After three years of abandonment, a Bahraini woman has won an irrevocable divorce after the Second Supreme Jaffari Sharia Court of Appeal ruled that her husband's desertion, remarriage, and refusal to mend the marriage had caused her clear harm. Lawyer Zainab Madan explained how her client had been left without support or contact since August 2022. She was neither properly married nor able to move on with her life. The court heard that she was forced out of the marital home, shut off from any attempt at contact, and accused of adultery. Payment Demands Meanwhile, her husband remarried and demanded payment in exchange for a divorce. Appeal judges found that the court of first instance had mishandled the case and overlooked the evidence presented. Witnesses described how the husband severed all ties, blocked the woman on every means of communication, and left her to manage alone. Attempts at Reconciliation She had tried, through third parties, to broker peace or restore the marriage, but was met with silence. The panel found the husband's actions fell short of what is required under Jaffari law, where abandonment and withdrawal of support are grounds for ending a marriage. Article 98(b) of Bahrain's Family Law allows a woman to seek divorce if she is left, without cause, in such a state. Court's Conclusion The court held that his conduct left her exposed to hardship and isolation. With no witnesses brought by the respondent, the court ordered that the divorce take effect once the judgment is final, with an official divorce certificate to be issued. The waiting period begins once the ruling stands, and the divorce must be declared in the wording prescribed by Jaffari law.

Custody of two children was granted to their mother after a ruling by the Lower Sharia Court, which also ordered the Minors' Affairs Administration to cover their monthly upkeep, school expenses and Eid clothing. The court said each child should receive BD100 per month. An additional BD30 is to be paid twice a year for Eid garments, alongside BD120 for school costs, also paid twice a year. The mother is to receive all amounts directly. The father, still legally married to the mother, must pay BD80 a month in spousal support and BD120 for housing. The mother, represented by lawyer Zainab Madan, brought the case after the children, born in 2009 and 2014, expressed their wish to stay with her. Marital home They live in the marital home, rented by the husband's father, as the husband is subject to a court-ordered guardianship. When the father stopped paying the rent, the mother sought support from the Minors' Affairs Administration, which manages her husband's property. Documents presented to the court included the children's passports, the marriage certificate, a copy of the lease under the father's name and the ruling placing the husband under guardianship.

When he approached the Information and eGovernment Authority to rectify the situation, they turned him away, stating he needed a court order. That prompted him to take legal action. Represented by lawyer Zainab Madan, the man presented his case before the Third Minor Civil Court. The court examined the documents submitted, including his passport. On Wednesday, the court ordered the Information and eGovernment Authority to issue him a birth certificate. The court also confirmed that the man was born in Manama on December 31, 1959. In line with legal procedures outlined in a 2000 decree-law, the judge referred the matter to a special committee tasked with handling name and birth record disputes. The committee reviewed his application and gave its approval. The court accepted the committee's findings and ruled in favour of the man. He was or- dered to pay the legal costs.
