Mumbai: India's federal anti-money laundering agency, the Enforcement Directorate, has issued summons to senior counsel Arvind Datar over his legal advice to Care Health Insurance on the controversial Esops (employee stock ownership) issued to former Religare Enterprises chairperson Rashmi Saluja. Religare holds a 62.98% stake in Care.Sources said the agency may also question former Irdai (Insurance Regulatory and Development Authority) chairman Hari Narayan, who also provided a legal opinion on the ESOP issue.Saluja was forced to step down from Religare Enterprises-Care Health's parent-in February, after shareholders blocked her board re-appointment, ending an 18-month tumultuous legal battle against the Burman family-the biggest shareholders of Religare. Thereafter, the Burman family that runs Dabur officially took control of Religare as its new promoter.Datar, who has represented Sebi in high-profile cases like the Sahara fundraising case, is said to have told ED officials that lawyers cannot be summoned for investigations involving their clients. According to sources, he also told them that lawyers are also prohibited from disclosing legal advice given to their clients because of professional privilege.Queries sent to Datar and Care in connection to this remained unanswered until press time.In 2019, Care appointed Saluja as its non-executive chairperson. Two years later, it sought approval from Irdai to grant her Esops. In May 2022, Irdai rejected the plan on the grounds that Saluja's role as non-executive chairperson was similar to that of a non-executive director and that her remuneration should match such a role.Care then sought opinions from Datar and Narayan. Both of them advised the company that it could issue Esops because Saluja was an employee of Religare and held the position of executive chairperson. Giving her Esops as a non-executive chair of Care was not allowed.Based on this, Care allotted her 22,700,000 Esops. A securities lawyer explained that Esops can be given to both executive and non-executive directors if they are employees and not promoters. He added that Sebi rules consider non-executive directors as employees for the purpose of Esops.In 2024, Irdai directed Care to buy back 7,569,000 shares given to Saluja at the same price paid for them (that is ₹45.32 per share) for violating its rules. The regulator also ordered the cancellation of all unused Esops.Saluja made headlines for opposing the Burmans attempting to gain control of the financial services company.

Jaipur/Jhunjhunu: The Enforcement Directorate (ED) conducted massive raids across Rajasthan and Gujarat on Thursday in connection with an alleged Rs 2,700 crore money laundering scheme linked to the Nexa Evergreen project. The operation, spanning 24 locations, targeted what authorities describe as a massive real estate fraud that affected approximately 62,000 investors. Till the evening ED has seized almost Rs 2 crores and 3 lakhs and have freezed around 10 bank accounts. The raids, supported by CRPF and local police, were carried out in multiple cities including Sikar, Jaipur, Jodhpur and Jhunjhunu in Rajasthan and Ahmedabad in Gujarat. The ED's investigation stems from multiple FIRs filed with the Rajasthan Police regarding the fraudulent scheme. According to ED officials, the company, registered in Ahmedabad in April 2021, allegedly lured investors with promises of affordable housing and land plots in Gujarat's Dholera Smart City Project. The primary accused, Subhash and Ranveer Bijarniya from Panlawa in Sikar district, specifically targeted govt employees, including police and armed forces personnel, promising high returns on investments. "While some initial investors received property possession, the scheme was later exposed as fraudulent, leaving most investors without recourse," said a senior ED officer in Jaipur. The agency has seized incriminating documents, bank account details, electronic devices and property papers during the raids. "So far we have seized Rs 2 crores and 3 lakhs and have also freezed around 10 bank accounts," said an officer. The scam, which affected around 62,000 people, has already led to hundreds of FIRs across different districts and multiple protests by victims. Both main accused, Ranveer and Subhash Bijarnia, were previously arrested in connection with the case. The ED's investigation continues, with officials stating this is their first major operation since registering the case in early 2024. The agency also raided the premises of Salim Khan, another accused who operated a Nexa Evergreen office in Jhunjhunu's KK Colony, allegedly to attract more investors to the scheme. While the ED has confirmed seizing significant evidence, specific details of the recoveries are yet to be disclosed as the investigation remains ongoing. My client would like to bring the true facts to your attention and would like to state unequivocally that such media reports are completely untrue."Vadra has complied with all the ED summons, demands for information and documentation for the last ten years. He has repeatedly affirmed and demonstrated his full cooperation with the authorities and will continue his full cooperation as a law-abiding citizen of India," Khaitan said in a said Vadra received a summons to appear before the ED on June 10 in respect of a case in which he has already appeared before the agency on multiple occasions dating back to 2019 when he also filed voluminous documents."On 09.06.2025, he came down with flu-like symptoms and was advised to take a COVID-19 test . This is in keeping with the current practice being followed by many institutions including the PMO. Consequently, he informed the ED that he would not be able to attend proceedings in person on 10.06.2025."He also informed the ED that as a law-abiding citizen who is keen on clearing his name, he is happy to attend the proceedings in person as soon as he is medically cleared to do so. He also volunteered to attend proceedings virtually if the ED thought it necessary to carry them out immediately," Vadra's lawyer lawyer said Vadra is scheduled to travel abroad later this month to attend his daughter's college graduation ceremony."He (Vadra) is perfectly happy to attend proceedings at any other time before or after the trip just as he has already done several times," his counsel also claimed that he has also recently submitted voluminous documents and answered all the questions asked by ED in the past."Any attempt to suggest that Mr. Vadra's attendance of his daughter's graduation ceremony is some sort of ruse to avoid attending any proceedings is completely untrue, unacceptable and without any basis in fact. This is especially clear from the fact that all foreign travels by Mr. Vadra, are always with prior notice to and knowledge of ED and with the prior permission of the Court."It is a matter of record with ED that Mr. Vadra has regularly and repeatedly appeared before the ED whenever summoned and there is no basis or reason to even think that Mr Vadra will ever try to give any untrue reason while asking for time to appear before ED," his lawyer sources said Vadra had sought an adjournment of Tuesday's summons, and he will now be given a fresh date. The ED wants to record Vadra's statement under the Prevention of Money Laundering Act (PMLA) and then file a charge sheet against him before the court, sources federal probe agency had questioned the 56-year-old businessman for three consecutive days in April in a separate money laundering case linked to alleged irregularities in a 2008 land deal in (63) fled to London in 2016, soon after the Income Tax Department raided him in Delhi.A UK court earlier this month refused an application filed by the Indian government seeking permission to appeal in Britain's Supreme Court against the discharge of Bhandari in an extradition case, virtually ruling out chances of him being brought to the country to face the ED filed a charge sheet in this case in 2023, alleging that Bhandari acquired the 12, Bryanston Square house in London in 2009 and got it renovated "as per the directions of Robert Vadra, who provided the funds for the renovation".Vadra has denied that he owns any London property directly or the charges a "political witch hunt", Vadra has said he is being "hounded and harassed" to subserve political ends.

New Delhi [India], June 12 (ANI): Advocate Suman Jyoti Khaitan, counsel for businessman Robert Vadra, on Tuesday addressed the media through a virtual press conference to clarify his client's absence from the Enforcement Directorate (ED) appearance in a money laundering case. Khaitan, speaking via Zoom, said recent media reports wrongly implied that Vadra was evading ED summons. 'These reports are misleading. Vadra developed flu-like symptoms and was advised to undergo a COVID-19 test, which he has taken. He is following all necessary health precautions,' Khaitan stated. Reaffirming Vadra's cooperation with the investigation, Khaitan said, 'He has willingly offered to join the probe through virtual mode and has previously submitted voluminous documentation to the ED.' The lawyer further stated that Vadra's prior appearances, including a three-day questioning in April in a separate money laundering case linked to a 2008 Haryana land deal. Khaitan also disclosed that Vadra plans to travel abroad later this month to attend his daughter's graduation ceremony, but remains open to participating in the ED probe either before or after the trip. Vadra, the husband of Congress MP Priyanka Gandhi Vadra, was summoned by the ED recently in connection with a case involving UK-based arms dealer Sanjay Bhandari. Sources said Vadra sought a deferment of the summons and will be given a new date for recording his statement under the Prevention of Money Laundering Act (PMLA). In 2023, the ED filed a chargesheet alleging that Bhandari purchased and renovated a property at 12, Bryanston Square, London, on Vadra's instructions and with his financial support--an allegation Vadra strongly denies. He has dismissed the case as a 'political witch hunt' aimed at 'harassing him for political reasons.'
