Hospital bollard bill, sparked by KXAN, gets House hearing

AUSTIN (KXAN) — A bill that would require crash-rated safety bollards at most Texas hospitals, sparked by a deadly crash at St. David's North Austin Medical Center last year and a series of KXAN investigations, is set to be heard Monday morning by the House Public Health Committee.
For months, the proposal to mandate the vertical security barriers had placed a wedge between the state's nurses, which back the bill, and the lobbyist arm representing the hospitals paying them.
'The safety of nurses and hospital staff should be the highest priority of any healthcare organization,' the Texas Nurses Association previously told KXAN. 'Any and all protection should be considered to ensure our healthcare providers can come to work with confidence that they are protected and working in a safe environment.'
While the bill has attracted bipartisan support, it has also found fierce opposition from the Texas Hospital Association — which called Senate Bill 660 a 'one-size-fits-all' mandate and an 'unreasonable administrative cost burden.'

'Vehicle-into-building crashes are undeniably tragic, but we've yet to see any national studies or scientific evidence that show prevention of these incidents is a pressing, critical need for hospital safety,' THA CEO John Hawkins previously wrote.
Since the bill already cleared the Senate, it would need to advance out of the House Public Health Committee and go to a full floor vote before it could be sent to the governor. If that happens, the Texas Health and Human Services Commission would have until Dec. 1 to adopt rules laying out how it would work. With the exception of rural areas, hospitals would have to comply as of Jan. 1, 2026.
KXAN reached out to St. David's for comment but did not immediately hear back. We previously asked Ascension, Ally Medical, Baylor Scott & White, and Texas Children's Hospital if they supported the bollard bill. All attended a stakeholder meeting to give input on Austin's bollard ordinance last September. So far, none have responded.

KXAN began investigating hospital crashes — what cause them, how often they occur and how they can be prevented — following a deadly crash at St. David's North Austin Medical Center on Feb. 13, 2024.
We learned there was no local, state or federal requirement for critical infrastructures, like hospitals, to have bollards. Using crash data from the Texas Department of Transportation, the nonprofit Storefront Safety Council, along with police, fire and media reports, we created our database revealing more than 400 crashes at or into medical-related sites across the country over the past decade resulting in more than 20 deaths — data KXAN shared with lawmakers and testified about in front of a Senate panel in March.
Those statistics were cited by Sen. Royce West, D-Dallas, who authored the bollard bill after a family injured in the Austin emergency room crash spoke out publicly to KXAN.
'We re-emphasize to the Bernard family: What happened to you is a tragedy and it shouldn't happen again in the state of Texas,' West told KXAN last October. 'And, I'm going to do everything I can in my power to make sure it doesn't happen again.'

The Texas Medical Association, which represents 60,000 physicians and medical students, has not taken a position on the bill but previously said what KXAN uncovered was a 'major problem' and, recently, presented us with an award for our coverage.
'If we can even save one life, and we can make sure it's safer for not only the people that are going to the hospitals, like our patients, but also all employees, I think it's a good thing to be doing,' TMA President Dr. Ray Callas previously said.
The bill's latest hearing comes nearly six months after the Austin City Council unanimously passed its own bollard measure — also sparked by our investigations — requiring crash-tested bollards at new hospitals, urgent care clinics and stand alone emergency rooms. After the vote, public records KXAN obtained revealed St. David's, while publicly neutral, privately opposed the measure. Their lobbyist, records show, tried to quash it over St. David's objections that it, in part, 'selectively targets healthcare facilities based on an incident at one of our hospitals.'
St. David's said it spent $500,000 last year installing additional bollards before the council's vote. It has repeatedly refused to say whether those barriers are crash-rated — something the ordinance requires of new medical facilities.
Former Austin City Council Member Mackenzie Kelly initiated that ordinance. She is expected to testify again in front of the House committee. In March, she told a Senate panel: 'This is not a partisan issue. This is a life-safety issue.'

AUSTIN (KXAN) — A man who was accused of killing an Austin father and daughter in a 2023 hit-and-run in east Austin has been charged with manslaughter, a second-degree felony, according to a Travis County arrest warrant affidavit. On June 23, 2023, the driver of a 2010 red Chevrolet was involved in a two-vehicle crash in the 5500 block of Delta Post Drive. Deputies identified the suspect as Luis Rodolfo Mata Limon, said the affidavit. KXAN will reach out to Luis' attorney once it is provided. We will update this if a statement is received. According to the affidavit, Limon 'failed to give half of the roadway and struck a black ATV.' The ATV was operated by Jonathan Gomez-Guajardo, who was with his daughter Azeneth Gomez-Rodriguez. Sadly, both were killed as a result of the crash. A video from a parked Tesla nearby captured the crash and was obtained by Texas Department of Public Safety (DPS) troopers, according to the affidavit. The video showed the pickup truck traveling southwest on Delta Post Drive and the ATV traveling northeast also on Delta Post Drive. Both vehicles eventually collided head-on. The pickup truck dragged the ATV across the roadway, onto the sidewalk area and into the grass, the affidavit detailed. The truck continued traveling southwest and eventually made a complete stop. That was when Limon left the scene on foot. Additionally, Travis County deputies had spoken with witnesses in the area and one resident even captured a Hispanic man running away from the scene of the crash. Through investigation, an iPhone and cans of alcohol were left inside the truck. The affidavit stated that only the driver's side airbag was deployed and was later used as DNA evidence. The phone left inside the vehicle also provided evidence for law enforcement. Following the crash investigation, troopers showed up at the residence where the vehicle was registered–which was under his father's name, Salvador Mata Garcia. When DPS arrived at the residence, they were unsuccessful in locating Luis and Salvador. However, on June 24, DPS was able to get in contact with Salvador, the affidavit stated. The affidavit said Salvador 'made a stolen [car] report with Travis County, but could not confirm his whereabouts during the crash time.' Salvador also told troopers that Luis was not answering his calls, nor did he show up to work since the time of the crash. The days following the crash, troopers had no luck in contacting Luis. When they asked Salvador why he hadn't reported his son missing, he told officers that 'his son is a little 'dumb'' and that 'he was not worried for him,' the affidavit stated. On July 17, 2023, a search warrant was issued for the vehicle and a DNA search warrant was issued for both men. The airbag was taken from the vehicle and was submitted to DPS Austin Crime Lab for evidence and DNA collection, the affidavit stated. According to the affidavit, the DNA search warrant was issued to 'possibly identify the driver from the DNA' in the airbag. However, DNA was only collected from Salvador. Further details revealed the night before [the crash], [Luis] was at a party and did not return home and that the truck was lent to Luis, the affidavit stated. Officials believe Luis was 'possibly drinking and driving' when the crash happened and ran away from the scene to avoid an arrest because he didn't have a valid driver's license at the time, the affidavit detailed. It was confirmed in the affidavit that Luis had open alcohol containers inside the truck. Additionally, deputies said Luis did not attempt to call 911, nor did he attempt to return to the scene of the crash to render aid to the victims. KXAN previously covered in September 2023, the family of Gomez-Guajardo and Azeneth had sued two men whom they believed were responsible for the east Austin fatal crash. They hoped this would've put pressure on the men to come forward at the time. As of Monday, there is still no information on his whereabouts, the affidavit said. Copyright 2025 Nexstar Media, Inc. Tips for protecting teen drivers during 100 deadliest days

AUSTIN (KXAN) — The period between Memorial Day and Labor Day typically sees a spike in deadly crashes involving younger drivers, according to the American Automobile Association, or AAA. It's become known as the '100 deadliest days' for teen driving. AAA reports teen drivers are nearly three times more likely than drivers aged 20 and older to be killed in a crash. Daniel Armbruster, a spokesperson for AAA in Texas and New Mexico, said it's in part due to the inexperience of younger drivers. 'But also we know this increase that we see in summer time is because of the fact that kids are out of school. They have more freedom and less supervision, and so they tend to behave in a way that is more risky behind the wheel,' Armbruster said. He highlighted speeding, impaired driving and distracted driving as some of the top factors contributing to crashes. According to AAA, 60% of all teen crashes involve a form of distraction, from smart phone use and texting to other passengers in the car. 'Talking, conversations can occur when you have several young people in a car, and the driver can become distracted,' Armbruster said, emphasizing the need for the state's graduated driver's licensing law. It restricts the number of people in the vehicle allowed with a teen driver to one person under the age of 21 that is not a family member. AAA also offers 'Dare to Prepare' workshops for teens and their parents to raise awareness. The free, 75-minute interactive or in-person workshop highlights the roles and responsibilities of driving, how to pick a safe vehicle and what to look for in a good driving school. Armbruster serves as an instructor for some of these workshops. 'A lot of times, teens come in, and you can see it on their face, right? 'Oh, a workshop my parent made me come to.' But they leave with a gratitude because they've received a lot of information that is helpful in not only saving their lives, but also the lives of everyone on the road,' he said. Across the country, 13,135 people died in a crash involving a teen driver between 2019-2023, according to a AAA review of crash data from the National Highway Traffic Safety Administration. In Texas alone, 1,463 people died in teen crashes during that same period. Approximately 30% of those deaths occurred during the 100 Deadliest Days between Memorial Day and Labor Day. AAA's review went on to show that, on average, eight people are killed per day in teen-involved driving crashes in the summer, compared to seven per day during the rest of the year. In his experience with the Dare to Prepare workshops, Armbruster said the knowledge is as important for parents as it is for teens. On final day of session, Gov. Abbott vetoes Botox patient safety bill filed after KXAN investigation

AUSTIN (KXAN) — Gov. Greg Abbott vetoed legislation which aimed to enhance Botox patient safety and transparency Monday, calling the measure 'unnecessary and overly-burdensome' for business in Texas. Senate Bill 378 would have prohibited barbers, cosmetologists and estheticians from administering Botox and other injectables unless they were licensed or authorized to give the shots. The measure would also have given the Texas Department of Licensing and Regulation more disciplinary authority over those professionals. 'The passage of SB 378 is a critical step that protects the public from unqualified individuals administering potentially dangerous injections. This common-sense legislation ensures cosmetologists and barbers are not performing injections without proper physician supervision,' the bill's author, Sen. Charles Schwertner, R-Georgetown, explained after the measure was sent to the governor on May 21. KXAN has reached out to Schwertner's office for comment after the veto. 'Texas should be removing barriers for small businesses and occupational licensees,' Senate Secretary Patsy Spaw said on the chamber floor Monday, reading the governor's written words verbatim. 'Senate Bill 378 by Schwertner does just the opposite by, among other things, prohibiting a licensed cosmetologist or barber from 'making an incision into the dermis, layer of a person's skin.' Barbers who nick a customer's neck during a straight razor shave should not fear the loss of their licenses as we work to make government more efficient and less intrusive for Texans and businesses.' While most of the governor's vetoes will be delivered after the session, SB 378's passage timeline required him to take action sooner or the bill would have gone into law without his signature. It is his first veto of a Senate bill this session. 'I disapprove of this bill,' Abbott wrote to Senators before sine die, the official end of the session. 'Since you remain gathered in regular session and continue to conduct formal business, I am delivering this disapproval message directly to you along with the unsigned official enrolled copy of the bill.' Schwertner told lawmakers earlier in the session there have been increased reports of 'Botox parties' which include unauthorized and unsafe injections to friends and family without proper supervision. RELATED: 'Botox party' bill heads to governor Schwertner previously shared with KXAN investigators that, by law, estheticians and cosmetologists can only perform injections, including Botox, under the authority of a physician. He added that while the Texas Medical Board has disciplinary authority over physicians who are authorizing the injections, there is no oversight when it comes to professionals including estheticians or cosmetologists who could be in violation. During a House committee hearing in April, lawmakers received nearly 50 written comments from many Texas estheticians and injectors opposing the legislation and sharing concerns about their businesses being impacted. KXAN INVESTIGATION: Backroom Botox a 'wild west' in Texas Patient protection advocates have been pushing for oversight in the growing industry. The legislation was filed after a KXAN investigation uncovered that anyone in Texas can become certified to do injections, including Botox. KXAN's 'Backroom Botox' investigation highlighted medical concerns after a Botox treatment led to an emergency in the back room of a local boutique in Dublin, a city north of Austin.
