Robbery suspect ordered to undergo psychiatric evaluation

BATU PAHAT: A coffee shop worker accused of attempting to snatch a woman's handbag was ordered to undergo a psychiatric evaluation at Permai Hospital after the court found that he did not understand the charge read out to him. The Yong Peng magistrate's court issued the order to Ismail Abu Amin, 48, during proceedings today before magistrate Arun Noval Dass. No plea was recorded from the accused, prompting deputy public prosecutor Farah Wahidah Mohd Sharip to request a mental health evaluation. The court allowed the application and ordered the suspect to be referred to Permai Hospital in Johor Baru for examination under standard procedures. According to the charge, the accused, a divorcee, allegedly attempted to snatch a 31-year-old woman's handbag by forcefully yanking it, causing the strap to snap, at a junction in Jalan Parit Jalil, Parit Sulong, at 11.20am on July 12. He was charged under Section 393 of the Penal Code for attempted robbery, which carries a jail term of up to seven years and a possible fine upon conviction. Ismail was represented by Tan Song Yan of the National Legal Aid Foundation.

BATU PAHAT: A tyre shop assistant with a string of housebreaking records was charged again in the Yong Peng magistrate's court here today. Mohamad Arif Rosie, was charged with breaking into a couple's home and flouting a police supervision order. The 33-year-old defendant pleaded not guilty to both charges when they were read before magistrate Arun Noval Dass. According to the first charge, the accused allegedly broke into the couple's house in Desa Murni, Jalan Kluang, at 6.30pm on Oct 27 last year. Items allegedly stolen included a water heater, vacuum cleaner, air-conditioner unit, television, electric stove and a round dining table set. For the offence, Arif faces a jail term of up to 14 years and a fine upon conviction. In the second charge, he was accused of violating police supervision conditions under POCA by leaving his designated surveillance area without the district police chief's permission. The offence was allegedly committed at Batu 6, Panchor, Jalan Kluang, at 2.40am on Oct 2, 2023. Deputy public prosecutor Farah Wahidah Mohd Sharip led the prosecution, while the accused was represented by Tan Song Yan of the National Legal Aid Foundation. The court allowed bail of RM8,000 for both charges and set Aug 12 for document submission and formal appointment of defence counsel. Arun also imposed an additional condition for the accused to report to the nearest police station fortnightly until the case is resolved.

BATU PAHAT: A 32-year-old man is facing the possibility of the death penalty after being charged in the Yong Peng magistrate's court today with trafficking nearly 2kg of cannabis and heroin. The accused, Muhammad Hazyzy Mohd Shah, nodded to indicate he understood the charges when they were read out before magistrate Arun Noval Dass. No plea was recorded as the case falls under the jurisdiction of the High Court. According to the two charges, he is accused of trafficking 1,027g of cannabis and 450g of heroin at a house in Bandar Putera Indah, Tongkang Pechah, at 1.45am on July 1. Both charges are framed under Section 39B(1)(a) of the Dangerous Drugs Act 1952, punishable under Section 39B(2) of the same Act, which carries the mandatory death penalty or life imprisonment, along with no fewer than 12 strokes of the cane if the death sentence is not imposed. Deputy public prosecutor Firdaus Ruslan prosecuted, while Musfira Mohd Fahmi appeared for the defence. The prosecution earlier requested a new mention date to allow time for the chemistry report. No bail was offered. The court fixed Sept 10 for mention pending the completion of the analysis.

Man just out of jail for menacing wife now back in for whacking son

BATU PAHAT: Just days after being freed from prison for threatening to kill his wife, a 45-year-old factory operator found himself back behind bars, this time for kicking his own son in the stomach and striking him on the head. The man pleaded guilty at the Yong Peng magistrate's court today and he was sentenced to five months' jail by magistrate Arun Noval Dass. The father-of-four was charged with voluntarily causing hurt to his 18-year-old son in front of a business premises in Sri Gading here at 1pm on July 5. He was charged under Section 323 of the Penal Code, read together with Section 326A, which allowed for a doubling of the maximum penalty if the offence was committed against a family member. The sections carried a jail term of up to two years, a fine of RM2,000 or both. According to the facts, the victim lodged a report stating that his father had approached him aggressively to retrieve a motorcycle key. During the interaction, his father suddenly kicked him in the stomach and struck him on the head before leaving the scene. Police arrested the accused at 11am the following day. The victim was later sent to hospital where doctors confirmed the injuries on his head and body. Deputy public prosecutor Firdaus Ruslan prosecuted, while the accused was represented by Tan Song Yan from the National Legal Aid Foundation. In February, the Batu Pahat magistrate's court had sentenced the man to seven months' jail for assaulting his wife and threatening to kill her after she refused to give him RM800 for a car downpayment. The sentence was ordered to begin at his earlier date of arrest. Despite his brief stint of freedom, it appeared that he had not learnt his lesson.
