Frustrated parents demand action from KZN Education Department over Westville Senior Primary issues

A group of parents whose children attend Westville Senior Primary School has accused the KwaZulu-Natal Department of Education (DoE) of failing to deliver on its promises to investigate allegations of misconduct against the school's principal.
In a strongly worded statement, the parents said they were left 'deeply disappointed and frustrated' by what they described as the department's 'troubling lack of capacity and inability to conduct timely, thorough, and transparent investigations.'
The grievances against the principal are not new. In May, parents staged a protest outside the school, citing more than 50 unresolved complaints since 2023. Allegations ranged from financial mismanagement and procedural misconduct to the unilateral dropping of isiZulu as a first additional language.
The principal was suspended in August 2024 to allow investigations to take place but was later reinstated after a review.
'On 28th May 2025, during a formal meeting chaired by Mrs TA Gumede (DoE), Mrs Gumede committed to the parents to complete all investigations and deliver comprehensive reports to the School Governing Body (SGB) by 12th June 2025,' the statement read.
Parents also questioned Gumede's conduct during that meeting, saying she was 'disrespectful to parents'.

The parents said no reports were submitted by the June deadline, and when the DoE convened a meeting with the SGB on 14 August 2025, parents allege the department once again failed to deliver.
'The entire panel arrived empty-handed, without a single completed report, rendering the meeting ineffective. The panel's dismissive attitude and alleged breach of confidentiality to certain parent members was not only unprofessional but deeply insulting to the educators, parents, and SGB members who have tirelessly advocated for answers and never failing to follow due process,' the parents' statement said.
They also raised concern that the 'DoE are only willing to investigate complaints by the Department employed teachers, and not the teachers employed by the SGB'.
In response, KwaZulu-Natal Department of Education spokesperson Muzi Mahlambi said: 'The department has written to the SGB with the new management plan that has proposed dates to meet them and the parents this month.'
The parents said they were now considering legal action. 'Parents, community, and educators have lost all confidence in the DOE's ability or willingness to do their jobs acting in the best interests of the school community,' the statement concluded.

The ELRC ruled that he was unsuitable to work with children. The Education Labour Relations Council (ELRC) has ruled that a Gauteng teacher must be dismissed after he allegedly raped a Grade 11 pupil at his home, while threatening her with a firearm. The Gauteng Department of Education dragged the teacher before the ELRC, but he failed to attend his arbitration proceedings. He faced three charges of misconduct: raping a pupil on 13 February 2025, pointing a firearm at her during the incident, and sending her sexually explicit WhatsApp messages. The case had been referred for inquiry; however, the teacher ignored both the pre-hearing on 18 June and the scheduled hearing on 24 July at the department's Johannesburg West District office in Florida. It later emerged that he was not interested in attending the inquiry because his focus was on his criminal rape case arising from the same incident. Rape victim's testimony The hearing went ahead in his absence. The pupil testified that the teacher, who taught her isiZulu from Grades 8 to 10, grew close to her family because they shared the same surname. He was even introduced to her father and regarded as an unrelated family. According to the 16-year-old girl's testimony, the teacher brought his daughter from KwaZulu-Natal (KZN) to live with him when schools reopened in January. He persuaded the pupil's parents to let her stay at his home too, claiming it was closer to school. Once she moved in, the teacher imposed strict rules, including forbidding her from calling her parents in his absence or speaking to tenants on the property. Although he ordered her to delete them, she first took screenshots. Later, while she was asleep in the room she shared with his daughter, the teacher allegedly dragged her to his bedroom. She testified that when she resisted, he cocked a gun and threatened to shoot her if she screamed. He then allegedly removed her pyjamas and raped her. Afte the ordeal, he ordered her to bathe and wash her clothes. The next day, the teenager reported the incident to her parents, who took her to a doctor and opened a case with the police. The school principal was informed on 16 February. Family's response The teenager's father broke down during proceedings, saying he regretted allowing his daughter to live with the teacher. He also revealed that the victim's mother discouraged her from pressing charges and appeared to side with the teacher. The father claimed he suspected that the teacher had promised the mother 'something'. The Gauteng Department of Education described the teacher's actions as deliberate and predatory. Comparing him to a predator, the department argued he was like a 'hunting lion' who knew how to 'scale, plan and prey on his victims'. His behaviour, they said, was calculated and premeditated. Arbitrator's ruling The ELRC arbitrator upheld all charges and ordered the teacher's dismissal, stating it was necessary to send a strong message to the other employees. 'He can no longer be trusted around girl learners. 'His relationship with the employer is irretrievably broken; thus, he was suspended from the school as his behaviour was that of a sexual harasser or rapist,' she said in her ruling delivered on 6 August. The arbitrator pointed out that, as the teacher had waived his right to present his case, the evidence before her stood unchallenged. She also highlighted that the witnesses' testimonies had no contradictions. 'There is a link between the messages and the sexual act. Therefore, he was the author of the messages. '[The teacher] not only raped the learner but also threatened to shoot her if she screamed. 'Shame and lack of defence certainly are behind his snubbing this inquiry,' the arbitrator said. '[His] attitude of refusing to attend this inquiry demonstrates a lack of remorse for this appalling and heinous offence. 'He displays brazenness with no regard to the outcome of these proceedings,' she added. In addition, the arbitrator ruled that he was unsuitable to work with children. Court orders eThekwini Municipality to reinstate investigator in Zandile Gumede corruption case

Image: Nomonde Zondi The Labour Court has ordered eThekwini Municipality to reinstate an investigator from its investigations unit, City Integrity and Investigations (CIIU), after it dismissed him in December 2024. The municipality had alleged misconduct connected to a forensic company contracted by CIIU to investigate corruption against former Mayor Zandile Gumede. The investigator cannot be named as he is a State witness in Gumede's R320 million fraud trial. The media is prohibited from naming State witnesses in Gumede's trial. The investigator sought several forms of relief, including the declaration that all decisions from the unauthorised disciplinary process by the municipality were invalid, reinstatement to his previous position, and compensation for legal expenses. In May 2024, the investigator received a disciplinary notice regarding alleged misconduct connected to the contract of forensic company Integrity Forensic Solutions CC (IFS). After that, he applied to the South African Local Government Bargaining Council (SALGBC) under Section 188A of the Labour Relations Act, requesting that an independent arbitrator handle the disciplinary proceedings instead of the municipality's internal process. 'The SALGBC ruled twice in the investigator's favour, issuing decisions on June 5, 2024, and December 3, 2024, that confirmed the matter should proceed as a pre-dismissal arbitration,' the judge said. She said the municipality proceeded with its internal hearing despite the SALGBC directives, with Sbonelo Mchunu as the chairperson, while Bokang Molefe was the initiator. In the matter before the Labour Court, the municipality is the first respondent, Mchunu is named as the second respondent, and Molefe is the third respondent. The hearing commenced on December 11, 2024, and continued through to December 13, 2024. On December 11, 2024, the investigator filed an urgent court application to stop the proceedings. Despite the court application and the SALGBC's authority, Mchunu and the municipality ignored both, with Mchunu refusing to acknowledge the arbitration council's rulings. Following that, the municipality fired the investigator on December 13, 2024, prompting him to launch review proceedings challenging the legality of the entire disciplinary process. The investigator argued that the municipality had acted without lawful authority by disregarding the SALGBC's jurisdiction. Additionally, Judge Whitcher said in January 2025 that Judge Lagrange had confirmed that the municipality's actions lacked legal foundation. She stated that the municipality exceeded its legal authority once the SALGBC had assumed jurisdiction over the matter. 'The respondents' refusal to recognise the arbitration council's authority rendered the entire internal disciplinary process legally meaningless,' Judge Whitcher stated. Judge Whitcher set aside Mchunu's December 13, 2024, dismissal decision, declaring it null and void. She said the disciplinary process was conducted without lawful authority. 'He must tender his services to the municipality by August 18, 2025, while the eThekwini Municipality bears responsibility for his legal costs,' Whitcher ordered.
