Legco passes bill to boost part-timers' rights
Labour chief Chris Sun says the government wants to improve the rights of part-time workers.
Lawmakers on Wednesday passed legal changes that officials say will better protect labour rights for part-timers.
Workers are currently only entitled to benefits like paid rest days and annual leave if they are employed under a continuous contract.
Such a contract is defined as working four straight weeks for at least 18 hours a week, otherwise known as the "418 rule".
The change to a "468 rule" now, means people working 68 hours over four weeks will be considered as continuously employed.
Labour minister Chris Sun said the change will take effect six months after the new law is gazetted.
He told lawmakers that as there have been changes in the labour market, the government initiated the amendment process three years ago, to improve the rights of workers.
"This legal amendment is allowing greater flexibility in calculating work hours and lowering the threshold for what qualifies as a continuous contract, making it easier for employees to meet the revised continuous contract requirement," Sun said.
"There will also be fewer disruptions to continuous employment in the event the workers' hours occasionally fall below the threshold in a certain week."
Some lawmakers who own businesses expressed concern about the changes.
Noting that employers often are the ones making roster decisions, Sun sought to allay their concerns by saying that the rule change would not give workers a bigger say on their working hours.
Sun added that other clauses under the Employment Ordinance are unchanged, and workers who already qualify as working under a continuous contract are not affected by the bill's passage.

The Hong Kong government has announced that 28 candidates will be competing in next month's 'patriots only' by-elections for the 21 seats on the powerful electoral body that chooses the city's top leader. The Registration and Electoral Office's announcement on Tuesday also confirmed media reports that 72 candidates – or 77 per cent of the Election Committee's by-election seats – would be uncontested. Those nominees, facing no competition, are expected to be automatically elected. The remaining 28 candidates will compete for 21 seats in six subsectors — Commercial (Third), Architectural, Surveying, Planning and Landscape, Technology and Innovation, Labour, as well as representatives from three government-appointed committees. The Candidate Eligibility Review Committee said on Monday that 100 candidates nominated for the September 7 polls had passed a national security screening to compete for the 93 seats on the Election Committee. Five polling stations will be set up on September 7, the day of the by-elections, opening from 9am to 6pm, according to the Tuesday statement. The Electoral Affairs Commission will hold a briefing session on Monday to allow candidates to familiarise themselves with the electoral arrangements and 'to ensure that the By-elections will be conducted in an open, fair and honest manner.' According to voter registration figures updated last month, there are 8,877 registered voters for the Election Committee polls, down from 257,992 in 2020. The 117 Election Committee seats held by district councillors were removed in the 2021 electoral overhaul, following the pro-democracy camp's landslide victory in the 2019 district council elections, held amid the anti-extradition bill protests. The Election Committee gained new powers after Hong Kong overhauled its electoral system in 2021, expanding the body's size from 1,200 to 1,500 members and allowing it to nominate and directly elect 40 of the 90 seats in LegCo. Besides having a hand in nominating and electing the chief executive, candidates filling the 93 vacancies next month will also have the power to influence the upcoming Legislative Council elections on December 7. In a separate announcement, the government announced on Wednesday that the nomination period for the LegCo elections would begin on October 24 and last two weeks, ending on November 6. The current term of the legislature will be dissolved once the nomination period begins. In March 2021, Beijing passed legislation to ensure 'patriots' govern Hong Kong. The move reduced democratic representation in the legislature, tightened control of elections and introduced a pro-Beijing vetting panel to select candidates. The Hong Kong government said the overhaul would ensure the city's stability and prosperity. But the changes also prompted international condemnation, as it makes it near-impossible for pro-democracy candidates to stand.

That finding came in a survey of 1,000 family members of employees and 400 human resources professionals in July and August last year. The study found that most family members want flexible hours, a five-day week and work-from-home arrangements for their family members. Executive director Ferrick Chu said that despite support from HR professionals for the former two measures, implementation still required endorsement from senior management. For leave that is beyond what's stated in the Employment Ordinance, HR professionals said that is not difficult to implement, he said, "as long as the employer agrees". Chu added that most of them say they aren't afraid of abuse as there are ways to handle such issues, such as asking for proof of need. Of companies in the study, only about 10 percent has a family-friendly policy down in writing. If they introduce a good policy, it may help to change the culture and practice, he said Chu added that the study can help companies gather information and adopt suitable policies, and that other institutions should conduct similar studies. "It is not something for the EOC to do alone, it's for the whole of society to support the measure, to change the culture."

US President Donald Trump on Monday picked a right-wing think tank economist to head the Bureau of Labour Statistics, replacing the commissioner he fired for reducing previously reported job growth estimates. Trump said in a post on his Truth Social platform that he was nominating E.J. Antoni to be commissioner of the bureau. 'Our Economy is booming, and E.J. will ensure that the Numbers released are HONEST and ACCURATE,' Trump said in the post. 'I know E.J. Antoni will do an incredible job in this new role.'
