Shafee asked by AG to show cause over ‘Nazi hearing' claim

PETALING JAYA: The attorney-general (AG) has asked lawyer Shafee Abdullah to show cause why committal proceedings should not be brought against him over his description of a court proceeding as 'a Nazi-Germany kind of hearing'. In a letter dated June 23 and handed personally to Shafee, the AG sought a reply from him within seven days. 'If you do not provide a satisfactory explanation within seven days from the date of this notice, criminal prosecution will be initiated against you,' the letter, sighted by FMT, read. The letter was signed by deputy public prosecutor Saiful Edris Zainuddin on behalf of AG Dusuki Mokhtar and sent pursuant to Order 52, Rule 2B of the Rules of Court 2012. The provision states that any formal notice to show cause why a person should not be committed to prison or fined must be served personally. The letter claimed that Shafee, who acts for ex-prime minister Najib Razak in his ongoing criminal charges and civil suits, made the remark during a press conference on May 29, which was live-streamed via Najib's Facebook page. The letter alleged that the words spoken as a whole could undermine public confidence and interfere in the administration of justice. Malaysiakini last month reported Shafee's criticism of a court order to temporarily stop all proceedings linked to Najib's royal addendum, during which the lawyer allegedly compared the decision to 'a Nazi-Germany kind of hearing'. Shafee clarified to the media that the remark was made during an exchange with a reporter and was intended to educate the public, not undermine the judiciary. He also said the remark was made solely in the context of explaining the meaning and essence of a 'judicial decision'. Najib has obtained leave from the Court of Appeal to begin judicial review proceedings to enforce a royal decree which allows him to serve the remainder of his jail sentence under house arrest. Zaid, partners appeal dismissal of libel suit against ex-Bar president
Zaid Ibrahim, Liew Teck Huat, and Rueben Mathiavaranam are appealing against the High Court's dismissal of their lawsuit against the Malaysian Bar and ex-president Karen Cheah for libel, breach of statutory duty, and conspiracy to injure. PETALING JAYA : Former law minister Zaid Ibrahim and two others have filed an appeal to overturn a High Court decision dismissing their libel suit against the Malaysian Bar and its former president over statements concerning their conduct in Najib Razak's final SRC International appeal. Lawyers Liew Teck Huat and Rueben Mathiavaranam, the co-appellants, confirmed that the notice of appeal was filed well ahead of its 30-day deadline. The appeal is from a ruling delivered by Justice Roz Mawar Rozain on May 29. 'We are now preparing the memorandum of appeal for the Court of Appeal to state where the trial judge erred. It will be filed by Aug 28,' Mathiavaranam told FMT. Roz Mawar said Zaid, now in legal practice, Liew and Mathiavaranam had failed to prove on a balance of probabilities that they were defamed in a media statement issued by then Bar president Karen Cheah. The judge also dismissed the trio's claims for conspiracy to injure and breach of statutory duty under the Legal Profession Act 1976. The suit was filed on Sept 30, 2022 over Cheah's statement titled 'Abuse of process brings disrepute to our justice system'. The plaintiffs contended that Cheah's remarks implied that the three lawyers had 'undermined the justice system through unscrupulous strategies'. The statement, published on Aug 19, 2022, was carried by several media organisations on the same day. The plaintiffs alleged that the words in the press statement were calculated to 'disparage, besmirch and damn' them in their professional capacities as advocates and solicitors. Najib appointed Zaid's law firm on July 25, 2022 to replace Shafee & Co as solicitors in his final SRC International criminal appeal before the Federal Court. Hisyam Teh Poh Teik was named lead counsel, replacing Shafee Abdullah. Roz Mawar agreed that the media statement had identified the plaintiffs and was published as alleged. However, she said the words, in their natural and ordinary meaning, were not defamatory of the plaintiffs. The judge said the plaintiffs themselves had, before the publication, made multiple public disclosures, including press interviews, social media postings, and commentaries. Roz Mawar said the court also found no evidence to support the plaintiffs' claim of conspiracy to injure and breach of statutory duty.

Student's murder in Cyberjaya: Three individuals arrested to assist investigation

Sepang police chief ACP Norhizam Bahaman said the three individuals, aged 19 to 20, were arrested in Johor Bahru, Johor, and Gemencheh, in Negeri Sembilan, within 48 hours after police received a report on the incident. "They are believed to be known to the victim," he said in a statement today. The police have applied for an order at the Sepang Sessions Court to remand them to facilitate investigation under Section 302 of the Penal Code. The public is advised not to speculate or share false information that could interfere with the police investigation. Meanwhile, the three suspects have been remanded for seven days starting today. 5 girls flung out of Vellfire in PLUS highway crash, 1 dead
The Vellfire is believed to have spun out of control after one of its tyres burst, crashing into the divider and coming to a halt on the emergency lane. (Malaysian Highway Authority pic) PETALING JAYA : A 13-year-old girl was killed after being flung out of a Toyota Vellfire which crashed at KM189.1 south-bound of the North-South Expressway (PLUS) this morning. The Malaysian Highway Authority's traffic management centre said four other children were also flung out of the vehicle in the crash which occurred at 7.54am. One of them was seriously injured while the other three sustained minor injuries. The vehicle travelling from Ayer Keroh to Jasin is believed to have spun out of control after one of its tyres burst. It then crashed into the road divider before coming to a halt on the emergency lane. 'The accident caused a female passenger to be thrown out onto the north-bound left lane of the highway. She was pronounced dead at the scene by paramedics,' the centre said, according to Sinar Harian. It added that the crash caused traffic congestion on the PLUS highway, stretching 7.4km northbound and 9.3km southbound.
