Assault charges against ward councillor provisionally withdrawn

Assault charges against Nelson Mandela Bay ward councillor Mpumelelo Majola have been provisionally withdrawn.
Majola's lawyer, Bond Nyoka, said his client had made multiple appearances at the Gqeberha magistrate's court without the case progressing due to outstanding matters.
Majola was arrested in Central by traffic officers in March.
In a video clip, the New Brighton councillor was seen fending off attempts to apprehend him and put him in the back of a traffic car, while bystanders watched.
Speaking on Thursday, Majola described the incident as an ugly experience that he would like to put behind him.
'If something of this nature can happen to a councillor, how much more to ordinary citizens.
'I'm saddened that people watched me in that situation.
'I was traumatised by that ordeal.
'People encouraged me to open a case, but I didn't want to.
'What happened to me was not OK,' he said.
Majola said that as a councillor, he is the face of the metro and cannot be seen having fights in public.
'I've forgiven them.
'I don't want to deal with this any further, and God will handle it from here,' Majola said.
In the video, two officers are seen struggling to get Majola to obey them as they try to handcuff him and put him inside the traffic vehicle.
The man who filmed the arrest is heard shouting: 'You are wrong, you are harming him, you are f***ing harming him.
'I'm videorising you.
'This is our ward councillor, you don't know this guy.
'You can't do this.
'You are wrong, the guy gave you everything you asked for, look at his arm, and now you're calling for backup.
'How can you hit someone who admitted to you and gave you his particulars? We can't let you do this,' the man shouts.
Another bystander is heard saying: 'Allow the officers to do their job.'
Meanwhile, Nyoka said he had raised objections because of outstanding documents.
'The case started in March, and on two occasions, the docket was missing or not brought to court.
'The provisional postponement doesn't mean the case won't be reinstated, but we're happy even though it could be brought back.
'Councillor Majola is going to the doctor tomorrow because what happened to his chest on that day.
'He is relieved as this was stressful, and the perception was that how can a councillor be accused of assault,' Nyoka said.
National Prosecuting Authority regional spokesperson Luxolo Tyali confirmed Majola's case had been withdrawn on Thursday.
'There was no docket, so it's a provisional withdrawal pending the availability of the docket,' Tyali said.

He faces charges of conspiracy to commit murder and murder. He told the court he plans to enlist his own private legal representative. Netshiunda said the murder investigation was handed to provincial serious and violent crime, murder and robbery detectives who cracked the case and arrested twins Vukani and Vukile Mchunu aged 35 on July 27. Investigations also pointed to Sandile Sakhile Ngcobo, 38, as the alleged mastermind behind the killing. Ngcobo made his first appearance on August 4 and is also an accused in a triple murder and attempted murder case in which he allegedly shot dead three people accused of murder in Msinsini in 2021. 'The three had just appeared in court when they were shot dead in a vehicle in Hibberdene on June 27 2024. A passer-by also sustained a gunshot wound during the incident,' said Netshiunda. Bail proceedings for eThekwini metro police officer Qiniso Sishi, who is charged with fatally stabbing his wife Thandokuhle Mkhize, failed to get under way in the Durban magistrate's court on Monday. Sishi's lawyer Musawenkosi Mkhize told the court, packed with family, friends and political party representatives, he was not able to fully consult his client at the Westville correctional facility. Thandokuhle Mkhize, a lawyer, was stabbed multiple times in the early hours of July 28 at their home in Woodlands, south of Durban. 'I had an appointment on Friday to consult my client at Westville and when I got to the prison I was made to wait for two-and-a-half hours,' said Musawenkosi Mkhize. During the wait he was informed Sishi was in the medical wing of the prison where he was being treated for injuries sustained during the incident on July 28. 'After some time I was told he could not be located — no-one knew where he was. This [is the] reason the defence is not in a position to continue with the bail application. I require ample time to take instructions, otherwise I would not be doing justice with this bail [application].' When magistrate Ashwin Singh adjourned the matter, Sishi was all smiles, much to the chagrin of Thandokuhle Mkhize's daughter Aphiwe Mkhize, who shouted to him ' sengathi ungafela phakathi ' (may you rot in jail).

A KwaZulu-Natal teacher and a 16-year-old girl died when the car in which they were travelling veered off a cliff in KwaSwayimane on Saturday. Transport and human settlements MEC Siboniso Duma said it was not clear what caused the vehicle driven by Anastasia Shabalala to reverse and fall off a cliff. The girl was identified as Lona Madlala. 'Shabalala, a single parent, received the car last year as a gift from her children. Sadly she left us on Women's Day. 'The helicopter rescue team worked under very difficult conditions to retrieve their bodies from the wreckage more than 800m down the cliff.' Duma said teacher Mbali Msomi alerted traffic ambassador Ayanda Msweli about the incident. 'We acted immediately by calling for the helicopter rescue team and reinforcement.
