Courts and the making of transgender rights

It is inspiring to recall that seven decades ago, Hansa Mehta, a member of the Constituent Assembly, ensured that the phrase 'All men are born free and equal' in the first Article of the Universal Declaration of Human Rights was changed to 'All human beings are born free and equal'.
In Hindu mythology, there is an ancient cultural acknowledgment of gender fluidity. Yet, for decades, transgender people simply did not exist in the eyes of the law. They lived, struggled, raised families, danced at births, mourned at funerals, and were part of India's social and spiritual fabric for centuries. Still, they remained on the margins, shunned from society, denied basic rights and targeted for their gender identities. And legally — on school forms, ration cards, voter IDs, and census sheets — they were invisible.
Until the late 1990s, voter registration forms did not provide an option beyond male or female, effectively disenfranchising transgender citizens. Public hospitals, welfare schemes, and official forms, all designed around a strict male-female binary, left them without access to essential services. Lacking legal recognition, many were unable to obtain basic identity documents, apply for jobs, or claim protections under existing laws — leaving them vulnerable to poverty, exploitation, and violence.

There are some judicial decisions in India that fundamentally changed the complex calculus of sexuality, power, religion, caste, masculinity, patriarchy, and gender. The Supreme Court's decision in National Legal Services Authority (NALSA) v. Union of India, 2014 stands as one such example.
The legal battle began with separate petitions filed in 2012 and 2013 by the National Legal Services Authority (NALSA), the Poojya Mata Nasib Kaur Ji Women Welfare Society, and Laxmi Narayan Tripathi, a leading voice from the hijra (transgender) community — all seeking legal recognition of a third gender.
The petitioners argued that limiting legal recognition to binary genders is violative of the Right to Equality, Right to be Free from Discrimination, Equality of Opportunity, Freedom of Expression, and Right to Life or Personal Liberty (Articles 14, 15, 16, 19, 21 of the Constitution, respectively). The Supreme Court responded with clarity and conviction.
In a landmark judgment, the two-judge bench recognised transgender individuals as the third gender, who are fully entitled to all legal rights bestowed upon citizens by the Constitution. The Court ordered states to grant legal recognition to transgender people, reservations in education and employment, and offer welfare — an ambitious list of affirmative actions that acknowledged historical harm.
Crucially, NALSA's true breakthrough lay as much in recognizing a third gender as in affirming the right to self-identify — a radical move even by international standards. The Court asserted that one's gender does not need to be authenticated by surgery, paperwork, or state verification — and that identity is an inherent aspect of personal dignity and autonomy. Justice KS Radhakrishnan (who was to retire in a month) said, '(…) the moral failure lies in the society's unwillingness to contain or embrace different gender identities and expressions, a mindset which we have to change.'
Lauded globally as one of the most progressive interpretations of gender rights, the judgment also laid the groundwork for later verdicts like Puttaswamy, 2017 (the right to privacy), and Navtej Singh Johar, 2018 (decriminalisation of homosexuality). With one stroke of the pen, the Court had rejected the dehumanisation of those who do not fit neatly in gender boxes. But reality tells a different story. The Transgender Persons (Protection of Rights) Act, 2019, ostensibly passed in response to the judgment has been widely criticised for requiring certification of gender by district authorities — a clear contradiction of the right to self-identification upheld in NALSA.
Critics argue that the Act undermines the principles of autonomy, dignity, and equality established by the Court. Many trans-persons still face barriers to education, health care, and housing. Violence against them remains disturbingly common. Lack of livelihood opportunities means they are frequently forced into prostitution. But NALSA stands out not just for what it changed in the law, but for changing the conversation from control and classification to recognition and autonomy.
It reminds us that the Constitution is not a cold document, it is a living promise. And it begins the work of drawing those beyond the binary into the fold of citizenship — not as exceptions, but as equals. Courts have done their part. Now we must do ours.

New Delhi: The Supreme Court on Thursday said the first major issue to be dealt with in cases concerning Rohingyas is whether they are refugees or illegal entrants. A bench of Justices Surya Kant, Dipankar Datta and N Kotiswar Singh said once that is decided, the other issues might be consequential. The court observed this while hearing a batch of pleas concerning Rohingyas in the country. "The first major issue is simple, are they refugees or illegal entrants," Justice Kant observed. The bench took note of the broad issues that arise for its consideration in the pleas relating to Rohingyas. "Whether the Rohingyas are entitled to be declared as refugees? If so, what protections, privileges or rights they are entitled to?" the bench said. It said the second issue is if the Rohingyas are not refugees and are illegal entrants, whether the action of the Centre and states in deporting them was justified. "Even if the Rohingyas have been held to be illegal entrants, can they be detained indefinitely or they are entitled to be released on bail, subject to such conditions as the court may deem fit to be imposed?" it asked. The court said the other issue raised in the petitions is whether the Rohingyas, who have not been detained and are living in refugee camps, have been provided basic amenities like drinking water, sanitation and education. "If the Rohingyas are illegal entrants, whether the Government of India and the states are obligated to deport them in accordance with law," it noted. The bench segregated the pleas in three groups -- one relating to Rohingyas, another not pertaining to the issue of Rohingyas and one plea that it said pertains to a different matter altogether. It said the three groups of matters would be determined separately and it would fix those for hearing on consecutive Wednesdays. The bench indicated that on the point of those who were found to be illegal entrants and on the question of the State's responsibility to deport them, it could only lay down the principles. During the hearing, the bench asked why these petitions were tagged for hearing. The counsel appearing for the petitioners said there were overlapping issues in the pleas and one of the core issues pertained to the detention of Rohingyas. One of the lawyers said the Rohingyas cannot be detained indefinitely. On May 16, the supreme court had rapped some petitioners who had claimed that 43 Rohingya refugees, including women and children, were dropped in the Andaman sea for deportation to Myanmar and said "when the country is passing through a difficult time, you come out with fanciful ideas". It had questioned the authenticity of the material placed before it by petitioner Mohammad Ismail and others and refused to stay any further deportation of Rohingyas, saying a similar relief was denied by the court earlier. On May 8, the top court had said if the Rohingya refugees in the country were found to be foreigners under Indian laws, they would have to be deported. The court had then referred to its earlier order and remarked that the identity cards issued by the United Nations High Commissioner for Refugees (UNHCR) may not be of any help to them under the laws. MUMBAI: Special trial judge A K Lahoti, in a key finding that led to the collapse of the Malegaon blast case , held that the prior sanction under the anti-terror law UAPA against the accused was "invalid." It was issued without judicious application of mind, and the mandatory twin test safeguard required by law was not scrupulously followed, the court said. The judge analysed Section 45 of the Unlawful Activities (Prevention) Act (UAPA), which outlines procedural safeguards. Section 45(1) requires valid sanction from the Centre or state govt to prosecute any terror offence under the Act. Section 45(2) mandates an independent review of the evidence by an authority appointed by the govt. Lt Col Prasad Purohit, through his counsel Shrikant Shivade (who passed away in 2022) and later advocate Viral Babar, had consistently argued that the UAPA sanction was flawed. Other accused also challenged the validity of the Jan 2009 sanction and another issued in 2011 by the additional chief secretary (home). The trial court held both sanctions to be "defective." So, all the provisions of UAPA will not be invoked," the judge ruled. Advocates Ranjeet Sangle (for Sudhakar Dwivedi) and J P Mishra (for Sadhvi Pragya Singh) also argued that the first sanction bypassed the statutory safeguard under Section 45(2), and that the absence of such review invalidated the trial court's cognisance of UAPA charges. Special public prosecutor Avinash Rasal had contended that the sanction's validity could only be decided during the trial, a view echoed by the Supreme Court in 2018. However, the special judge reviewed the sanctioning procedure and found that UAPA charges could not be sustained due to the faulty sanction. Shivade had also pointed out that the authority did not comply with the mandatory safeguard of an additional review committee required under law since Dec 31, 2008. The prosecution argued that since the crime occurred in Sept 2008, the earlier 2004 provision-without the second review-was applicable. But the Supreme Court clarified in 2023 that the UAPA's procedural safeguards during sanction are mandatory.
