SC seeks report from Centre on measures to curb child trafficking

New Delhi [India], August 11 (ANI): The Supreme Court on Monday directed the Central government to submit a detailed report on measures taken to curb child trafficking, which it said is rampant in Delhi.A bench of Justices JB Pardiwala and R Mahadevan Court also expressed displeasure over the grant of bail to accused in child trafficking cases, saying it would examine those orders.'File a detailed report on how bail was granted and how the state opposed the bail. If need be, we will take suo motu cognisance of those bail orders," Justice Pardiwala said after the bench was informed by the counsel Delhi government that the alleged kingpin was granted bail.The counsel said, 'Two more children, who their parents sold, had recently been recovered, and that the alleged kingpin had been arrested. However, she was subsequently granted bail."The apex court listed the matter on August 18 for further hearing.The top court was hearing a case raising concerns about a major inter-state child trafficking racket, in which multiple accused allegedly kidnapped children and sold them across states, including Rajasthan, Bihar, and Jharkhand, to childless couples.Earlier, the top court had expressed serious concern over the issue of child trafficking in the country and said the situation is getting worse. The apex court took cognisance of a media report where police busted a gang involved in abducting and selling newborn babies in Delhi.The news report stated that the gang operated across state borders, mainly targeting remote villages and hospitals in Rajasthan and Gujarat. The newborns, some barely a few days old, were taken and kept in slum areas around Delhi before being sold to childless couples for anything between Rs 5 and Rs 10 lakh, it had said.On April 15, the apex court delivered a judgement and said that if any newborn infant is trafficked from any hospital, immediate action against the hospital should be suspension of the hospital's license to run the hospital.It had also issued a set of guidelines for all the states to prevent child trafficking and offences arising out of it.To curb the trafficking of newborns, it had issued a slew of guidelines saying that any laxity in implementing the directions would be taken seriously and be treated as contempt of court.It had expressed serious concern over the bail granted to a group of accused in child trafficking cases by the Allahabad High Court and cancelled their bail. Clad in caps and raincoats, switching off the lights after entering the building, putting locks on the door of every house on the premises except that of their target. This is how four men carried out a heist to the tune of Rs 50 lakhs inside a house in East Delhi's Laxmi Nagar on Saturday. The house was empty as the occupants were out to celebrate Raksha Bandhan, the police said. According to the police, the incident happened around 4:30 am on Saturday, when four men entered a residential building in FF block of Laxmi Nagar. The men were wearing mufflers and raincoats to hide their faces, while donning gloves to avoid fingerprint marks, an officer said. The suspects then moved to the first floor of the building, and noticed one locked house with all lights switched off, the officer said. According to the police, the house belonged to Apratim Jaiswal, who along with his wife, were out since Friday, as they had gone to their relative's place to celebrate Raksha Bandhan. Setting their eyes on the target, the men, fearing interruption, proceeded to put locks on all the houses in the building, except Jaiswal's home before breaking inside his house by busting the lock of the main door. Then, the suspects proceeded to rob Rs 1 lakh in cash, and several gold, diamond alongside other jewellery amounting to Rs 40 lakh. After allegedly committing the theft, the men switched off the lights of the building stairs, and fled, police said. The CCTV camera at the building caught their movement, an officer said.

Observing that boys are equally vulnerable to sexual assault as girls, a Delhi court recently sentenced a man to 15 years of imprisonment for raping a minor boy in 2019. 'Boys are as vulnerable to the sexual abuse and exploitation as that of girls and they are equally susceptible to the heinous crime of penetrative sexual assault. It is generally presumed that only girls can be subjected to penetrative sexual assault,' noted Additional Sessions Judge (ASJ) Anu Aggarwal of Saket court in her order dated July 31. 'However, this is a myth and the POCSO (Protection of Children from Sexual Offences) Act has been designed to cover all the children irrespective of their gender as children are at the risk of being sexually assaulted,' she added. 'POCSO Act is a gender neutral act qua (in the capacity of) the accused and the victim. It was enacted to provide the children with protection from the offence of sexual assault, sexual harassment and pornography. The Act has been designed to protect all the children under the age of 18 from sexual abuse, regardless of their gender,' the court said. ASJ Aggarwal was hearing arguments on sentencing against the man, who was convicted under Section 6 (aggravated penetrative sexual assault) of the POCSO Act, and under Section 377 (unnatural offences) of IPC (Indian Penal Code) on July 23. Additional Public Prosecutor (APP) Arun K V, who represented the state cited a report by the Union Ministry of Women and Child Development, which mentioned that approximately 54.68% of child sexual assault victims are boys. The APP also mentioned that male children were equally vulnerable to sexual abuse comparable to their female counterparts. 'The mental trauma that the sexually abused boy experiences is the same as that of other sexually abused survivors. They experience fear, flashbacks and undergo post-traumatic stress disorder,' the court said. It added that boys feel ashamed due to the 'societal framework'. The court also directed the man to pay Rs 2 lakh to the survivor, who was in class 4, when the offence was committed. The state was also directed to pay Rs 10.5 lakh as compensation to the survivor.
