Two Form 3 students plead guilty over school assault

SUNGAI PETANI: Two Form 3 male students pleaded guilty at the Magistrate's Court today to a charge of causing hurt to a fellow student at a secondary school last month. The two teenagers, aged 15, admitted to intentionally causing hurt to a 16-year-old male student in the school hall at about 12.15pm on July 21. The offence, under Section 323 of the Penal Code, carries a maximum jail term of one year, a fine of up to RM2,000, or both, upon conviction. The plea was recorded before Magistrate Mohamad Azlan Basri after the charge was read to them. Deputy Public Prosecutor Nur Hazwani Md Nor prosecuted, while the two students were represented by National Legal Aid Foundation (YBGK) counsel Farah Azlinda Zahari. The court allowed bail of RM1,000 each with one surety and ordered them not to harass the victim throughout the proceedings.

KUANTAN, Aug 8 — A grass-cutter was sentenced to eight months in prison after pleading guilty in the Magistrate's Court here today to injuring a police corporal with a machete last Saturday. Magistrate Ellyna Othman passed the sentence on Muhamad Firdaus Abdul Hamid, 37, and ordered his jail term to start from the date of his arrest on August 2. Muhammad Firdaus was charged with intentionally causing harm to Corporal Muhammad Shafril Izzwan Ismail, 37, using a machete and two smaller machetes, which could have caused death. The incident occurred on August 2 at 5.15pm in front of a house in Felda Bukit Kuantan. The charge was framed under Section 324 of the Penal Code, which carries a maximum penalty of 10 years' imprisonment, a fine, or whipping, or any combination of these upon conviction. Deputy public prosecutor Muhammad Firdaus Ahmad Mokhlis urged the court to impose a fitting sentence, considering the public interest and to deter the accused from repeating the offence. Defence counsel Mohd Azlan Mohd Arish@Arshad, from the National Legal Aid Foundation (YBGK), informed that the accused is single and earns RM70 a day. Earlier reports indicated that Corporal Shafril Izzwan was attacked with a machete, sustaining injuries to his back, chin, and left hand, by a man believed to be mentally unstable. The incident took place when police responded to a report of a man causing a disturbance while armed with a machete. — Bernama

TAIPING: A gravedigger was charged in the Sessions Court here today with sexually abusing a nine-year-old boy last Friday. The accused, Muhammed Syahril Reza Omar, 43, who is also a single father of three, pleaded not guilty before Judge Nabisha Ibrahim and requested to be tried. According to the charge sheet, he is accused of committing physical sexual assault on the boy by kissing his face and neck with sexual intent. The alleged incident took place in the women's toilet at Masjid Jamek Taman Yayasan, Kamunting, at 12.30pm on July 11. The offence falls under Section 14(a) of the Sexual Offences Against Children Act 2017 (Act 792), which carries a maximum penalty of 20 years' imprisonment and whipping, upon conviction. The prosecution was led by Assistant Superintendent Shabani Bahari, while Syed Saifullizan Syed Abd Razak from the National Legal Aid Foundation (YBGK) represented the accused. Shabani proposed bail at RM30,000, with additional conditions that the accused must not approach, contact, or harass the victim — who is not related to him — and must report to the nearest police station once a month. Syed Saifullizan appealed for a reduced sum, citing the accused's limited income of RM400 a month from his gravedigger's allowance and the fact that he is a widower supporting three children aged 19, 14, and eight. The court allowed bail of RM8,000 with one surety, and imposed all additional conditions requested by the prosecution. The case has been fixed for mention on Aug 19 for case management and the appointment of legal counsel.

JOHOR BARU: A sand lorry driver was fined RM6,000 after pleading guilty in the Johor Baru magistrate's court today to driving recklessly and causing damage to several public properties along Jalan Johor Baru–Gelang Patah Pendas, in Iskandar Puteri, last Tuesday. The accused, Chew Ah Sing, 69, entered the plea before Magistrate Nur Fatin Mohamad Farid after the charge was read out in Mandarin by the court interpreter. According to the charge sheet, Chew had driven the sand lorry on a public road without due care and attention, with the rear bucket left raised, causing it to strike overhead electrical cables. The incident resulted in damage to the cables, three electricity poles, a traffic light pole, a closed-circuit television (CCTV) camera, and a bus stop. The offence was committed at Kilometre 30.7 of Jalan Johor Baru–Gelang Patah Pendas at around 3.20pm on June 10. The charge was framed under Section 43(1) of the Road Transport Act 1987 (Amendment 2020), which carries a penalty of up to 12 months' imprisonment and a fine of not less than RM5,000 and not more than RM10,000. For a second or subsequent offence, the punishment may include up to 12 months' imprisonment and a fine of not less than RM10,000 and not more than RM15,000. In such cases, the offender's driving licence will be endorsed by the court, and a probationary licence may be revoked upon conviction. Deputy Public Prosecutor Amirah Tasnim Saleh prosecuted the case. In mitigation, the senior citizen, represented by lawyer Sharmaine Fairuz Mohd Zulkifli from the National Legal Aid Foundation (YBGK), pleaded for a minimum sentence, citing his monthly income of RM2,000 and financial responsibility for his wife, mother, and school-going child. However, Amirah Tasnim urged the court to impose a fitting sentence, as the accused's actions had caused damage to multiple public properties. The court imposed a RM6,000 fine, in default four months' imprisonment, and endorsed Chew's driving licence. On the day of the incident, media reports stated that a sand lorry with its rear bucket still raised struck overhead power lines, causing three electric poles to fall near a school. A video of the incident, recorded around 3.20pm and widely shared on social media, showed the lorry hitting the cables before the poles came crashing down. Iskandar Puteri district police chief Assistant Commissioner M. Kumarasan was quoted as saying that the driver claimed he was unaware that the rear bucket had not been lowered.

KUALA LUMPUR: A former registrar of a private university in Perlis pleaded not guilty in the Sessions Court here today to 36 counts of forgery of documents to withdraw RM826,481.29 from the university's funds. Mohd Fairuz Al-Fatah Badarudin, 40, who is also a former special officer at the university, is accused of forging authorisation letters for fraudulent purposes involving a total of RM826,481.29. The offences were allegedly committed at a bank in Jalan Raja Chulan here between June 20, 2022, and July 10, 2023. He is charged under Section 468 of the Penal Code which provides for a maximum jail sentence of seven years and a fine, if convicted. Deputy public prosecutor Ahmad Fariz Abdul Hamid offered bail at RM100,000 in one surety, while G. Sivajothi Pillai, a lawyer from the National Legal Aid Foundation (YBGK) representing the accused, requested a lower bail of RM10,000, on the grounds that her client is currently employed as a lecturer at an aviation training institution, earning RM2,600 a month. 'The accused also has to support his 10-year-old twins, while his 41-year-old wife is currently unemployed after an accident left her with a fractured left leg. He has also fully cooperated with the authorities throughout the investigation,' said the lawyer. Judge Suzana Hussin then allowed the accused bail of RM15,000 in one surety for all charges with the additional condition that the accused to surrender his passport to the court until the disposal of the case. The court set July 17 for mention.
