HC: Aadhaar, PAN, voter ID don't make one a citizen

Mumbai: A person does not become a citizen of India merely by possessing documents like Aadhaar card, PAN card or a voter ID, the Bombay High Court on Tuesday said while refusing bail to a man, allegedly from Bangladesh, for entering India illegally. The man is accused of staying in India for more than a decade with forged and fabricated documents. A bench of Justice Amit Borkar said provisions of the Citizenship Act lay down who can be a citizen of India and how citizenship can be acquired and documents such as the Aadhaar card, PAN card and voter ID are only meant for identification or availing services. The court refused bail to Babu Abdul Ruf Sardar, alleged to be a Bangladeshi national, who entered India illegally without a valid passport or travel documents. He allegedly procured forged Indian documents such as Aadhaar card, PAN card, voter ID and also an Indian passport. In 1955, Parliament passed the Citizenship Act which created a permanent and complete system for acquiring citizenship, Justice Borkar noted. "In my opinion, the Citizenship Act of 1955 is the main and controlling law for deciding questions about nationality in India today. This is the statute that lays down who can be a citizen, how citizenship can be acquired and in what situations it can be lost," he said. "Merely having documents such as Aadhaar card, PAN card or voter ID does not, by itself, make someone a citizen of India. These documents are meant for identification or availing services, but they do not override the basic legal requirements of citizenship as prescribed in the Citizenship Act," the HC said. The law draws a clear line between lawful citizens and illegal migrants, the bench said. People falling in the category of illegal migrants are barred from obtaining citizenship through most of the legal routes mentioned in the Citizenship Act, it added. "This distinction is important because it protects the sovereignty of the country and ensures that benefits and rights meant for citizens are not wrongfully taken by those who have no legal status to stay in India," the court said.

No addl tariffs by US on Indian pharma, electronics: Centre

New Delhi: The government on Tuesday said no additional tariffs have been imposed on Indian exports to the US in sectors like pharmaceuticals, and electronics so far. In a written reply to the Lok Sabha, Minister of State (MoS) for Commerce and Industry Jitin Prasada said reciprocal tariff at the rate of 25 per cent has been imposed on certain goods exported from India to the US, effective August 7. It is estimated that around 55 per cent of the total value of India's merchandise exports to the US is subjected to this reciprocal tariff, he said, adding that additional ad valorem rate of duty of 25 per cent with effect from August 27 has been imposed on certain goods exported from India. 'No additional tariffs have been imposed on Indian exports to the US in sectors like pharmaceuticals, and electronics as yet,' Prasada said. He also said the government is engaged with all stakeholders, including exporters and industry, for taking feedback of their assessment of the impact from the reciprocal tariffs imposed by the US. 'The government attaches utmost importance to protecting and promoting welfare of farmers, workers, entrepreneurs, exporters, MSMEs and all sections of industry,' Prasada said.

Unable to dictate terms, US calls Indian trade negotiators ‘recalcitrant' but hopes deal by Oct-end

US Treasury Secretary Scott Bessent has said trade talks with India remain stuck, with Washington calling New Delhi 'a bit recalcitrant' as it resists opening its agriculture and dairy markets, even as a tariff row with President Trump escalates. US Treasury Secretary Scott Bessent said on Tuesday that several major trade deals, including those with Switzerland and India, remain pending, remarking that New Delhi had been 'a bit recalcitrant' in its negotiations with Washington. The comments come amid a standoff in US–India trade talks, with President Trump unable to push through his terms as India refuses to open its agriculture and dairy markets. In retaliation, Trump has slapped a 25 per cent tariff on Indian goods, with an additional 25 per cent penalty set to take effect on August 21 over New Delhi's trade ties with Russia. STORY CONTINUES BELOW THIS AD Speaking to Fox Business Network's Kudlow, Bessent voiced optimism about concluding the negotiations by the end of October. 'That's aspirational, but I think we are in a good position,' he said, adding, 'I believe we will have agreed on substantial terms with all the key countries.' This is a developing story.
