SC criticises Allahabad HC for ignoring settled law on sentence suspension
The observations from the top court came days after it pulled up an Allahabad High Court judge for allowing criminal proceedings in a civil dispute case.
In an unprecedented order, a bench of Justices J B Pardiwala and R Mahadevan on August 4 stripped criminal matters of the roster of a Allahabad High Court judge 'till he demits office" after he 'erroneously" upheld summons of criminal nature in a civil dispute.
The same bench came hard on the high court decision in another case.
'The impugned Order is one more from the High Court of Judicature at Allahabad with which we are disappointed," it said, adding that this plea arose from an order passed by the High Court on May 29, in a criminal appeal by which the high court declined to suspend the substantive order of sentence passed by the trial court.
'We are once again constrained to observe that such errors creep in at the level of the High Court and only because the wellsettled principles of law on the subject are not applied correctly.
'It is very important to first look into the subject-matter. Thereafter the court should look into the issue involved. In the last the court should look into the plea of the litigant and then proceed to apply the correct principles of law," Justice Pardiwala said in an order on August 6.
The apex court observed that the High Court's order was legally flawed and demonstrated a disregard for established jurisprudence.
It was hearing an appeal filed by a convict who had been sentenced to four years of rigorous imprisonment under various provisions of the Protection of Children from Sexual Offences (POCSO) Act, Indian Penal Code (IPC), and the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989. The sentences were ordered to run concurrently.
The convict had approached the high court with an application under Section 389 of the Criminal Procedure Code, seeking suspension of his sentence.
However, the high court rejected the plea solely on the ground that the offence was 'heinous", without evaluating the request in light of the settled law.
Setting aside the high court's order, bench cited a landmark judgment which mandates that appellate courts should adopt a liberal approach in suspending fixed-term sentences unless exceptional circumstances exist.
Emphasizing the need for judicial clarity, the bench said, 'It is very important to first look into the subject matter. Thereafter, the court should examine the issues involved, and only then consider the plea of the litigant before applying the correct principles of law." The apex court took particular issue with the high court's failure to analyze the application on legal grounds.
'What the high court did was to reiterate the prosecution's case and the oral evidence, without engaging with the legal test for suspension of sentence in a fixed-term conviction," the bench observed.
It has now remanded the matter back to the high court for fresh consideration, directing it to pass an appropriate order within 15 days.
'The High Court shall keep in mind that the sentence is for a fixed term, that is four years and it is only if there are compelling circumstances indicating that release would not be in public interest, that suspension may be denied," the order clarified. PTI SJK ZMN

Speeding Thar kills man, wounds another after ramming into pavement in Delhi's Chanakyapuri — Watch
In yet another incident, a man was killed and another person wounded on Sunday morning after a speeding SUV rammed into a pavement and hit them near the Gyarah Murti landmark in Chanakyapuri area of Delhi. According to the police, the incident took place when a white Thar coming from the direction of central Delhi swerved towards the pavement and struck the two men. The two victims were rushed to the AIIMS Trauma Centre, where one was declared brought dead while the other is undergoing medical treatment. Both men were walking along the pavement when the SUV suddenly swerved towards them, climbed onto the pedestrian path and hit them. The incident was captured on camera. The vehicle, which has a Uttar Pradesh registration number, was seized and the SUV driver was apprehended. The accused has been identified as Ashish, a resident of Shakarpur in east Delhi. He was returning home from Dhaula Kuan when the accident took place. According to the preliminary probe, Ashish was driving his friend's Thar at the time of the accident. The SUV is registered in the name of Ankit, a resident of Ghaziabad district, Uttar Pradesh. A police patrolling party was in the vicinity and witnessed the accident around 6.30 AM, reported news agency PTI citing a senior police officer. "One of the policemen immediately made a PCR call and requested for an ambulance. The injured were taken to AIIMS Trauma Centre without delay," the officer said. "Preliminary inquiry has revealed that Ashish was heading towards his residence in Shakarpur. His occupation status is unclear at the moment, though he has previously worked as a driver," the officer said. The police further said that they are examining CCTV footage from the area to establish the exact sequence of events. Three persons died after their motorcycle rammed into a stationary truck at Lakra Kocha in Jharkhand's Seraikela-Kharswan district in the early hours of Sunday, reported PTI. The accident took place around 3.30 AM when they were on their way to Jamshedpur from Chaibasa, a police officer said. A police team took them to a nearby community health centre, where doctors declared them dead, SP Mukesh Kumar Lunayat said. The deceased were residents of Jamshedpur.

Downing of Pakistani special mission aircraft during Op Sindoor significant
Last Updated: New Delhi, Aug 10 (PTI) Air Chief Marshal A P Singh's assertion that Indian Air Force downed a large Pakistani aircraft from a distance of around 300 km, reflected its unprecedented air superiority that dealt a 'huge" psychological blow to the adversary. This is what military officials said while breaking down nuances of the Air Chief Marshal's address in Bengaluru on Saturday where he said India shot down five Pakistani fighter jets and a large special mission aircraft during Operation Sindoor. The IAF chief described the downing of either an ELINT (Electronic Intelligence) or AEW&C (Airborne Early Warning and Control) aircraft as the 'largest-ever recorded surface-to-air kill" that we can talk about. 'It is significant as there is no publicly available information of a surface-to-air missile bringing down such an asset at a distance of 300 kms or beyond," said a senior military official on condition of anonymity. The strike dealt a massive psychological, strategic and tactical blow that will be difficult for Pakistan to overcome, explained another official. If it was an AEW&C aircraft, then the blow was much more significant as every air force globally has a limited number of such aircraft. An AEW&C aircraft provides airspace surveillance and early detection of airborne threats and plays a very important role in an air combat scenario. Pakistan is reported to have six to eight AEW&C aircraft. 'The kill showed we can reach every corner of Pakistan," he added while elaborating how induction of Russian S-400 air defence missile systems helped India enhance its air dominance. This was not the case during the 2019 Balakot strikes as Pakistani jets came very close to the frontier and mounted a spirited offensive when they came for retaliation. People had questioned India's air dominance capabilities, said a third officer. Pakistan had briefly captured Group Captain Abhinandan Varthaman after he downed an enemy jet during aerial combat over six years back. Now, it is a different scenario. The S-400 missile systems backed by superior air dominance jets have brought in a different dimension to India's air power capabilities. Russia has delivered three squadrons of the air defence missile system under a USD 5.43 billion deal inked in 2018. The remaining two squadrons of the S-400 missile system are likely to be delivered within the next one year. The officials also pointed out how India managed to hit multiple Pakistani installations while jamming its communication systems. India launched Operation Sindoor on May 7, targeting terrorist infrastructure in territories controlled by Pakistan in response to the Pahalgam terror attack. The strikes triggered four days of intense clashes that ended with an understanding on stopping the military actions on May 10. New Delhi has been maintaining that India's fierce counter-attack that day forced Pakistan to plead for ending the hostilities. Delhi: Gang member held with pistol, live cartridges in Dwarka
New Delhi, Aug 10 (PTI) A man suspected to be a member of the Nandu gang was arrested with a pistol and live cartridges in Dwarka, the police said on Sunday. The accused, identified as Ishwar Singh alias Monu, a resident of Bharthal village in Dwarka, was nabbed during a planned operation. According to the police, Singh is a key member of the Nandu gang, an organised criminal group involved in several cases of violence, extortion, and possession of illegal firearms in Delhi and neighbouring areas. Singh is allegedly involved in multiple previous cases, including those under the Arms Act, attempt to murder, extortion, and assault on public servants, the police mentioned.
