Rethinking social and labour plans: from compliance to transformational community development

The consequences of climate change amplify vulnerabilities in communities, placing additional stresses on water availability, agricultural productivity, health outcomes, and infrastructure resilience, such as roads and housing susceptibility to severe weather conditions.
Too often, when the disaster or distress hits, communities turn to mining companies to provide services and infrastructure.
Despite this reality, there remains a disconnect between intention, impact, and outcomes in these interventions.
Mining is on the cusp of a once-in-a-generation investment boom.
The global population is approaching 10 billion people, and many parts of the world, including us, are pursuing a net zero economy towards 2050 and beyond.
With an estimated $100 billion in additional capital investment in the resources sector required each year to meet the demand outlook associated with urbanisation and the decarbonisation of the global energy system, sizeable increases in material production and infrastructure are also necessary.

For emerging economies, there is a narrow window of opportunity to seize now.
Such growing demand brings an opportunity to benefit communities, countries and investors committed to enabling and facilitating the mining and investment activities needed to meet our needs, such as skills-to-employment ecosystem, generating local value addition and create revenue flows capable of decarbonized economic development.
South Africa's mining sector is a significant driver of economic growth and critical for the socio-economic transformation of our society.
Central to this transformation agenda are Social and Labour Plans (SLPs), elements of the mining licensing regime which were introduced through the Mineral and Petroleum Resources Development Act, 2002 to ensure mining contributes to sustainable community development.
SLPs were conceived as strategic tools to promote socio-economic development, stimulate and broaden economic opportunities, and enhance skills development to support the creation of sustainable communities during and after mining.
However, nearly two decades after their inception, the question remains: Have SLPs truly driven sustainable, transformative change within mining-affected communities
This ongoing struggle reveals a fundamental disconnect between the institutional understanding of challenges within communities and the intended goals and actual community-level outcomes, raising the question of why there is this persistent gap and what are the possible solutions.
Despite the significant resources mining companies have committed under SLPs, informed by local integrated development plans (IDPs), tangible and sustained improvements in the quality of life and long-term socio-economic resilience remains elusive.
A significant contributing factor is the prevailing and compliance-driven mindset underpinning SLP implementation, amongst mining companies, regulator and beneficiaries.
Too often, SLPs, being regulatory obligations, are limited from being approached as strategic investments for genuine socio-economic empowerment and, in today's terms, transforming communities in response to climate change and commence the just transition journey.
As it stands, the law ringfences SLPs to individual mining rights, leading to less effective deployment of resources for joint projects which would deliver greater impact and minimise duplications.
Such an approach frequently leaves underlying structural challenges unaddressed.
For example, projects may initially improve conditions but deteriorate without municipal long-term planning, community stewardship, financial constraints and skills shortages to adequately sustain them.
Under such a compliance framework, companies prioritise with local government , short-term deliverables—such as building municipal and district roads, donating to local charities, a clinic here and school classroom there, or sponsoring temporary initiatives—over comprehensive, sustained, and systemic socio-economic transformation projects.
This situation ultimately limits the durability and scale of impacts, leading communities to cycle back into dependency and vulnerability. Even though, not directly affected by the SLP, lessons from the decommission of power stations, and associated mine closures in areas like Komati has brought this reality to the fore.
Recently mining companies have been trying to pool their SLP projects with amendments to legislation also being advocated.
The overarching idea is to bring the benefits of mining to communities through collaboration. But this is not often the case, as some IDPs do not exhibit the essential elements of integration along a clear developmental trajectory -resulting in sub-optimal developmental outcomes, leading to mistrust and finger-pointing.
Whereas mining companies correctly complain of the failure of government in creating an enabling environment for development, host communities often bear the brunt of such failures, including poor service delivery and ineffective local economic development.
A further complication is the apparent inadequacy of meaningful community engagement during IDP and SLP formulation.
Inadequate measurement of actual impacts exacerbates the problem. Without robust metrics to measure true progress—such as improvements in health and education outcomes or enhanced local economic development—SLPs risk remaining exercises in compliance rather than vehicles for genuine and sustained socio-economic development.
Furthermore, what is necessary to maximise this developmental impact through increased collaboration not just among mining companies within a municipality, but also with entities in other economic sectors. An appropriate legislative frameworks to guide collaboration between all economic players operating in the same mining region is urgently required.
Mining companies, together with other economic players, government, communities and other stakeholders involved can reorient SLPs away from transactional, fragmented efforts towards comprehensive, integrated, and strategic frameworks.
By doing so, SLPs can effectively contribute to the fulfilment of the developmental objective by serving as powerful catalysts for inclusive and enduring transformation in the communities that host South Africa's critical mining operations.

The impact of Trump's tariffs on South Africa's sugar industry and jobs
The South African sugar industry is facing the threat of collapsing and job losses as a result of US President Donald Trump imposing 30% tariffs on the country's exports. Image: Karen Sandison / Independent Newspapers Stress is weighing on farmers as they anticipate losing millions of rand through 30% tariffs, which US President Donald Trump imposed on South African companies generating profit from exporting to the United States of America. Despite President Cyril Ramaphosa's ongoing efforts to talk to Trump to go easy on the local exporters, the fear was that the US would not back down. The US tariffs against many countries around the world came into full swing after midnight on Friday, leaving a chilling fear that this might collapse the South African industries. SA Farmers Development Association (SAFDA) Executive Chairman Dr Siyabonga Madlala is concerned that while businesses have no power over politically influenced tariffs, they are the ones that will bear the brunt. Although it was still early to see how much damage the tariffs would inflict on the local businesses, Madlala anticipated a loss of millions of rand, a situation that would result in alarming job losses. His concern was that the sugar industry, which falls under the South African Sugar Association (SASA), was producing far more than enough for local and foreign producers, and with the tariffs, a lot might go to waste. 'America, through AGOA (African Growth and Opportunity Act), has given us a lucrative market for some 24,000 tons of sugar exports, so with the imposition of tariffs, our sugar won't be attractive to our US consumers as it is now becoming expensive. 'It forces US consumers to look for alternatives rather than buying from us because our sugar becomes 30% more expensive,' said Madlala. South African competitors in supplying the US with sugar are Mexico, Brazil, Australia, and several Central American and Caribbean nations. Madlala said that while the local sugar industry produces 1.5 million tons for local consumers, another 500,000 tons are sent to the foreign market, which is also supplied by its local producers and other countries. He estimated that, through the tariffs, SASA loses R168 million from its annual revenue. He said the sugar market, through the government, will have to find an alternative market for the 24,000 tons that would not be viable to send to the US. According to Madlala, the US market, which found South African sugar affordable under the AGOA agreement, may look for alternative countries to buy from. 'The reason is that lots of other countries are subsidised, therefore they can afford to sell sugar than us, as we are not subsidised but working on our own. 'With this imposition of tariffs, we will lose 24,000 tons, which will have to go to the dumping market, meaning that we are losing half of the profit we are receiving from the sale of the sugar,' said Madlala. He said reducing production would cause job losses and the closure of sugar mills. 'Once you try to lower the production, it means some farms will shut down or diversify. By that, it means that sugar mills will lose sugar cane supply, which is the lifeblood of the sugar mill,' he said. He said the tariffs came at the wrong time when most of the sugar mills were being revived through the Trade and Industry's master plan and when some sugar mills, including Tongaat Hulett, were making their way out of business rescue. 'Those mills are starved for sugar cane, so we cannot lower production; in fact, we need to grow production. Unfortunately, Trump's tariff is coming at a time when the industry is being revived. While we are appreciating the initiative of the master plan, we are now bombarded with the tariffs,' said Madlala. Influential organisations such as FW De Klerk Foundation recently called for the country to expand its trade partners rather than relying on the US. Agriculture Minister John Steenhuisen said the government was also reaching out to other countries. However, Madlala said finding an alternative market was not easy to do overnight. National Association of Automotive Component and Allied Manufacturers (NAACAM) Chief Executive Officer Renai Moothilal told the media that the automotive industry was already feeling the effects of the tariffs, as some US companies that contract with the local industry were starting to fall away. 'We are already seeing new contracts, especially for the US, being cancelled or not pursued, putting one of the country's most critical manufacturing sectors at risk,' Moothilal said. Build One SA (BOSA) described the tariffs as 'a serious escalation in trade tensions between SA and the US', which are threatening thousands of jobs in automotive manufacturing, agriculture, and mining. In a statement, the party called on Ramaphosa to be frank with the US political leadership in trying to revive the AGOA agreement.

So tense were the discussions that officials sometimes had sleepless nights working to secure a deal, while the government tried to keep the news under wraps to avoid jeopardising the talks. 'Yes, there has been huge pressure and last-minute talks to try to convince the US government to at least cut the tariffs to 15%, but that is a matter the department would have to confirm with you at a later stage if it succeeds. 'Our government has been working on it, but I can tell you now it does not look good because discussions have started late despite the president having indicated that they have made efforts to reach Trump,' the source said. With a 30% tariff expected to be imposed on South African goods by the US at midnight on Thursday, negotiations were still taking place between the two countries regarding the proposed tariffs. President Cyril Ramaphosa confirmed that he spoke with Trump on Wednesday. Presidency spokesperson Vincent Magwenya said the two agreed to continue further engagements on bilateral trade matters. Political analyst Ntsikelelo Breakfast believes the government was wasting its time as Trump was unlikely to listen or be sympathetic. 'The EU has just signed (an agreement on higher tariffs) and who are we to think we can win if they sign. We are in trouble and Trump is not going to forgive us for taking Israel to the International Court of Justice. 'An attack on Israel is an attack on the US. Even Ramaphosa is wasting his time', said Breakfast. Another political analyst, Sethulego Matebesi, said Trump was likely to do what he did during the Oval meeting with Ramaphosa in May.

This comes as the US President Donald Trump imposed a 30% tariff on South African imports, which are anticipated to have a profound impact on critical sectors of the South African economy, particularly the automotive and agriculture industries. President Cyril Ramaphosa and Trump held a telephone discussion on bilateral trade matters with Trump on Wednesday morning, undertaking to continue with further engagements recognizing the various trade negotiations the US was currently involved in. Minister in The Presidency, Khumbudzo Ntshavheni, said on Thursday that the Cabinet received an update regarding the Framework Deal established with the US, which aims to create a foundation for ongoing discussions. A notable aspect of this agreement is a provision that stipulates tariffs will be reconsidered once the two nations reach a comprehensive deal. 'Government's efforts remain focused on growing the economy to save and create new jobs, which include intensifying diversification efforts and strengthen their global supply chain integration as the country works to expand its export markets to Asia, Europe, the Middle East, and across Africa to enhance our economic resilience,' Ntshavheni said. Meanwhile, Ntshavheni said the government was focusing on demand side interventions in the impacted industries and targeted interventions to ensure industry stability and safeguard employment. The implementation of the tariffs has raised concerns among South African businesses that rely on exports to the US market, as increased costs could lead to reduced competitiveness. The government this week warned that about 30 000 jobs in various sectors were likely to be impacted by the unilateral 30% import tariffs, hence it is seeking to craft an export diversification strategy leaning heavily towards China's R20 billion market. Ben Farrell, global CEO of the Chartered Institute for Procurement and Supply (CIPS), urged African nations to step forward as leaders in the next era of global supply chains. Farrell issued a warning against protectionist policies and blasted the US tariffs. 'The most popular vehicle in America is the Ford F150 – 45% of its parts are made outside America. Some of them here in Africa. Now these manufacturers are about to see a 35% increase in costs because of tariffs,' he said. 'Consider the implications of this unilateral national action against global suppliers. It's insanity. The stars have aligned for procurement and supply around the world, and particularly here in Africa.' The US is South Africa's third-largest bilateral trading partner after China and the European Union. South Africa's exports to the US account for about 7.5% of the country's total exports, and in turn the largest category of SA's exports to the US are precious metals, at 36% of total exports to the US, which are mainly tariff exempt. The second largest category is vehicles, aircraft and vessels at 20% of total exports to the US, and the third, products of iron and steel at 14%. Mineral products follow next, at 6.8% and chemicals at 6.7%. Investec chief economist, Annabel Bishop, said there were many different issues at play for South Africa in terms of trade balance as the country was running a surplus. 'We could be running a bigger trade surplus if we'd managed to repair the problems we have in Transnet. So there's still an opportunity for us to improve,' Bishop said. 'But I do think an important point is that around the world there's very fierce competition on trade. There's a lot of focus on price. And of course, what this differentiated tariff structure does is now make some countries more competitive than others. And South Africa, 30%, instead of the 15%, which most African countries are, is therefore prejudiced.' Bishop also warned of direct implications of these tariffs on the consumer inflation. She said though the full tariff effect has not come through and was only going to be apparent towards the end of this year, there was an expectation that US economic growth will dip in the medium term as importers absorb the rising costs of imported products. 'But also, while it's not to forget that there could be a double whammy effect. If inflation comes out higher and, of course, remains persistent, then you also start to worry about going to higher interest rate territory,' Bishop said. 'Then has a secondary negative impact on consumers. At the moment, we don't think that's the case. We think the tariff impact is going to be once-off, if it is indeed a once-off tariff situation. 'Then the monetary policy authorities can look through that and say, 'OK, we won't move our interest rates yet'. But it becomes more entrenched, and this is the problem with uncertainty. If tariffs fluctuate, if they move around, you're always at a moving target. You never really know where you are.' BUSINESS REPORT
