Najib Betrayed Public's Trust, SRC International Wants RM42 Million Back
Counsel Kwan Will Sen, representing SRC International and its subsidiary, Gandingan Mentari Sdn Bhd, in the RM42 million civil suit against Najib, stated that it has been ten years since the money ended up in Najib's personal accounts and now, the two companies want it back.
He made these remarks while delivering the opening statement on the first day of trial in the civil suit filed in May 2022 by SRC International and Gandingan Mentari against Najib (the sole defendant).
'Three courts namely the High Court, Court of Appeal and Federal Court, have already found him (Najib) criminally guilty of these very acts beyond a reasonable doubt.
'Najib was the Finance Minister at the time and had full control over SRC International. He held key positions, including that of Advisor Emeritus. As such, no significant transaction occurred without his knowledge or consent,' he said.
Kwan also stated that the evidence will prove that the RM42 million was transferred from SRC International and ultimately ended up in Najib's personal bank accounts. Of this sum, RM32 million was immediately transferred to two companies that had previously covered shortfalls in Najib's accounts.
'These transfers were made pursuant to instruction letters bearing his (Najib) personal signature. The remaining RM10 million was spent through personal cheques issued by Najib himself,' he said.
'We say that the money trail is clear, the documentary evidence is overwhelming, and Najib's own sworn admissions are damning. We will prove our case under three complementary causes of action; knowing receipt, dishonest assistance, and misfeasance in public office.
'On any of these grounds, justice demands that these public funds be returned to their rightful owners – the Malaysian people,' he insisted.

KUALA LUMPUR: The royal pardon granted to Prime Minister Datuk Seri Anwar Ibrahim in 2018 fully restored his eligibility to contest elections and hold office, according to constitutional law expert Emeritus Prof Datuk Dr Shad Saleem Faruqi. He stated that the pardon under Article 42(1) of the Federal Constitution erased all legal consequences from Anwar's previous conviction. 'Once there was a free pardon under Article 42(1), all disqualifications under Article 48(1) were removed and there was absolutely no need for His Majesty to issue a new, second order to lift the disqualification,' he explained in an op-ed to Bernama. Shad Saleem addressed recent claims by opposition leaders questioning Anwar's eligibility under Articles 48(1)(e) and 48(3) of the Federal Constitution. He clarified that a full pardon not only releases a person from serving a sentence but also removes legal disqualifications. 'It includes those that would otherwise bar the individual from contesting or holding office as a Member of Parliament (MP). Once there is a free pardon, all disqualifications under Article 48(1) are removed,' he said. He cited case law from Malaysia and other Commonwealth countries, including Anwar Ibrahim (2018) and Jeyaratnam v AG (1990) from Singapore. A free pardon 'wipes the slate clean,' restoring the individual's full legal standing, he noted. Shad Saleem also referenced the 1969 case of DAP veteran Lim Kit Siang, where a royal pardon reinstated his MP position after disqualification due to a technical breach. 'If this view is correct, that a free pardon wipes the conviction off the slate, then the Article 48(3) removal of disqualification order is absolutely unnecessary,' he concluded. - Bernama

Justice assured in Zara Qairina case, says PM Anwar
LARUT: Prime Minister Datuk Seri Anwar Ibrahim has reiterated that justice will prevail in the case of Form One student Zara Qairina Mahathir's death. He emphasised that no one involved will evade accountability. Anwar cautioned against attempts to manipulate the case or tarnish individuals' reputations. 'The government has said the police are investigating, and I have made it clear that it doesn't matter who (is involved), they will be investigated,' he said at the MADANI Dairy Entrepreneurs Carnival. The event, themed 'Driving Modern Agricultural Revolution, Generating People's Economy,' was held at the Farm Fresh Perak Dairy Complex. Perak Menteri Besar Datuk Seri Saarani Mohamad and ministers Datuk Seri Mohamad Sabu and Fadhlina Sidek were also present. Anwar highlighted the government's commitment to protecting vulnerable groups like fishermen and farmers. He shared his routine of visiting small eateries weekly to engage with the public.
