HC closes plea by TN assembly Speaker to clean high-level water supply channel in Tirunelveli

Madurai: The state govt informed the
Madras high court
that the work of cleaning the high-level water supply channel formed between Alanthurai aaru and Suravali odai anai, situated in the reserve forest area in the Western Ghats in Radhapuram taluk in
Tirunelveli
district, has been completed. Following this, the court recently closed a plea filed in 2019 by M Appavu (presently
Tamil Nadu Assembly Speaker
).
The petitioner stated that the Western Ghats is the birthplace of many small rivers, and one of these rivers is Kalisamban odai, which reaches Alanthurai aaru. He stated that Alanthurai flows through Kanyakumari district.
Most of the perennial water was used by the people of Kanyakumari district for agricultural purposes, a scheme was formulated by the state govt in 1969 for the usage of water from Kalisamban. A small dam was constructed at Alanthurai with the objective to distribute water 60% to Tirunelveli and 40% to Kanyakumari districts, respectively.
He stated that later, a high-level supply channel was formed between Alanthurai and Suravali, through which water would flow to eight ponds in Kavalkinaru village and 48 ponds in Panagudi village, benefiting nearly 2,000 acres of agricultural land in Tirunelveli district. The high-level water channel was filled with stones and boulders, preventing the free flow of water. Hence, he moved the court seeking a direction to the authorities to clean the channel.

A division bench of justice G R Swaminathan and justice B Pugalendhi took note of the status report filed by the authorities in Nov 2019, stating that the works were already successfully completed. The court was of the view that nothing survives for further adjudication, the judges observed, and closed the petition.

Kochi: Kerala high court has extended its earlier order deferring the implementation of an office order issued by Lakshadweep administration, which sought to remove Arabic and Mahl languages from the school curriculum in the Union Territory, until the disposal of the petition challenging it. Observing that there was no material to show the office order was issued following any study or stakeholder consultation, the court emphasised the deep cultural significance of language and cautioned that changes could have serious ramifications. The bench comprising Chief Justice Nitin Jamdar and Justice Basant Balaji was hearing a public interest litigation (PIL) filed by P I Ajas Akber, a resident of Kalpeni Island, challenging the office order dated May 14, issued by the director of education, Union Territory of Lakshadweep. The order pertained to the implementation of the three-language formula (TLF) from Class I, excluding Mahl and Arabic as optional subjects. Accordingly, the court directed that the existing position with respect to CBSE and non-CBSE schools in Lakshadweep shall continue. Additionally, the court clarified that the Union Territory is free to study local conditions within the framework of prevailing education policies and to engage all stakeholders through a meaningful process of consultation, not merely as a formality. If such studies and consultations are undertaken, the respondents may seek appropriate orders, the court said.

1 2 3 Kolkata: The Kolkata Municipal Corporation (KMC) and cops on Tuesday started a drive, for the first time this year, to oust pavement dwellers from several prime city areas but faced stiff resistance and called off the drive. Though the civic officials and cops during the special drive seized belongings of around 200 pavement dwellers, the civic officials finally convinced only five such dwellers to go to the KMC-run shelter house. According to plans, three different KMC teams started the drive from three locations: Park Circus-Beckbagan zone, Ballygunge-Gariahat zone, and Hazra-Alipore zone. When the civic officials and cops reached the Park Circus-Beckbagan belt and asked the pavement dwellers to move out of the approach road to AJC Bose Road, they fled. The civic officials seized their belongings and moved forward. When the cops and civic officials were busy playing a cat-and-mouse game in the Park Circus area, the second team in the Gariahat area faced real trouble as the pavement dwellers under the flyover turned violent. The cops present in large numbers helped the civic officials in removing their belongings. Later, the KMC brass sent officials from its social welfare department and roped in a couple of NGOs that work among the homeless to conduct counselling so that the defiant pavement dwellers accept the civic proposal and leave the space. "We gave strict instructions to our officials and the cops not to do bodily damage to any of the pavement dwellers even if they don't fall in line. We have sought help from two NGOs who have experience in handling such issues. We hope this will yield some sort of results," said a senior civic official. However, the KMC brass has asked the cops to keep a constant vigil on the pavement dwellers and get ready for fresh drives in the coming weeks. According to a KMC source, the civic body planned a major drive to remove pavement dwellers after receiving frequent calls from across the city complaining about illegal encroachment of roads and spaces under flyovers. "We planned to conduct a raid only to clear roads and civic infrastructures. The complainants also expressed their apprehensions about the law-and-order situation at night. But we don't want the pavement dwellers to be deprived of their right to shelter. We have kept several shelter homes ready for them," said a KMC official. According to a KMC social welfare department official, the department runs seven such shelter homes across the city. Sources said the civic body planned to accommodate pavement dwellers from the Gariahat-Ballygunge zone at the Kalighat shelter home and dwellers from Park Circus-Beckbagan at a Beleghata shelter home.
