‘Unacceptable to charge toll with safety, traffic issues'—House panel bats for new road tariff authority

Batting for establishing a tariff authority—on the lines of the Airports Economic Regulatory Authority in the civil aviation sector—to ensure transparency and fairness in toll fixation, collection and regulation, the panel noted, 'While higher toll charges are justified during the period of concession agreement, continuation after that needs to be justified.'
'This includes highway stretches that are incomplete, under prolonged construction, or marked by serious deficiencies in safety and traffic flow,' the Public Accounts Committee (PAC) led by Congress MP K.C. Venugopal said in its report tabled Tuesday.
New Delhi: A parliamentary panel looking into the levy of toll fee on national highways has come down heavily on the Ministry of Road Transport and Highways (MoRTH), saying that it is 'unacceptable' that toll continues to be collected even in situations where 'the essential service—namely, safe, uninterrupted, and timely travel—is not available'.
The panel said that the authority should be mandated to review and determine the periodicity of toll revisions based on certain parameters.
The PAC has also pushed for rationalisation of toll collection on any highway stretch, and its substantial reduction once capital and routine maintenance costs have been recovered.
'Any continuation of tolls beyond this point should be permitted only if clearly justified and approved by the proposed independent oversight authority,' the PAC said in its report.
Noting that while toll rates are revised annually through a formula combining a fixed three percent increment with partial indexation to the Wholesale Price Index, the parliamentary panel said that there is no institutional mechanism to independently evaluate whether toll charges are justified in relation to actual operation and maintenance costs, or future service requirements.
'Continuing to levy toll without delivering the promised level of service violates both the user-pay principle embedded in Section 7 of the National Highways Act and the norms of fair commercial conduct envisaged under Section 10 of the NHAI Act,' the report reads.
Drawing parallels with the Income Tax framework, where the government has institutionalised a transparent and automated mechanism to process refunds to taxpayers in cases of excess deduction or payment, the panel further said, 'Charging toll under these conditions not only violates the principle of quid pro quo but also undermines public confidence in the legitimacy of user charges.'

'Need to rationalise base rate'
Deposing before the PAC, MoRTH officials said that they have initiated a study with NITI Aayog to revise the user fee determination framework, including base rates, inflation indexing and concession structures.
'… all existing contracts and publicly funded toll plazas allowing tolling beyond cost recovery must be reviewed in light of these principles to safeguard user interest and uphold the principle of equity in public infrastructure usage,' the PAC said.
It further recommended that the ministry pursue the proposed study—being initiated through NITI Aayog in collaboration with reputed academic institutions—and ensure that it is time-bound and result-oriented.
The PAC also recommended that MoRTH and the National Highways Authority of India establish a clear, technology-driven and transparent mechanism for automatic toll refund or waiver in cases where the highway is 'incomplete, unfit, or unavailable fully or under maintenance for use'.
'This system should be fully integrated with the electronic toll collection framework (e.g., FASTag) and designed to function without the need for user intervention, just as income tax refunds are processed and paid directly to taxpayers,' the PAC notes in its report.
Currently, there is a provision that if a four-lane road is getting converted to a six-lane road, the user fee is reduced to 75 percent. 'It is because inconvenience is caused to the citizens while travelling on that road. And also, user fee is not increased till the completion of the upgradation,' the report notes. 'If due to some reasons, we are not able to provide the land or the forest or environment clearance, in that case, the scheduled completion date gets extended and the concession of 75 percent continues till the completion of the road is achieved.'

Ahead of the roll out, the government has opened the pre-booking window for FASTag-based annual passes that allow users to cross up to 200 highway toll booths on a single recharge of Rs 3,000 within a year. A dedicated link for activation of the annual pass is available on the Rajmarg Yatra app. The link would also be available on the official websites of National Highways Authority of India (NHAI) and the Ministry of Road Transport and Highways (MoRTH). The annual pass will be applicable only for non-commercial private vehicles such as cars, jeeps, and vans. It will allow seamless travel across National Highways without the need for repeated recharging of FASTag cards for toll payments. In closed tolling highways such as Delhi-Mumbai Expressway - where toll collection occurs exclusively at exit points - a single trip includes both entry and exit points. On the other hand, on open tolling routes like Delhi-Chandigarh, each toll plaza crossing would constitute a separate trip. The pass can be recharged again once the 200-trip limit in a year is reached. According to the MoRTH, those who already have a FASTag on their vehicles will not need to purchase a new FASTag. The annual pass will be valid only at National Highway (NH) and National Expressway (NE) fee plazas. At fee plazas on Expressways, State Highways (SH) managed by state governments or local bodies, the FASTag will operate as a regular one, and applicable user fee charges may apply. FASTag - the electronic toll collection system - uses Radio Frequency Identification (RFID) technology to automatically deduct toll charges from a prepaid account linked to the vehicle. Over 10.1 crore FASTags were issued till December 1, 2024, according to the road transport ministry's 2024 year-end review.

The Opposition parties on Thursday (August 14, 2025) welcomed the Supreme Court's directions to the Election Commission of India to take steps to make the Special Intensive Revision (SIR) more transparent but said that the observations illustrate the shortcomings in the process that require a debate in the Parliament. A call on continuing the protests against the SIR in the last week of Parliament's Monsoon Session, which ends on August 21, will be taken at the floor leaders' meeting on Monday. Speaking to The Hindu, Congress general secretary (organisation) K.C. Venugopal, who is also a petitioner in the case, said that the Opposition's campaign will end when all the issues concerning the SIR are settled. 'We will decide our Parliamentary strategy on the issue on Monday morning when floor leaders of Opposition parties meet,' he said. CPI(ML) general secretary Dipankar Bhattacharya said the issue of legality of SIR is yet to be determined by the Supreme Court. The interim order, he said, addresses some of the basic objections, but for the 3.5 million migrant workers whose names have been struck off, the onus remains on them to raise objections. 'The scale of exclusion is huge, time is short and most of the electors have been wrongfully penalised for no fault of their own. The onus of correction should also be put on the perpetrators of the error,' he said. Lauding the Supreme Court's directions, DMK's Rajya Sabha floor leader Tiruchi Siva said the judiciary has done its bit and now it is for the legislature to play its role. 'Judiciary has come to the rescue of democracy, it is now for the legislature to safeguard it,' he said. CPI(M) general secretary M.A. Baby, in a post on X, said the debate over SIR extends beyond mere revision, raising concerns about 'systemic sabotage' in the voters' list that could undermine democracy. The party's Rajya Sabha floor leader John Brittas said the Opposition's protests had started against the SIR in Bihar, but since then more evidence has emerged on adulteration of voter lists that must be addressed. 'We need to deliberate upon the electoral process and how to ensure its sanctity. We will take a considered call on Monday on how to proceed further,' he said. Trinamool Congress's Rajya Sabha member Saket Gokhale said the Supreme Court's directions partially prove the Opposition's allegations and the issue must be discussed in Parliament. 'Even before the Supreme Court has settled the issue, the EC has announced its intentions to carry out such an exercise in West Bengal and Assam. This shows its sinister agenda to tamper with the elections. Why is it in such a hurry,' he asked.
