Cassation Court upholds 10-year sentence for man convicted of storing illicit drugs
AMMAN — The Court of Cassation has upheld a State Security Court (SSC) ruling sentencing a man to 10 years in prison after convicting him of storing a large quantity of illegal narcotics in Mafraq governorate in March 2023. The SSC declared the defendant guilty of possessing large quantities of Hashish and Captagon pills at his home in Mafraq on March 29. The SSC handed defendant Abdul Aziz A., a 15-year prison term for the charges and ordered him to pay JD10,000 in fines. However, the court decided to reduce the sentence to 10 years in prison while maintaining the JD10,000 'to give the defendant a second chance in life'. Court documents said Abdul Aziz A. and two other defendants, who did not appeal their 15-year verdicts, decided to earn quick cash by selling illegal narcotics in the local market. 'The two defendants stored 60 kilogrammes of Hashish and 140,000 Captagon pills at Abdul Aziz A.'s house,' court papers said. The Anti-Narcotics department (AND) received a tip about the stored illicit drugs at the defendant's house and decided to raid the premises, according to court papers. 'The three defendants were arrested and AND agents seized a large quantity of illicit drugs,' court papers added. The defendant contested the SSC's ruling through his lawyer, who argued that 'legal errors were committed during the investigation process'. Meanwhile, the SSC prosecution office asked the higher court to uphold the sentence and the fine imposed on the defendant. The higher court maintained that the SSC had followed the proper procedures in issuing the sentences against the defendant. 'It was clear to the court that the defendant confessed willingly to storing the illegal drugs with the intent of selling them in the local market,' the higher court said. The Cassation Court bench comprised judges Yassin Abdullat, Nayef Samarat, Hammad Ghzawi, Mohammad Khashashneh and Qassem Dughmi.

Cassation Court upholder 6-year sentence for drug dealer
AMMAN — The Court of Cassation has upheld a May 2023 State Security Court (SSC) ruling sentencing a drug dealer to six years in prison after convicting him of selling illegal narcotics to an undercover agent in Muwaqar area in December 2022. The court declared the defendant guilty of possessing a large quantity of illegal narcotics on December 3. The SSC handed the defendant a punishment of six years in prison and ordered him to pay JD6,000 in fines. Court documents said that the Anti-Narcotics Department (AND) learnt the defendant was in possession of a large quantity of illegal narcotics and sent one of its agents to pose as a buyer. 'The AND agent offered the defendant JD4,700 in return for two kilogrammes of Hashish and 4,000 Captagon pills,' court documents said. When the two met, court papers stated, law-enforcement officers immediately apprehended the defendant. The defendant contested the SSC's ruling through his lawyer, who argued that the court 'did not provide solid evidence to implicate his client of illicit drug trafficking'. Meanwhile, the SSC prosecution office asked the higher court to uphold the sentence and the fine imposed on the defendant. The higher court maintained that the SSC had followed the proper procedures in issuing the sentences against the defendant. 'It was clear to the court that the defendant confessed willingly to possessing the illegal drugs to sell them in the local market,' the higher court said. Therefore, the higher court maintained that the defendant deserves the punishment he received. The Cassation Court bench comprised judges Yassin Abdullat, Hammad Ghzawi, Qassem Dughmi, Mohammad Khashashneh and Nayef Samarat.

Cassation Court upholds over 3-year sentence for attempted drug smuggling into correctional facility
AMMAN — The Court of Cassation has upheld a June 2022 State Security Court (SSC) ruling, sentencing a man to over three years in prison after convicting him of attempting to smuggle illegal narcotics to an inmate in Tafileh in 2021. The court declared the defendant guilty of obtaining illegal narcotics with the intent of smuggling them while visiting an inmate at Tafileh Correctional and Rehabilitation Centre (TCRC). The SSC handed the defendant five years in prison for the offence of possessing illegal narcotics and ordered him to pay JD5,000 in fines. However, the court decided to reduce the fine to JD3,500 and the prison term to three years and four months in prison to give the defendant a second chance in life. Court documents said the Anti-Narcotics Department (AND) learnt the defendant was in possession of illegal narcotics and was planning to smuggle it while on a visit to TCRC. When the defendant arrived, the correctional officers searched him and found a small stash of illegal narcotics attached to three fake banknotes, court documents said. The defendant contested the SSC's ruling through his lawyer, who argued that the court 'did not provide solid evidence to implicate his client'. The lawyer argued that 'there were legal errors in the investigation process'. Meanwhile, the SSC prosecution office asked the higher court to uphold the sentence and the fine imposed on the defendant. The higher court maintained that the SSC had followed the proper procedures in issuing the sentence against the defendant. 'It was clear to the court that the defendant confessed willingly to attempting to smuggle the illegal drugs while on a visit to the correctional facility,' the higher court said. Cassation Court upholds 15- and 8-year sentences in drug trafficking case
AMMAN — The Court of Cassation has upheld a July 2023 State Security Court (SSC) ruling sentencing two men to prison terms ranging from eight to 15 prison after convicting them of possessing and trafficking illegal narcotics in Amman in 2022. The court declared the defendants guilty of possessing and trafficking Captagon pills and Hashish in Amman. The defendants received 15-year and eight-year prison terms respectively. They were ordered to pay JD16,000 fines in total. Court documents said the Anti-Narcotics Department (AND) learnt that the defendants possessed illegal narcotics to sell in the local market. They two were placed under surveillance and were arrested at one of the defendants' homes, the court added. Upon searching the house, the court maintained, police found 2,600 Captagon pills and over five kilogrammes of hashish, according to court documents. The defendants contested the SSC's ruling through their lawyers arguing that there were irregularities with the investigation procedures. They also claimed that they were subjected to torture and duress to confess. Meanwhile, the SSC prosecution office asked the higher court to uphold the sentences and the fines imposed on the defendants. The higher court maintained that the SSC had followed the proper procedures in issuing the sentences against the defendants. 'It was clear to the court that the defendants confessed willingly to possessing and trafficking the illegal drugs,' the higher court said. The higher court also ruled that the defendants did not provide any proof that they were subjected to any form of torture or duress.
