
Kelantan protects Orang Asli rights and welfare, including customary land
Menteri Besar Datuk Mohd Nassuruddin Daud said for matters relating to the issue raised regarding the customary land of the Orang Asli community in the Galas state legislative assembly, it is not an issue because there is no term as customary land for Orang Asli either in the National Land Code 1965 or the Orang Asli Act 1954.
He said customary land only exists in Sabah and Sarawak according to state laws in both states relating to Orang Asli land in Sabah and Sarawak.
'Customary land does not exist in Peninsular Malaysia. The Orang Asli Act only mentions Orang Asli wandering areas which need to be gazetted,' he said.
He said this at the winding-up session of the State Legislative Assembly at the Kota Darulnaim Complex here today.
Mohd Nassuruddin said in Kelantan, Orang Asli areas are not gazetted under the Orang Asli Act but are gazetted under the reservation provisions of the National Land Code.
'The Orang Asli Act is not a law relating to land, but the National Land Code is a specific law relating to land,' he said.
He said therefore that gazetting under the National Land Code has stronger legal standing compared to gazetting under the Orang Asli Act.
He added that in Kelantan, several locations have been gazetted under Section 62 of the National Land Code such as the Aring 5 area, PT 11982, Kampung Meranto, PT 5612, HSD 8978 as well as several Orang Asli gazetted lots in the Lojing area.

KOTA BHARU: The federal government has approved RM4.15 billion for 17 development projects in Kelantan through the Department of Irrigation and Drainage (JPS). Menteri Besar Datuk Mohd Nassuruddin Daud confirmed the allocation includes flood mitigation initiatives to protect residents and property. He stated the flood mitigation projects reflect strong collaboration and timely execution by all stakeholders. KOTA BHARU, Aug 13 — The federal government, through the Department of Irrigation and Drainage (JPS), has approved a development allocation of RM4.15 billion for 17 projects in Kelantan, including for flood mitigation, said Menteri Besar Datuk Mohd Nassuruddin Daud. He said the implementation of flood mitigation projects (RTB) would protect the people and safeguard property, proof of the government's commitment to public safety. 'This RTB not only reflects the collective effort and cooperation of all parties but also demonstrates our ability to deliver quality work within the stipulated timeframe. 'Therefore, the Kelantan state government is deeply grateful and wishes to express appreciation to the Ministry of Energy Transition and Water Transformation and JPS, in particular, for the approved development allocation,' he said. He said this when speaking at the DID Senior Managers and District Engineers Conference 2025 here today, officiated by Deputy Prime Minister Datuk Seri Fadillah Yusof. Commenting further, Mohd Nassuruddin said that in dealing with the aftermath of the major floods that recently hit Kelantan, he had also requested JPS to immediately repair all flood-damaged infrastructure through a comprehensive and phased approach. 'The government will strengthen efforts to improve disaster management efficiency through drainage and irrigation structural plans in all flood-affected areas. 'These efforts should be implemented through the construction of concrete drains and more modern eco-friendly drainage systems.
