SC fixes Nov 19-20 for final hearing on pleas against Talaq-e-Hasan
New Delhi, Aug 11 (PTI) The Supreme Court on Monday fixed November 19-20 for the final hearing of pleas seeking declaration of 'Talaq-e-Hasan" and all other forms of 'unilateral extrajudicial divorce" as unconstitutional.
Talaq-e-Hasan is a form of divorce among Muslims through which a man can dissolve the marriage by pronouncing the word 'talaq" once every month over a three-month period.
A bench of Justices Surya Kant and Joymalya Bagchi, while fixing the date for final hearing on a batch of pleas, including petitions by victims and other aggrieved parties, sought the views of National Commission for Women (NCW), National Human Rights Commission (NHRC) and National Commission for Protection of Child Rights (NCPCR).
When the bench enquired about Centre's view, its counsel Ashwini Kumar Upadhyay said it had not file any counter affidavit in the matter as such but given views in Triple Talaq case in which they have opposed all forms of 'unilateral extrajudicial divorce".
The top court allowed all the intervention applications and said they could assist the court in the hearing.
'If there is any material including some books or scriptures that may be produced. An opinion of the NCW, NHRC and NCPCR should be on record for proper assistance. We request ASG K M Nataraj to seek instructions and ensure that their opinions are brought on record," the bench said.
When one of the counsel appearing for opposing parties said there could be issues of maintainability and locus of petitioners challenging the Talaq-e-Hasan, the bench said the victims and aggrieved parties were before it and there couldn't be an issue over locus standi and maintainability as a result.
'We should not be worried about technicalities at this stage. There are individuals who are affected and are before this court. We will look into it," the bench said, adjourning the matter.
The apex court was hearing nine petitions, including the one filed by Ghaziabad resident Benazeer Heena, claiming to be aggrieved by Talaq-e-Hasan.
They have also sought a direction to the Centre to frame the guidelines for gender and religion-neutral and uniform grounds of divorce and procedure for all citizens.
The top court had previously impleaded husbands of the petitioners and sought their replies on the pleas.
On October 11, 2022, the top court admitted the pleas challenging the practice and all other forms of unilateral extrajudicial divorce and sought directions to declare them unconstitutional.
The top court in August, 2022 said its primary focus was to provide relief to women, who claimed to be victims of Talaq-e-Hasan, before deciding the constitutional validity of this form of divorce.
Under Talaq-e-Hasan, a divorce gets formalised after the third utterance of the word talaq in the third month if cohabitation has not resumed during this period.
However, if cohabitation resumes after the first or second utterance of talaq, the parties are assumed to have reconciled. PTI MNL MNL AMK AMK

India, Kazakhstan discuss ways to boost defence cooperation, military ties

'In a cordial and friendly atmosphere, both ministers discussed matters related to defence cooperation and defence industrial collaboration. India, Bangladesh DG-level border talks in Dhaka this month
Agency: PTI Last Updated: New Delhi, Aug 11 (PTI) India and Bangladesh are expected to hold their bi-annual border talks in Bangladesh this month-end. This will be the first time that the Indian delegation will travel to Dhaka post the fall of the Sheikh Hasina government last year. Talks are held between the Indian Border Security Force (BSF) and the Border Guard Bangladesh (BGB). A BGB delegation visited India in February for these talks. 'The 56th director general-level border talks between India and Bangladesh are expected to be held between August 25-28 at the BGB headquarters at Pilkhana in Dhaka. 'These talks were originally scheduled for July, but due to some administrative issues, they are now slated for this month," a source in the security establishment told PTI. A delegation led by BSF DG Daljit Singh Chawdhary will travel to Dhaka for these talks, the source said. BSF officials said a host of issues related to a variety of cross-border crimes along the 4,096 km long international front will be discussed during this meeting. The BSF is expected to take up the issue of illegal infiltration. It will also inform the BGB that it has provided about 5,000 body-worn cameras to its troops on this border so that the evidence of attacks on the force's personnel by miscreants and other such activities on the border can be recorded and a 'strong" action be launched, the officials said. They, however, said the talks were not expected to draw any concrete policy steps as Bangladesh currently has an interim government. Muhammad Yunus, the chief adviser of the interim government in Bangladesh, announced last week that general elections would be held in the country in February 2026. The announcement coincided with the first anniversary of the ouster of Sheikh Hasina's Awami League regime on August 5. The two border forces, during the talks held in Delhi in February, decided to establish a new communication link between the second-in-command rank officers (additional director general) and had identified about 99 fresh patches for erecting a fence along the shared borders. A total of 864.48 km of this front remains unfenced, including 174.51 km of 'non-feasible" gap, according to official data. The DG-level border talks were held annually between 1975 and 1992, but they were made bi-annual in 1993, with either side alternatively travelling to the national capitals of New Delhi and Dhaka. The India-Bangladesh border spans across five states — West Bengal (2,217 km), Tripura (856 km), Meghalaya (443 km), Assam (262 km) and Mizoram (318 km). The BSF is designated as the lead security and intelligence-gathering agency for this front. Locals cry foul over proliferation of slaughterhouses in Haryana's Nuh
Seven slaughterhouses are operational in Haryana's Nuh, with the maximum five situated in the district's Nagina block. Another two dozen are likely to be set up soon with the land having been purchased and their buildings under construction, making Nuh the hub of slaugtherhouses. Though these slaughterhouses have created job opportunities for the youth in this Meo Muslim-dominated district, one of India's most backward areas, the locals are now gradually turning against these for more than one reasons. Accusing the slaughterhouses of functioning in violation of the environmental norms leading to groundwater contamination and unpleasant odour, the locals argue that the abattoirs are also a source of pest infestation, which has led to fears of outbreak of diseases in a region already grappling with sanitation issues. Cutting across party lines, the leaders from various political outfits, including the ruling Bharatiya Janata Party and the Congress, along with social activists and sarpanches convened a meeting in Nuh's grains market on August 1 raising their voice against the growing number of abattoirs. BJP leader and former Minister Azad Mohammad said that the slaughterhouses were a major issue for the Ferozepur Jhirka Assembly constituency because of their growing numbers. He stressed that despite being a member of the ruling party, he opposed these as they have polluted the region's air and become a breeding ground for pests. The gathering also submitted a memorandum to the local administration for the Chief Minister, Home Minister and the Prime Minister. Mewat RTI Manch convenor Rajuddin Meo, who has been actively involved in the protests, said the slaughterhouses relocated from Uttar Pradesh were gradually shifting their base to Nuh. 'As many owners of these slaughterhouses are Muslims, they find Nuh a safe destination to set up their business. Also, the land in Nuh is the cheapest in the National Capital Region, with the latest circle rate of around ₹25 lakh per acre,' said Mr. Rajuddin. He added that the locals want a ban on more licences to slaughterhouses in the region already battling water scarcity. He said many are being set up within a few meters of the village abadi area, causing inconvenience to the residents. Regional Officer, Haryana State Pollution Control Board, Nuh, Akansha Tanwar told The Hindu that eight abattoirs were granted 'Consent to Operate', but only seven were functioning and 23 more were already granted the 'Consent to Establish' and were under construction. She added no new 'No Objection Certificates' were granted during her tenure, but six NOCs were granted in 2023. 'There are no specific parameters for setting up abattoirs to determine their optimal location. After the opposition, we are now planning to frame siting parameters to fix their distance from village abadi, schools and highways. Also, inspections would soon be conducted to ensure that they adhere to all norms,' said Ms. Tanwar.
