resumption order under Section 6(3) of the West Bengal Estates Acquisition Act, citing prolonged disuse of the land. The order was first upheld by the West Bengal Land Tribunal and later by the Calcutta High Court. The Supreme Court also upheld the High Court's endorsement of the constitutional validity of Explanation II to the proviso to Section 6(3) of the Act, which formed the legislative basis for the State's resumption proceedings. The Court recorded that it saw no infirmity in the High Court's interpretation and refused to interfere. Senior Advocate Shyam Divan, appearing for Hindustan Motors, argued that the resumption order was arbitrary and that the land continued to be part of the company's industrial estate despite being unused. However, the Court was not inclined to disturb the concurrent findings of the Tribunal and the High Court, which held that the resumption served a larger public interest. The decision comes amid the West Bengal government's push for optimal utilisation of industrial land. Just four days ago, the State leased out 40 acres of the resumed 395-acre parcel to Titagarh Rail Systems to set up a state-of-the-art coach manufacturing facility at Uttarpara. According to the State, this facility will augment Titagarh's existing unit and become the largest such plant in Asia outside China. Debanjan Mandal, managing partner, Fox & Mandal, said this marks the culmination of a prolonged legal battle, during which the state successfully demonstrated that the land had remained unutilised for several decades and that its resumption was in public interest and in accordance with law. Fox & Mandal appeared on behalf of the state of West Bengal. When contacted, Uttam Bose, director of Hindustan Motors, responded 'no comments' via text. The Hindustan Motors' Uttarpara plant, which used to roll out the iconic Ambassador car, had declared 'suspension of work' in 2014, which continued. The legal wrangle between the state and the company goes back to 2022. On July 6, 2022, the West Bengal government had expressed its intention to resume the 395 acres of land. By an order dated November 9, 2022, the state resumed the 395 acres, which was challenged by the company and set off legal proceedings. Earlier, the Land Tribunal had upheld the state's decision to resume the land under the West Bengal Estates Acquisition Act, 1953. This was challenged by Hindustan Motors before the Calcutta High Court, which, by its judgment dated May 22, 2025, rejected the appeal and confirmed the state's right to resume the unused land. Earlier in the week, the West Bengal Cabinet approved the transfer of a 40-acre parcel to Titagarh Rail Systems (TRSL). This was part of Hindustan Motors' Uttarpara land and prompted a sharp reaction from the company. In a filing with the stock exchanges on July 15, Hindustan Motors said that on July 11, 2025, at around 11.00 am, officials including the additional district magistrate, Hooghly, accompanied by the BL & LRO, police personnel and several others, without prior intimation, forcibly entered the factory premises and trespassed, intimidated and wrongfully seized the property at the company's premises situated at Hindmotor, Uttarpara. 'The suo motu action taken by the concerned department of the government of West Bengal, despite our special leave petition listed and pending for hearing before the Hon'ble Supreme Court of India, has caused considerable prejudice to our challenge,' it mentioned. However, Wednesday's development in the apex court marks the end of a long road for the country's first carmaker, Hindustan Motors, at Uttarpara — which goes back to 1946.
