Federal Court grants bail to businessmen charged with organised crime links
The court also imposed conditions for the two men to wear electronic monitoring devices and remain within the compound of their respective homes.
The decision on Thursday (July 3) was made in a 2-1 majority by a three-member panel led by Federal Court judge Tan Sri Nallini Pathmanathan.
She said the majority were of the view that S. Hemanathan, 31, and N.Nithiyan, 39, had made out their case primarily due to their health conditions, coupled with the inability of the prison system to attend to or care for prisoners who need special medical attention.
"They are prohibited from travelling outside of their residential home without reasonable consent of the police and must report to the nearest police station once every two weeks. Also, they may travel to hospitals for treatment of their medical conditions with the permission of the police, which should not be unreasonably withheld," she said.
Justice Datuk Hanipah Farikullah supported the majority ruling, while Justice Abu Bakar Jais dissented.
Earlier, defence counsel Datuk Rajpal Singh had urged the court to allow bail on medical grounds.
He said Nithiyan suffers from ischemic heart disease, hypertension and dyslipidemia, which could lead to life-threatening cardiovascular failure without consistent treatment, while Hemanathan, who uses a wheelchair, suffers from diabetes, hypertension, dyslipidemia and high cholesterol, and has not received consistent treatment in prison.
Deputy Public Prosecutor Ng Siew Wee argued that both men had received necessary treatment and their conditions were under control.
Hemanathan and Nithiyan were charged in the Sessions Court in May last year for being members of an organised crime "Geng TR" in Sunggai Janggut Seafood Restaurant in Jalan Bagan Sungai Janggut, Jeram, Selangor between November 2019 and May 2024.
They were charged under Section 130V of the Penal Code, read together with the Security Offences (Special Measures) Act (Sosma).
Their case was transferred to the High Court in Aug last year, and the trial is fixed to begin in October next year. - Bernama

PETALING JAYA: The Securities Commission (SC) has charged a former unit trust consultant (UTC) Nadihah Nawi at the Kuala Lumpur Sessions Court with offences relating to securities fraud involving purported unit trust investments. In a statement, the SC said Nadihah, 34, faced two charges jointly with another individual who is at large, under section 179(b) of the Capital Markets and Services Act 2007, read together with section 34 of the Penal Code. 'She was charged with defrauding two investors of RM20,000 by representing to them a unit trust investment in Kenanga Investors Bhd (KIB). 'The offences took place between January and June 2022 in Kuala Lumpur. 'The monies deposited by the investors were instead utilised for Nadihah's own unit trust investments in KIB. 'Nadihah was a UTC with Principal Asset Management Bhd at the material time.' The SC said Nadihah claimed trial to both charges before Sessions Court judge Tuan Izralizam Sanusi and was granted bail of RM70,000 with two local sureties. The court also imposed an additional bail condition for the defendant to report to the SC's investigating officer at the SC office in Kuala Lumpur on a monthly basis.

2,400 vapes, related components found in Singapore-bound lorry at Tuas Checkpoint

In a statement on Facebook on July 30, the Immigration and Checkpoints Authority (ICA) said it foiled the smuggling attempt made via a Malaysia-registered lorry. The lorry was carrying cargo declared as precast products. Based on information received by ICA's Integrated Targeting Centre (ITC), ICA officers directed the vehicle for enhanced checks. The vapes and related components were found hidden inside the lidded compartment of a flat plate, which was on top of the trailer chassis. A chassis is an undercarriage structure that supports a vehicle's other components, such as the engine and wheels. The case was referred to the Health Sciences Authority for further investigation. The ITC is a new unit under ICA that uses data analytics to identify high-risk foreigners before their arrival. These foreigners are flagged for more stringent checks at immigration. A total of 33,100 foreigners were denied entry in 2024 after being found to pose immigration or security risks to the nation, according to figures released in February. From January 2024 to March 2025, HSA seized $41 million worth of vapes – nearly fivefold the reported value of vapes seized from 2019 to end-2023, according to numbers compiled by The Straits Times. The Ministry of Health and Ministry of Home Affairs said in a joint statement on July 12 that they are looking at enhancing laws around vaping. On July 20, Health Minister Ong Ye Kung said that both ministries are working together to list etomidate, which is increasingly being abused through vapes, under the Misuse of Drugs Act. With etomidate listed as a Class C drug under the Act, the authorities will be able to take tougher actions against suppliers and users of vapes with the drug. Since July 21, HSA has extended operating hours for its Tobacco Regulation Branch hotline on 6684-2036 or 6684-2037 to report vaping-related offences. GOF seizes 14 goats, 190kg of ketum in Kelantan raids
PASIR MAS: The General Operations Force (GOF) has seized 14 goats and 190kg of ketum leaves, with a combined estimated value of over RM18,000, in two separate operations carried out here and in Tanah Merah. GOF Southeast Brigade commander Datuk Nik Ros Azhan Nik Abd Hamid said two local men were arrested in connection with the possession of the livestock and the ketum leaves. He said both seizures were made under Op Taring Wawasan Kelantan, which took place on Monday and last night. In the first operation, members of the 7th Battalion spotted a suspicious vehicle at Chabang Empat Tendong in Pasir Mas at around 7pm yesterday. "Upon inspection, GOF personnel found 14 goats cramped in the rear of the vehicle. "The 41-year-old driver failed to produce any documentation for the animals, which are believed to have been intended for sale on the local market. The estimated value of the seizure is RM10,500," he said. The case has been referred to the Kelantan Veterinary Department for further action under Section 36(1) of the Animals Act 1953. In a separate case, Ros Azhan said GOF personnel discovered several packages of ketum leaves in a vehicle. "The car was stopped as it passed through Kampung Bechah Butir Nangka in Tanah Merah at around 9am on Monday. Inside, the personnel found 19 black plastic packages containing 190kg of ketum leaves. The driver was also detained. "The seizure, valued at about RM7,600, has been handed over to the Tanah Merah Narcotics Criminal Investigation Division," he said. The case is being investigated under Section 30(3) of the Poisons Act 1952.
