Widow settles case against HSE over death of husband (44)
Our Lady of Lourdes hospital breached its duty of care to a 44-year-old man who died two weeks after he was allegedly wrongly discharged from the Co Louth hospital, the High Court has heard. Simon Sherry (44), late of Edenburt, Virginia, died at Cavan General Hospital in August 2019 after developing a severe urinary tract infection and subsequent heart infection, about two weeks after he was allegedly wrongly discharged from Our Lady of Lourdes, Drogheda, without a doctor's certification. Mr Justice Paul Coffey was told on Friday that Fiona Sherry, Mr Sherry's widow, had settled her case against the HSE over his death for a 'substantial' sum. Outlining Ms Sherry's case, her senior counsel Dr John O'Mahony, instructed by Hussey Fraser solicitors, said a breach of duty of care to Mr Sherry occurred at Our Lady of Lourdes, resulting in his death. READ MORE Court documents show that a letter of apology was sent to Mr Sherry's family on behalf of the Our Lady of Lourdes, acknowledging deficiencies in care that led to his death, and apologising. Dr O'Mahony said Mr Sherry was admitted to Our Lady of Lourdes on August 4th, 2019, suffering with significant back pain and fever. Mr Sherry was diagnosed with a urinary tract infection, and antibiotics were proscribed. Counsel said Mr Sherry was discharged after two days in hospital, and added that his discharge was allegedly not certified by a doctor. Dr O'Mahony said the 'flagrant breach' of duty of care was Mr Sherry's discharge from Our Lady of Lourdes when he was still unwell. It was Ms Sherry's case that it was clear her husband should not have been discharged. Following this discharge, Ms Sherry's case contended that Mr Sherry developed urosepsis, a severe urinary tract infection, which gave rise to an abscess developing on his kidney. He ultimately developed endocarditis, an inflammation of the lining of the heart, which led to his death at Cavan General Hospital on August 23rd, 2019, the case contended. Mr Justice Paul Coffey approved the division of €35,000 in statutory mental distress payment between members of Mr Sherry's family, and extended his sympathies to them.

Update after 2yo hurt, two people dead after being hit by out-of-control car in Wantirna South
The two-year-old boy who was seriously hurt in a collision that claimed the lives of another two people has been discharged from hospital. The boy was being walked by two people - believed to be the boy's grandparents - on Coleman Rd in Wantirna South at about 12.20pm on Thursday when they were struck by an out-of-control Toyota Yaris. The 91-year-old driver is believed to have lost control of her vehicle, striking the trio before ploughing through a fence and hitting a park bench. The two adults are reportedly the grandparents of the two-year-old boy, as per The Herald Sun. The 59-year-old woman died at the scene. The 60-year-old man - understood to be the woman's partner - was rushed to hospital with life-threatening injuries, but died on Saturday night. The two-year-old was rushed to the Royal Children's Hospital in a serious but stable condition. A hospital spokesman confirmed on Monday that the child had been discharged from hospital. Tracey Jean, one of the neighbours who was first on the scene and shielded the child after the crash, told reporters she had been in contact with the child's parents and confirmed he was coming home and appears healthy. 'I'll get to hold him again this afternoon,' she said per The Daily Mail. 'I've got a photo of him and he looks great. He really is OK.' Ms Jean said the child's mother rushed to the hospital to be by her father's side before he died. 'The (boy's) mum was texting me while she was in the hospital saying goodbye to her dad,' Ms Jean said. 'She told me that her dad is now with her mum.' Witness Heather Webber told reporters last week she 'ran straight out' of the house after haring a 'funny, weird sound'. Outside, she discovered the 60-year-old man lying on the footpath. 'There he was, the poor chap, lying on his back,' she said, adding she was 'first one to see the … gentleman on the path'. She recalled the young boy 'clinging' to Ms Jean, who picked him up while Ms Webber's husband called paramedics. Ms Webber told reporters she was 'very disturbed' by the crash and was unable to sleep on Thursday night. The 91-year-old driver remains in hospital with minor injuries. Victoria Police Superintendent Justin Goldsmith said last week the elderly driver was 'terribly shaken' by the incident, and taken to hospital for minor injuries. Superintendent Goldsmith said the incident was 'not believed to be intentional'. Police told NewsWire on Monday the investigation remains ongoing and they are yet to interview the elderly driver, who remains in hospital. It is unclear if the she will be charged.

Province obtains court order to recover $144K from agency for client hotel stays
Social Sharing The Alberta government is trying to recover nearly $144,000 in costs from the social service agency that made headlines last year for having its clients placed in hotel rooms after they were discharged from hospital. The province obtained a judgment against the Contentment Social Services Foundation in March after making numerous attempts to contact people involved with the agency last fall. Alberta's former ministry of seniors, community and social Services, now known as Assisted Living and Social Services, outlined the costs in a statement of claim filed in November. They include $82,730 owed to the Park Inn by Radisson in Leduc for room bookings, additional costs and damages, $42,908 to Mainstreet Equity Corporation for apartments the agency rented for clients and $14,569 for Meals on Wheels, which was contracted after the government found clients at the hotel. Contentment Social Services did not file a statement of defence in response. The court judgment also includes costs incurred by the law firm contracted by the government and the process server during the attempts to find officials from Contentment Social Services. CBC News first reported in March 2024 how a stroke patient who was discharged from the Royal Alexandra Hospital in Edmonton was placed in a hotel room instead of the long-term care facility he thought he was going to. His wife said he had difficulties getting to the washroom in his wheelchair and that he was being fed fast food. The province stepped in to help 39 people under the care of Contentment Social Services find appropriate places to live. The Alberta government conducted investigations into the matter and evidence of possible criminal fraud was forwarded to Edmonton Police. In March, Shum Shabat Yousouf, the former director of Contentment Social Services, was charged with fraud over $5,000 and theft over $5,000.
