MUMBAI: The department of stamps and registration has issued a circular that has brought relief to developers intending to sell flats they have built or properties they have redeveloped on land owned by various government or civic agencies. MHADA Office at Bandra Internet photo In a clarification issued on Thursday, the department said builders do not require a no-objection certificate (NOC) from agencies such as the Maharashtra Housing Area and Development Authority (MHADA), City and Industrial Development Corporation (CIDCO), Maharashtra Industrial Development Corporation (MIDC) or municipalities, to sell or transfer flats built on land belonging to these agencies. The clarification was issued by Dharmdev Mainkar, deputy inspector general of stamps and registration. Confusion had arisen in April, after the department amended Article 18 (a)(1) (b) of the Registration Act. The amendment was ambiguous, and officials had interpreted it in a way that required an NOC from MHADA, SRA, MIDC and CIDCO for the sale and transfer of every flat built on their property, explained Hitesh Thakkar, an expert on property registration. 'This led to procedural and other delays, which ultimately led to a 70% fall in the registration of such properties. Some buyers also sought a refund of stamp duty as it was not possible to get NOCs in time,' he said. The July 24 circular, however, clarifies that the provisions of section 18 (a) (1) (b) of the Registration Act will not be applicable to the sale or resale of residential and/or non-residential units in buildings developed by private developers on land leased by municipalities, local self-government bodies and authorities such as MHADA, CIDCO and MIDC. They will, however, apply to documents in the form of final purchase deed / assignment deed in the form of land and construction in the interest of the organization or company in respect of such property, the clarification said. Raju Dhote, deputy inspector general, stamps and registration department, said the clarification had been issued after consulting the state revenue department and law and judiciary department. They had also informed the state inspector general of stamps and registration, Ravindra Binwade, about the delays and losses in revenue. A senior officer in the state finance department said, 'The finances of the state are strained because of the Ladki Bahin and other welfare schemes. Most revenue comes from urban areas and we realised that our revenue from stamps and registration in urban areas was falling. Hence, we asked the Stamps and registration department to issue the clarification.'

Maharashtra Chief Minister Devendra Fadnavis on Saturday said the state government has set a September 30 deadline to inaugurate the Navi Mumbai International Airport (NMIA). 'Today we have set the target as we have to seek an appointment of Prime Minister Narendra Modi. We have set a target of September 30. This is an ambitious one but we have told officials of Adani, Navi Mumbai airport authority and CIDCO that you double or triple the 13,000 workers currently working here,' Fadnavis said. He was speaking to reporters after inspecting the ongoing construction work of NMIA along with Deputy CM Eknath Shinde. The CM said all the licenses for the airport are in place. 'Because for commercial operations, you need certain licenses after completion of work. We have told them to initiate that simultaneously. So that we can inaugurate this around September 30, as per the convenience of the PM,' he said. Fadnavis said the PM laid the foundation stone of the airport and he will inaugurate it. 'In two and a half years (of MVA rule) all infrastructure projects were delayed. But we returned to power and put them on fast track. However, the cascading effect of that (MVA rule) is on all infrastructure projects. We wanted to complete the work by April and initiate flight operations by August. Which is not possible now. However, the ongoing progress is satisfactory. We are hopeful that the September 30 deadline will be met,' Fadnavis said. Earlier, Fadnavis said the physical work of the airport is 94 per cent complete, with runaway and terminal building work over. Work on the interiors is underway while an efficient system for baggage counters has been set up. 'This will be bigger than the existing Chhatrapati Shivaji Maharaj International airport with two runways,' he said, adding that it will be a green airport. All airport vehicles will be EV or alternate fuel driven. Fadnavis said the airport will have good connectivity. 'A coastal road from Atal Setu is under progress which will be completed by March 2026. Shinde has suggested an elevated road from Thane. In addition all modes of transport such as suburban rail, metro and water transport will be developed for the ease of passengers,' he said. 'In the second phase, an underground metro will connect all the terminals,' he added.

Navi Mumbai: RTI documents reveal that the Maharashtra govt has sought comprehensive reports from the Thane district collector and CIDCO regarding dumping activities at Lotus Lake, a recognised three-hectare wetland in Nerul, Navi Mumbai. This development follows the Central govt's instructions to the State Environment Department to investigate NatConnect Foundation's complaints about CIDCO's debris disposal activities into the wetland. NatConnect Director B N Kumar submitted a grievance through the PMO public grievance portal to the Ministry of Environment Forest and Climate Change (MOEFCC) regarding CIDCO's plans to fill the lake at Sector-27, Nerul, Navi Mumbai. The matter was acknowledged by Pankaj Verma, Scientist-F in the MOEFCC's Wetland Division, who directed state environment director Abhay Madhukar Pimparkar to handle the complaint. Through an RTI inquiry with the state Environment Department, Kumar requested details about actions following the MOEFCC directive. The lake is included amongst 564 wetlands studied by the National Centre for Sustainable Coastal Management (NCSCM) under state govt direction for pending wetland notification. Kumar's petition reminded MOEFCC about its instruction to preserve wetlands following the Supreme Court decision identified by the Space Application Centre under the National Wetland Inventory and Assessment. The Bombay High Court has safeguarded Lotus Lake through two PILs filed by Adv Pradeep Patole, instructing CIDCO to clear debris and the Navi Mumbai Municipal Corporation to tackle illegal occupations. Notwithstanding these protective measures, CIDCO engaged a private agency, owned by an influential politician, to deposit debris from the Navi Mumbai International Airport construction onto the wetland. CIDCO asserts ownership of the Lotus Lake whilst rejecting its wetland status, leading to debris dumping for commercial development purposes.
