Judge allows supervised visits for father caught on camera kicking toddler daughter at Sunny Isles Beach condo

CBS News22-05-2025

A father who police way was caught on camera kicking and dropping his 2-year-old daughter at a Sunny Isles Beach condo will have to wait a little longer to see if he will be released from jail.
Andrei Sevastianov is facing charges of aggravated child abuse with great bodily harm, child abuse, and resisting arrest with violence.
On Wednesday, he appeared before Miami-Dade County Judge Mindy Glazer, who found probable cause for the child abuse charges and resisting arrest charge, ordered that he be held without bond. She issued a no-contact order with the child and granted one-time access to the condo to collect his belongings.
Sevastianov, speaking through an interpreter, told the judge, "We are tourists" and mentioned they had a flight scheduled for June 12th.
On Thursday, Sevastianov and his attorney learned that their hearing before a division judge for a final hearing for the state's motion pretrial detention will be held June 10.
Also on Thursday, a family court judge ruled on who would get temporary custody of the girl, and her sibling, while the legal process plays out.
During the hearing, the judge asked about the girl's safety along with that of her younger sibling. The judge then granted a shelter petition, allowing the two children stay with their mother while Sevastianov remains in jail.
Technically, the state has emergency custody of the children so that means she and the children can't travel.
Once the stay away order is lifted, Sevastianov will be allowed to have supervised visits twice a week.
The judge asked about their financial situation and whether he could afford a private attorney. Sevastianov informed the judge that they bring in $30 thousand a month with their business back in Russia.
Anonymous tip led to disturbing behavior
The investigation in Sevastianov began after an anonymous tipster urged authorities to review surveillance footage from the La Perla condominium at 16699 Collins Avenue.
"Basically, a 2-and-a-half-year-old child was manhandled, for lack of a better word, by her father. Her hair was pulled, her arm was yanked on, she was kicked, dropped, just things that you don't expect to see happen to a child, especially at the hands of someone that they trust most in the world, their father," Sunny Isles Beach Police spokesman Sgt. Brian Schnell said.
Surveillance footage shows series of violent acts
Video allegedly shows Sevastianov and his daughter initially in the pool area of the condo.
At one point, police say he wrapped a towel around her neck and appeared to tighten it. The girl is seen flailing her arms before he lets go, turns her toward him and slam her head into his shoulder.
"The defendant then begins to walk inside of the lobby, carrying the victim. As he was walking in the door, he drops the victim from chest height, and knees her on the way down as she hits the floor. The defendant then kicks her on the right side of her head," the arrest report states.
Authorities say Sevastianov dragged the girl by her hair as they moved toward the elevator where she collapsed.
"The defendant picks up the victim and violently shakes her causing her head to uncontrollably snap back and forth several times," according to the report.
While waiting for the elevator, he is seen wrapping her tightly in a towel as she kicks her legs.
"The defendant then backs into the wall slamming her into it, pinning her between the wall and his back. The defendant then whips her around to the front, letting her fall to the floor. The two then leave out of camera view," the report continues.
After reviewing the video, Sevastianov was taken into custody after a confrontation with officers in which he resisted arrest. The girl's mother took her to Joe DiMaggio Children's Hospital where doctors did not find any serious injuries.

Suspect planned to kill all in group he called 'Zionist,' but appeared to have second thoughts

BOULDER, Colo. — A man in Boulder disguised as a gardener who wounded 12 people in an attack on a group holding their weekly demonstration for the release of Israeli hostages in Gaza had planned to kill them all but appeared to have second thoughts, according to authorities. Mohamed Sabry Soliman had 18 Molotov cocktails but threw just two during Sunday's attack in which he yelled 'Free Palestine,' police said. He didn't carry out his full plan 'because he got scared and had never hurt anyone before,' police wrote in an affidavit.

Blake Lively pulling 'emotional distress' claims from Justin Baldoni lawsuit

Blake Lively is set to drop claims of emotional distress from her lawsuit against Justin Baldoni. In December, the actress sued co-star Baldoni for alleged sexual harassment on the set of the drama It Ends with Us, which he also directed. Lively also claimed the 41-year-old orchestrated a smear campaign against her around the film's release in August 2024. Baldoni, who has denied the allegations, filed a countersuit for alleged defamation and civil extortion against Lively, her husband Ryan Reynolds, and others. On Monday, editors at Variety reported Lively, 37, is seeking to withdraw her claims of "intentional infliction of emotional distress" and "negligent infliction of emotional distress" from her lawsuit. The update comes after Baldoni's lawyers noted in a filing that they had asked the former Gossip Girl star to sign a form giving them access to her therapy notes and medical records as part of discovery. "In other words, Ms. Lively wants to simultaneously: (a) refuse to disclose the information and documents needed to disprove that she suffered any emotional distress and/or that the Wayfarer Parties were the cause; and (b) maintain the right to re-file her IED Claims at an unknown time in this or some other court after the discovery window has closed," his lawyers wrote in court documents, according to the outlet. "By alleging that she suffered physical and emotional injuries, Ms. Lively has placed her physical and mental condition at issue and, in turn, must produce relevant information and documents (including) psychiatric records. In other words, Ms. Lively has waived any doctor-patient privilege." Representatives for Baldoni have not yet commented further. But responding to the news, Lively's lawyers insisted they were simply "streamlining and focusing" her case. "The Baldoni-Wayfarer strategy of filing retaliatory claims has exposed them to expansive new damages claims under California law, rendering certain of Ms. Lively's original claims no longer necessary," they said in a statement to Us Weekly, referring to Baldoni's Wayfarer Studios production company. "Ms. Lively continues to allege emotional distress, as part of numerous other claims in her lawsuit, such as sexual harassment and retaliation, and massive additional compensatory damages on all of her claims." The trial is slated to begin in March 2026.

Santa Rosa Police investigating late-night crash that injured teen

Santa Rosa Police said they are investigating a crash that injured a teen on Saturday night. The crash happened around 10:20 p.m. at the intersection of College Avenue and Beaver Street. Police said they received several 911 calls about the crash, and one of the calls was from the driver who told them the teen was still lying in the roadway. First responders found the unconscious teen on the westbound lanes of College Avenue. He was taken to a trauma center with life-threatening injuries and was later taken to a different Bay Area trauma center. The driver, whose identity police said they will not yet be releasing, stayed at the scene and cooperated. Police said she told officers that she was driving westbound on College Avenue and that she hit the teen when she got near the Beaver Street Intersection. She told officers that he had entered the roadway from the north side of College Avenue, police said. Neither alcohol nor drugs appeared to be a factor in the crash, according to police. Investigators are looking for surveillance video in the area and are trying to find out if the 14-year-old was in the crosswalk at the time of the crash. Police said the teen may have been with someone else at the time of the crash and was possibly riding a skateboard.
