Man charged with assaulting pregnant wife using rubber pipe
KUALA LUMPUR: A man claimed trial at the Sessions Court today to a charge of kicking and assaulting his expecting wife with a rubber pipe last month.
Daniel Kenneth Abdullah, 35, entered his plea after the charge was read out before Judge Zulqarnain Hassan.
He is accused of causing hurt to his 24-year-old wife by kicking her left leg and striking her body with a rubber pipe.
The offence allegedly took place at 9pm on April 30 at their home in Bandar Sri Permaisuri.
The charge is framed under Section 324 of the Penal Code, read together with Section 326A.
Section 324 provides for a maximum prison sentence of 10 years, or a fine, or whipping, or any combination thereof, upon conviction.
Section 326A allows for the maximum imprisonment term under Section 324 to be doubled, along with the possibility of a fine or whipping if found guilty.
Deputy public prosecutor Mohamad Ikhwan Mohd Nasir did not offer bail.
"The offence is non-bailable. We are concerned as the victim is terrified, as she is still living under the same roof as the accused," he said.
In mitigation, Daniel, who was unrepresented, pleaded to be granted bail.
He promised to care for their two children, aged one year and four months, and claimed that his wife is currently pregnant.
However, the judge denied bail and fixed June 9 for mention.
