Letter urges CJI to set up green benches in high courts

Agency: New Delhi, Aug 19 (PTI) A lawyer has written to Chief Justice B R Gavai urging him to constitute dedicated and permanent 'green benches" in all high courts for speedy and effective adjudication of environment-related matters. The letter said 'climate disasters" and 'massive ecological assaults" were taking place in the country. Advocate and environment activist Akash Vashishtha said though the National Green Tribunal had evolved to be an effective and efficacious forum for the settlement of disputes, the inherent limitations of the National Green Tribunal Act, 2010, posed major hurdles for the citizens in seeking environmental justice. 'As against a remedy under the National Green Tribunal Act, 2010, a remedy under Article 226 of the Constitution of India before a high court is an all-encompassing recourse, enabling citizens, as victims, to seek compensation for the environmental wrongs committed in rem as well as in personam," the letter sent to the CJI said. The lawyer in his letter stressed on the 'critical need of the hour" to establish a speedy and effective mechanism for a permanent, dedicated and robust resolution of environment, ecology and climate change issues in every high court of the country. 'Constitute dedicated and permanent, one or more 'green benches' (on the lines of that in the Supreme Court), in all 25 high courts in the country. The number of green benches in each high court may be in accordance with the number of courts functioning in that respective high court, the numerical strength of the judges, thereof, and the population of the state(s) under the territorial jurisdiction of that high court," the letter added. SC grants bail to brother of Bhopal-based sadhvi in fraud case

New Delhi, Aug 5 (PTI) The Supreme Court on Tuesday granted bail to the brother of Bhopal-based 'sadhvi", who is accused in a Rs 90 lakh fraud case following the death of the 'mahant" of Ram Janaki Temple in Chhindwara district of Madhya Pradesh. A bench of Justices M M Sundresh and N Kotiswar Singh said bail was an accused's right. The top court was hearing a plea filed by Harsh Raghuvanshi challenging the cancellation of bail granted to him by the Madhya Pradesh High Court. Advocate Ashwani Dubey, appearing for the accused, submitted there were no criminal antecedents of the petitioner and he was implicated as an accused during the investigation. He said the accused was not involved in commission of offence and his name was added as a co-accused at the time of investigation. The counsel for the Madhya Pradesh government opposed the plea. The high court on May 19 cancelled the anticipatory bail granted to Sadhvi Laxmi Das and cancelled the regular bail granted to her brother in the case. Sadhvi Laxmi Das alias Reena Raghuvanshi was granted anticipatory bail on December 20, 2024 on the condition that she would deposit the amount equal to money allegedly siphoned off by her, i.e., Rs 90 lakh in the bank as security money. According to the police, Mahant Kanak Dass Maharaj died in a road accident on April 17, 2023. He had a savings account at State Bank of India which had a deposit of Rs 88,74,081. He had not named anyone as his nominee in the account. It was alleged that Das, who the mahant's disciple, embezzled the amount with the intention to cheat. The police booked her under Sections 420 (cheating), 403 (dishonest misappropriation of property) and 404 (dishonest misappropriation of property) of IPC. Court should be sensitive in cases of sexual assault on helpless women: SC

New Delhi, Aug 5 (PTI) The Supreme Court on Tuesday underscored the need to remain sensitive in sexual assaults of helpless woman as it confirmed the punishment of a man in a POCSO case. A bench of Justices Sudhanshu Dhulia and N V Anjaria said the Chhattisgarh High Court was wholly justified in upholding and confirming the conviction and sentence awarded to the convict by the trial court. 'The court should remain sensitive while dealing with the charges of sexual assault on the helpless woman," the bench said. The top court verdict referred to its previous decisions and said a rapist 'not only violates the victim's privacy and personal integrity, but inevitably causes serious psychological as well as physical harm in the process". 'Rape is not merely a physical assault and subsequently destructs the whole personality of the victim," the bench quoted its decisions as saying. The top court said the evidence of the survivor in the present case was entirely 'probable, natural and trustworthy" who with lucidity narrated the whole incident about commission of offence against by the accused. 'There exists no reason, much less compelling reasons, to disbelieve and discard her testimony," the bench observed. Similarly, the bench was convinced by the testimony of the brother, who supported the survivor's statement. 'There was a consistency lent. The conduct of the victim, soon after the incident was quite natural, as she went to cousin sister's neighbouring house and through her, informed cousin brother and her parents who were away," the bench said. The incident occurred on April 3, 2018, when the 15-year-old survivor and her brother were inside their house. The parents had gone to a neighbouring village to attend the funeral ceremony of a family member. Finding the her alone, the convict entered the house and sent her brother to bring a pack of chewing tobacco and sexually assaulted the minor.
