Ghaziabad: The district consumer disputes redressal commission has directed a two-wheeler showroom to pay a bike owner 50% of an accident claim for a delay in processing his insurance policy despite being paid in full. The biker's wife met with an accident just two days after the vehicle was purchased and died, but was still uninsured as the showroom sat on the papers for six days before processing them. The petitioner, Dipanshu Jha, told the commission he had purchased a general insurance policy for the vehicle which included personal accident coverage worth Rs 15 lakh from Magma HDI General Insurance Company Limited through Sahibabad's Sahib Automobiles, from where he purchased the bike, on Feb 1, 2023. The commission issued a notice to the motorcycle dealer, but in the absence of any response, took up the matter ex parte. Appearing before the commission later, the insurance company refused to take responsibility because they issued the policy with an IDV of 73,099 and personal accident cover of Rs 15 lakh on Feb 7, 2023, which was valid till Feb 6, 2024. After hearing both the parties, the commission concluded that there was no instance of deficiency of service on the part of the insurance company. However, since Sahib Automobiles did not place on record any proof that it paid the amount meant for insurance to the company after obtaining it from Jha on Feb 1, it was liable to be declared guilty of deficiency in service.
