Non-compliance of court order: HC orders salary attachment of three top Punjab officers

The Punjab and Haryana high court has ordered the attachment of salaries of three top Punjab officers for failure to comply with the court's directions to stall all fresh construction activities in Kharar.
The officials include principal secretary, department of housing and urban development, Rahul Tewari; chief town planner, department of town and country planning, Prabhjot Singh Dhillon; and principal secretary, department of local government, Tejveer Singh.
'To the utter dismay of this court, despite the construction activity being stayed throughout the city of Kharar, no steps have been taken by the respondents towards compliance of the order passed by the writ court. Faced with this indifferent attitude of the respondents, let salaries of respondent Nos 1 to 3 remain attached till the compliance is made,' the bench of justice Harkesh Manuja ordered while posting a contempt petition hearting for September 23.
Omega Infra Estates Private Limited had moved a petition alleging non-compliance of the court's October 2024 directions. It was during these proceedings that HC had restrained all fresh or new construction in Kharar until a revised master plan is finalised.
The court, while passing this order, had observed that the last master plan for Kharar was published on May 25, 2010, and since then haphazard construction activity at large scale is going on in and around the entire area without taking into consideration the need for providing of basic and necessary amenities to residents.
It had further noted that the process of finalisation of the revised master plan in consonance with the Punjab Regional Town Planning and Development Act, 1995, has not been undertaken.
The contempt petition was filed in January after the government failed to comply with the undertaking given in October during the proceedings of a petition that demanded amendment in the Master Plan for Kharar, which was last notified in 2010. The plea had argued that the existing Master Plan, no longer reflects the ground realities and is therefore not implementable. It was disposed of as the government submitted that necessary action would be taken in eight weeks. But it was not complied with.

The ongoing legal controversy is related to Mathura's Shahi Idgah mosque, reportedly built during the era of Aurangzeb. The Hindu side has alleged that the structure was established after demolishing a temple at the birthplace of Lord Krishna. The petitioner also claimed in court that the mosque bears symbols of Hindu deities on its walls. The petitioner has also argued that the Muslim side has not provided any documentary evidence to prove it to be a mosque. Furthermore, as per IANS, he stated that the structure is not listed in the official land records (Khasra-Khatauni), has no municipal records, and no taxes have been paid for it -- therefore, it should not be recognised as a mosque. Muslim Side's Argument The Muslim side presented its argument in the HC, strongly opposed the petition, and asserted that the Shahi Idgah has existed at the site for over 400 years. Additionally, they argued that the demand to declare the structure disputed is 'baseless' and must be dismissed. HC On Shri Krishna Janambhoomi Case The Allahabad HC agreed with the Muslim side's argument and rejected the petition, declining to classify the Mathura's Shahi Idgah as a disputed property. This was one of the 18 petitions filed by the Hindu side with regard to the claims on the land around Sri Krishna Janmabhoomi.

The Madras High Court on Thursday dismissed an appeal from a set of medical aspirants against a single judge order refusing re-examination of NEET, saying any such move would severely affect over two million students. S Sai Priya and 11 others had preferred the appeal against a June 6 order where the HC had dismissed a batch of petitions that sought to restrain the National Testing Agency (NTA) from declaring the results. In their petitions, Priya and other students also sought a direction to the NTA to conduct re-examination for candidates, who had experienced power outages at four centres in Chennai, where they appeared for the examination. On Thursday, a Division bench of Justice J Nisha Banu and Justice M Jothiraman dismissed the appeal. 'It is to be noted that the integrity of the exam is particularly ensured through human supervision including the presence of the Centre Superintendent, Invigilators, NTA appointed Observers and City Coordinator. All these officials have examined and confirmed that the examination was conducted smoothly. A factual enquiry was undertaken by the NTA and the enquiry was conducted with regard to the field verification through the reports of the examination functionaries and an independent statistical analysis of candidate performance data,' the bench said. It said statistical analysis was conducted by an independent expert committee and it carried out an analysis based on anonymised data relating to the average number of questions attempted by the candidates at the said centre, and comparisons with other centres in Thiruvallur District are statistically comparable across the centres in the district, where the examination was conducted smoothly. 'This analysis found no statistically significant difference in the number of questions attempted, confirming that the alleged power outage did not materially impact candidate performance. Furthermore, NEET (UG) 2025 is a time sensitive and large scale national examination,' the court said. It was crucial to uphold the integrity of the educational assessments in conducting examinations and 'this Court cannot sit in an appellate jurisdiction against the considered decision of the speaking order passed by the NTA, after field verification of examination centre and statistical analysis by an independent expert committee with no affiliation to the NTA, unless such decision is demonstrated to be manifestly arbitrary, mala fide or illegal.' 'In such circumstances, if any re-examination is permitted, the same would severely affect more than two million candidates. Therefore, we do not find any reason to interfere with the order impugned and the writ appeal lacks merit and the same is liable to be dismissed. In the result, this writ appeal stands dismissed,' the court ruled. Meanwhile, the Madhya Pradesh High Court on Tuesday stayed the retest of candidates affected by power cuts at exam centres in Indore and Ujjain during NEET UG held on May 4 for admission to undergraduate medical courses.

Representative image NEW DELHI: Advocate Ramaswamy Neelakandan prepared for life as a high court judge by returning case files to clients after the CJI-led Supreme Court collegium on Jan 17, 2023, recommended to Union govt to appoint him, along with four other advocates, including L C Victoria Gowri, as judges of Madras high court. The Union govt appointed all of them as judges, except Neelakandan. Though names of the five advocates were sent by the SC collegium on the same day, the govt appointed them in batches - three on Feb 7, 2023, and the fourth on Feb 27, 2023. Neelakandan, who belongs to the OBC community, shares his fate with 28 other advocates, whose names were recommended to the govt by the collegium between Jan 2023 and April this year. The Centre's pick and choose policy has left them in suspense - whether to resume practice or keep waiting for the Centre's nod to become an HC judge. While Neelakandan's wait has stretched beyond 29 months, advocate Subhash Upadhyay, whose name was recommended by collegium on April 12, 2023, for judgeship in Uttarakhand HC, is waiting for his warrant of appointment for the last 26 months. Along with Upadhyay, the collegium had recommended names of three advocates and a judicial officer for appointment as judges of the HC. Only Upadhyay's name was left out. Among them, only advocate Amit Seth is still awaiting appointment. Of the 29 advocates still awaiting appointment as HC judges, five are women advocates. Among them, the one enduring the longest wait is advocate Shamima Jahan, whose name was recommended by the collegium on Jan 4, 2024, for appointment as a judge of Gauhati HC. Other women advocates sharing Jahan's fate are Sreeja Vijayalakshmi (name recommended on April 16, 2024), Tajal Vashi (Oct 15, 2024; Gujarat HC), Shwetasree Majumder (Aug 21, 2024; Delhi HC), and Sheetal Mirdha (March 5, 2025; Rajasthan HC). Despite successive chief justices, including the incumbent CJI B R Gavai, impressing upon the Union govt not to pick and choose from the list and avoid making staggered appointments from the same batch, the govt has not abandoned the practice which creates seniority issues in constitutional courts where merit and seniority are two crucial factors for career advancement. Interestingly, the collegium's recommendations for appointment of judges to Supreme Court have been speedily processed and implemented by the govt, in some cases the appointments have come through within three days of the recommendation. The collegium recommended to the govt on May 26 to appoint Justices N V Anjaria, Vijay Bishnoi and A S Chandurkar as judges of the SC. The three took oath as Supreme Court judges on May 30. On May 26, the collegium recommended appointments of chief justices to five HCs, transfers of four HC CJs and transfer and repatriation of 22 HC judges. More than a month later, govt is yet to give effect to the appointments and transfers of HC CJs and judges.
