
FBR's binding instructions: Member Legal approached regarding alleged blatant violations
Concerns have been raised over certain field formations initiating recovery proceedings in apparent disregard of the landmark order passed by the Division Bench-I of the ATIR, as well as the explicit and binding directives earlier issued by the FBR itself. These actions are being viewed by stakeholders as attempts to undermine the authority of both the appellate forum and the FBR's own legal framework.
Tax lawyer Waheed Shahzad Butt, speaking to this correspondent, 'emphasized the gravity of the situation. It is imperative that necessary steps be taken to ensure strict compliance with the FBR's binding instructions and the judicial pronouncements of ATIR. Any deviation from these standards amounts to administrative overreach and poses a serious risk to justice,' he stated.
According to sources, a formal request has been made to the Member Legal to issue urgent and unequivocal instructions to all concerned field formations, directing them to halt actions that are inconsistent with established legal precedent and the FBR's internal guidance. Observers noted that the matter now warrants immediate and serious attention to prevent further miscarriage of justice and to preserve the integrity of administrative and judicial processes within the tax system
It is deeply concerning that the binding instructions issued by the FBR have been openly violated, without any justification or explanation. Such a defiant act reflects either willful disobedience or gross incompetence, both of which are unacceptable and damaging to the credibility of the tax administration. The 161 notices generated under the command of flagship entity of the FBR exhibit a glaring lack of professional diligence and legal awareness. Such conduct not only undermines the integrity of the department but also exposes taxpayers to unlawful proceedings, thereby eroding public trust, Waheed added.

Tax frauds and smuggling gangs: FTO seeks action against FBR officers
ISLAMABAD: A key recommendation of the Federal Tax Ombudsman (FTO) remained unimplemented by the Inland Revenue and Customs wings of Federal Board of Revenue (FBR) wherein FTO recommended action against FBR officers who are allegedly involved with private TAX FRAUD GANGS involved in selling non-custom paid products, with connivance of some FBR/Customs/IRS tax employees. It is reliably learnt that the FTO has issued very crucial order in Complaint No 1763/2024 (Waheed Shahzad Butt versus Secretary Revenue Division, Islamabad) wherein FTO has directed the FBR to initiate disciplinary proceedings against the officers responsible for failure to submit comments in a case involving gang selling non-custom paid products in connivance with FBR employees, causing huge loss of revenue. FTO directs DG I&I-IR to dig out cybercriminals who used IP addresses for introduction of fake supplies in supply chain FTO further ordered FBR to direct the Directorate of I&I-Customs and I&I-IR to conduct a detailed investigation on the issues involved in the Complaint On the basis of public interest complaint lodged by a tax lawyer Waheed Shahzad Butt, the FTO has ordered the Chairman FBR to conduct an investigation with the help of Federal Investigation Agency (FIA) and other agencies and submit a detailed report. FBR is not ready to accept the naked truth about open violation of law and promoting huge tax evasion by allowing the sale of non-customs paid goods without any check and balance. Complainant prayed that FIR(s) may kindly be lodged against the mastermind culprits of this biggest fiscal scam so that the same may be referred to FIA/NAB/HR Cell of the Supreme Court of Pakistan, appropriate disciplinary and criminal proceedings may kindly be initiated against the public office holders and other respondents responsible to cheat the national exchequer/taxpayers of Pakistan and damaging the taxation system of Pakistan for openly selling non-custom paid products across Pakistan through illegally opened/maintained microfinance accounts. LHC-IHC DBs to hear all tax, financial cases directly
ISLAMABAD: All tax related and financial cases would now be directly heard by Divisional benches of Lahore and Islamabad High Courts to speed up clearance of all pending cases of Federal Board of Revenue (FBR) in higher courts. Thus, single benches of LHC/IHC would not hear tax related cases in future. The tax experts/advisers and lawyers are happy that the tax related cases of Federal Board of Revenue (FBR) pending in higher courts would be early decided after High Courts' decision of hearing of all tax and financial matters by Divisional benches of Islamabad and Lahore High Courts. FED related cases: FBR allows direct ATIR appeals Asif S Kasbati, Senior Tax & Legal Advisor explained recently issued notifications by the LHC and IHC. All tax and financial matters writ petitions will now be heard by Divisional Benches of the LHC and IHC. This means that the single bench will not hear cases or Intra-Court Appeals, but the tax and financial matters will now be heard by these two High Courts' Divisional Benches. Resultantly, it would not only provide speedy justice to the taxpayers but also reduce cost of doing business. When discussed the above matter, Kasbati elaborated that Chief Justices of Islamabad & Lahore High Courts, issued notifications, pursuant to the decision of National Judicial (Policy Making) Committee made in the 53rd Meeting dated July 11, 2025. The order has been issued by IHC, in exercise of powers conferred under Rule 158, Part B, Chapter 5 and Rule 40, Part F, Chapter 2 of the Islamabad High Court Practice and Procedure Rules, 2025 (Volume V). Another order has been issued by the LHC, in exercise of Rule-1 of Part-B, Chapter 3 & Rule 3 part-II of Part J, Chapter-4, Lahore High Court Rules & Order Volume-V. As per the Order, all Constitutional Petitions pertaining to tax and financial matters will be heard and decided by the Division Benches instead of Single Bench of Islamabad and Lahore High Courts. Kasbati, ICAP all Fiscal Laws Committee Member, added that in addition to Lahore, the Lahore High Court Order also encompass Rawalpindi, Multan and Rawalpindi Benches. Consequently, Kasbati was of the view that there will not be any Intra Court Appeal (ICA) before the Divisional Bench in LHC on the pattern of the Sindh High Court (SHC). LHC/IHC has harmonized laws in line with the SHC. Kasbati, PBC Core Tax & Legal Committee Member concluded that the decision will speed up the appeal process, with better quality order, if Single Bench Judges, having sound tax & financial matters knowledge, are transferred to the Division Bench (as two heads are always better than one). Biometric verification of registered persons: LTBA urges FBR, Nadra to bring in secure mobile app
ISLAMABAD: The Federal Board of Revenue (FBR) and the National Database and Registration Authority (Nadra) should jointly implement a secure mobile application for biometric verification of sales tax registered persons. According to a letter of the Lahore Tax Bar Association (LTBA) to the FBR Chairman, the association highlighted major challenges faced by certain sales taxpayers under the current biometric verification system and proposed a digital solution aligned with FBR's commitment to facilitation and innovation. Presently, biometric verification for sales tax registration and annually bio metric which required in terms of SRO 350(1)/2024 is conducted exclusively through Nadra's physical infrastructure. While this may suffice for most residents, it poses considerable challenges for the following categories of taxpayers: (I); Individuals temporarily residing or travelling abroad. (2); Taxpayers located in remote or underdeveloped areas. (3); Elderly or physically challenged individuals who cannot easily access the Nadra facilities. Due to the unavailability of a remote verification mechanism, these taxpayers are unable to complete their sales tax registration and annually biometric which required in tarns of SRO 350(1)/2024 dated 07.03.2025, despite their willingness to comply with legal requirements. This creates unnecessary delays, hampers business operations, filing of sales tax returns and discourages potential entrants into the tax system. Key challenges included no Remote Option for Overseas Taxpayers and delays in Registration Activation and filing of sales tax returns. He LTBA proposed the FBR should consider in coordination with Nadra, the development and deployment of a secure mobile application for biometric verification. This solution may include facial recognition or fingerprint scanning wing smartphone technology and secure integration between the FBR and the Nadra. The expected benefits included enhanced taxpayer's facilitation particularly for overseas Pakistanis and remote areas residents, improved compliance rate with quicker registration and fewer delays; expanded lax base and alignment with FBR's digital transformation and automation goals. The association is confident that this initiative would greatly enhance the accessibility, efficiency, compliance and Inclusivity of FBR's taxpayers' registration system and ease filing of sales tax returns and enhance the revenue collection, it added.
