
Pregnant Minor Rape Survivor Agrees To Give Birth After Moving Delhi High Court
A minor rape survivor who moved the Delhi High Court with a plea to terminate her 30-week pregnancy has agreed to give birth to the child, who would be given for adoption.
The 14-year-old girl, who was abandoned by her parents, moved the court through her aunt.
She was raped and impregnated by a cousin and is currently residing at a shelter home in the capital.
Justice Swarana Kanta Sharma's August 18 order observed the survivor was abandoned by both parents and the mother of the rape accused, her aunt, was the only guardian with whom she wanted to reside.
"With these peculiar background circumstances, this court by way of abundant caution, deems it appropriate to hold that the child will need care and protection under the Juvenile Justice Act, 2015 and CWC is directed to independently interact with the child, obtain her opinion and inform this court regarding the same before passing of a final order," the court said.
The survivor and her guardian agreed on giving birth after being counselled about the opinion of the medical board, which examined her and said the termination of her pregnancy was not possible, given the medical complications.
The board opined that any pre-term C-section for delivery or medical termination of pregnancy would pose higher future obstetrical implications, and if undertaken, could adversely affect her future reproductive prospects.
The board's report indicated that at the present gestation period, the child would be born alive, and the doctors have informed the girl and her guardian about the implications of terminating the pregnancy.
The board informed the court that the minor and her guardian were willing to continue with the pregnancy for the next four to six weeks.
The court noted the minor's pregnancy would continue given the statements, and it couldn't direct the termination against their will.
"Considering the above, the prayer to direct the respondents 1 and 2 (Delhi government) to medically terminate the pregnancy of the victim given the Explanation 2, Section 3(2) of the Medical Termination of Pregnancy Act, 1971, will be infructuous," it said.
The court then posted the matter for August 20, when the Child Welfare Committee would submit its report.
The girl learnt about her pregnancy in early August when she saw a doctor. She was already 27 weeks pregnant by then.
She subsequently moved the court after the doctors referred to statutory restrictions under the MTP Act, limiting such procedures to 20 weeks in ordinary cases and 24 weeks in certain categories such as rape survivors.

Barmer Gurukul teacher held for burning two students with hot iron rod
The Rajasthan Police have arrested a teacher at a Gurukul who allegedly burnt two children with hot iron rods for wetting their beds in Barmer district. The students, aged 10 and 11, narrated their ordeal to their parents, who subsequently lodged an FIR. The incident occurred on August 17 at a Gurukul in Harpaliya village under Sedwa police station limits. The teacher allegedly pressed a heated rod on the children's thighs. The Gurukul, which houses students studying Sanskrit and other subjects, has about 30 children on its rolls. On the night of August 18, the two students fled the premises but lost their way before strangers helped them contact their families. Villagers later staged a protest against the teacher. Jeevan Lal Khatri, Circle Officer, Chohtan, said: 'Students left for their home in the middle of the night but couldn't reach. Later, they contacted their family members with the help of strangers. Villagers protested against the action of the teacher. We have arrested the accused teacher named Narayan Giri under Section 151 of CrPC and provisions of Juvenile Justice Act are imposed. Investigation is ongoing and things will be clear soon'. Police said only two children have so far lodged complaints, but they suspect more students may have been assaulted earlier. Some children alleged that the teacher routinely beat them, tied their hands with ropes, and subjected them to physical abuse. This is the first time he allegedly used a hot rod.

Student Among Two Injured In Blast Outside Kerala School
Explosives found at Vyasa Vidyapeeth in Palakkad injured a student and a woman. Panic gripped a school in Kerala's Palakkad on Thursday after explosives were found near its gate, leaving a student and a woman injured. The student, unaware of the danger, had been playing with the material when it exploded, also injuring a lady identified as Leela. The incident happened at Vyasa Vidyapeeth in Palakkad district on Wednesday. Police have registered a case under section 3(a),4(a) of the Explosive Substances Act and under section 75 of the Juvenile Justice Act. Education Minister V. Sivankutty stated that the government is taking this matter seriously and has requested a report from the Director of General Education. The minister stated that the site is known to be a ground where the RSS regularly holds shakhas. He further mentioned receiving reports that additional explosives were discovered there today. The government maintained that regardless of the syllabus a school follows, its premises cannot be used for weapons training, storage of arms, or RSS drills. An explanation has been sought from the school authorities in this regard. Earlier, over 9 tons of explosives and 4,000 detonators were recovered from Kandhamal district, the Odisha Police said on Monday, suspecting a nexus between the Maoist groups and mining companies. 'We strongly suspect that the explosives being procured for mining explosion activities are getting diverted to the Maoists. There appears to be a nexus between them, and the police have been investigating the matter," the ADG said.
