
Activist opposes Bandra Reclamation project, says MSRDC can't act as private landholder
The rejoinder contended that the 24 acres were part of a 57-acre plot which comes under the Coastal Regulation Zone (CRZ) and thus, cannot be exploited for commercial use. The MSRDC cannot act as a private landowner as the land came into being for the purpose of the Bandra Worli Sea Link – a public project, it said. The original petition, filed in April 2024, was also in force to restrain the MSRDC and other respondents from using the plot in a manner that was legally impermissible and contrary to public interest, the rejoinder stated.
The rejoinder was necessitated as the Adani group firm that won the bid to develop the plot had claimed in court that the land belonged to the MSRDC and the corporation had allowed its commercial exploitation. The MSRDC too had contended that a writ directing it to use the land in a particular way was not maintainable as the land no longer fell within the CRZ area.
The prime land parcel located along the Bandra Worli Sea Link approach road faces the Mahim Bay and is valued at an estimated ₹ 30,000 crore. It currently houses a casting yard and the MSRDC office, and it has been allocated for commercial and residential use as per the Development Control and Promotion Regulations, 2034.
In the detailed affidavit submitted on Tuesday, Bhathena disputed claims in the tender for commercial development of the plot, which said the project area was confined to 24 acres of land 'freely available for development'. The 24 acres were part of the 57-acre plot which Bathena's original petition had mentioned, and commercial exploitation of even the 24 acres was not allowed as the entire plot was located in the CRZ area where such development was prohibited, the affidavit said.
Bathena claimed that the land was previously owned by the state government and it was vested with the MSRDC via an order dated January 30, 2018. Several conditions were imposed on MSRDC when the land was transferred, including obtaining prior approvals for any development on the plot from the Maharashtra Coastal Zone Management Authority (MCZMA) and the Ministry of Environment and Forests (MOEF).
'By seeking to restrain MSRDC from acting contrary to the conditions, which were clearly intended for public benefit and which are now brazenly being breached by MSRDC, I merely seek to enforce against MSRDC covenants on the basis of which the land was granted to it,' Bhathena submitted in court.
The affidavit further stated that the MSRDC was permitted to reclaim the land on the express assurance that it would be kept open and developed as a 'green area'. Conditions were incorporated in the environmental clearance on the ground that only a road would be constructed and the remaining portion would be left open.
Bhathena told the court that the Brihanmumbai Municipal Corporation (BMC) had, in its reply to the court on March 6, 2025, stated that the land was under the Coastal Regulation Zone. The civic body had referred to the land as 'no development zone' within the CRZ II-Greater Mumbai area.
'Even assuming whilst denying that the land falls outside the CRZ area, the commercial exploitation of the land still remains prohibited,' said Bathena.
He submitted that Mumbai has just 1.1 square meters (about 1 square foot) of open space per person as compared to the recommended 10 square meters. If commercial exploitation of the land which was reclaimed on the express assurance that it would be kept open and green was permitted, yet another precious public resource would stand appropriated in favour of private interests, he said.
HT reached out to the Adani group for comments on the development, but there was no response from the company.

Adani Realty revives Khatau Mill land project in Mumbai after SC ruling
Bengaluru: Adani Realty has revived its plan to develop around 20 acres of land that formerly belonged to textile firm Khatau Mill in suburban Mumbai's Borivali (East), following a recent Supreme Court ruling on environment clearance for real estate projects, said two people in the know of the matter. The developer had acquired the mill land, located close to the Sanjay Gandhi National Park in Borivali, several years ago for a greenfield residential township. The project planning and design process started around two years ago. However, the project went into limbo like several others after the 2024 National Green Tribunal (NGT) ruling that said large-scale real estate projects within a 5-km radius of ecologically-sensitive zones such as forests or mangroves need environmental clearance from the central government. This led to confusion and delays for developers. In August, the regulatory hurdle was removed when a Supreme Court judgment allowed state authorities to resume environmental impact assessment of real estate projects in the Mumbai Metropolitan Region (MMR) and Pune. The ruling removed the NGT-ordered approval process, allowing projects to go back to securing regular state clearances. The ruling came after industry body Confederation of Real Estate Developers' Associations of India-Maharashtra Chamber of Housing Industry (Credai-MCHI) filed a writ petition, with interventions from Credai National and Godrej Properties Ltd. 'Adani's Borivali project is in the vicinity of a national park which is an eco-sensitive area. Due to the regulatory ambiguity, the project was put on the back burner. The developer has resumed work on the project plan and will apply for approvals soon,' said the first of the two person cited earlier, both of whom spoke on the condition of anonymity. Adani Realty's project is one of the many that were stalled or delayed due to the legal proceedings. Adani plans to build three- and four-bedroom apartments priced at ₹ 3.5-5 crore in the project. 'It was one of the key greenfield projects that was impacted. Now, once the approvals come in, the project will be launched in phases. This will be one of the larger greenfield projects of the group, which has a number of redevelopment projects in the city,' said the second person. An Adani Realty spokesperson didn't respond to Mint's queries. Adani Realty is a joint venture partner with Mumbai-based Marathon Group in a premium residential project named Monte South, located on the 12-acre Khatau Mill compound in the central Mumbai locality of Byculla. Until now, Adani Realty has been developing projects in Ahmedabad, Mumbai Metropolitan Region (MMR), National Capital Region (NCR) and Pune. However, it is Mumbai, the country's most valuable property market, which has steadily become its core real estate-focused geography. In July, the developer signed an agreement with state agency Maharashtra Housing and Area Development Authority (Mhada) for the redevelopment of Motilal Nagar in suburban Mumbai's Goregaon (West). The ₹ 36,000-crore Motilal Nagar Mhada colony project that spans across 142 acres will be the largest redevelopment project in the country. Adani Realty is also gearing up to launch its biggest luxury residential project in the prime Bandra Reclamation area. It is in the process of building its sales office for the 20-acre project located along the Bandra-Worli Sea Link approach road. The mega Dharavi redevelopment project is being developed by Navbharat Mega Developers Pvt. Ltd, a special purpose vehicle formed as a joint venture between the Maharashtra government and the Adani Group. 'Real estate is a priority sector for the Adani Group. The way they have gone deep into each geography, built differentiated products, and built their team signal their focus on the sector. Unlike Adani, many large corporate groups have engaged in the real estate business, but for most, it is not a priority,' said Anuj Puri, chairman at property advisory Anarock Group. Earlier this year, an Adani Group subsidiary also acquired a 1.1-acre plot in south Mumbai's tony Carmichael Road locality for over ₹ 170 crore. Adani Realty is also going to build a 1,000-acre township project in Navi Mumbai, where the conglomerate is developing a new international airport. EAC calls for bird hazard study for Puri international airport
BHUBANESWAR: The state government will soon conduct a bird hazard study for the proposed international airport in Puri and submit its report to the Ministry of Environment, Forest and Climate Change (MoEFCC) for necessary approvals for the project. The study was sought by the expert appraisal committee (EAC) of the ministry as one of the additional conditions for grant of combined Environment Clearance and Coastal Regulation Zone (EC plus CRZ) for development of the Shree Jagannath International Airport (SJIA) at Sipasarubali in Puri. The state Commerce and Transport department, the project proponent of the airport, has been asked to undertake the bird hazard study involving a reputed institute in the field, and submit the report to the integrated regional office of MoEFCC along with the first six-monthly compliance. 'The plan shall be implemented at the project cost,' the EAC has stated in its 148th meeting. The Commerce and Transport department had earlier informed EAC that the Zoological Survey of India (ZSI) undertook a comprehensive study on the proposed project area and that it will strictly implement appropriate environmental protection measures to safeguard migratory birds and their habitats in and around the project. Apart from the bird hazard study, the project proponent has also been asked to follow all the conditions stipulated by the Odisha Coastal Zone Management Authority (OCZMA) under CRZ notification 2019.

Windfall for bldrs as redevelopment booms through higher FSI schemes
In the lanes and back streets of Bandra-Khar-Santacruz, if you see a six-storey housing society building demolished and replaced by an 18-storey tower, it's not magic. Nor is it illegal. Some clauses in the city's development control regulations can bring great windfalls for builders redeveloping housing societies. If the builder constructs tenements for project-affected persons within a radius of 5 km from their redevelopment projects and hand them over free of cost to the BMC or the Slum Rehabilitation Authority (SRA), they receive a much higher floor space index (FSI) in exchange,, which allows them to add more floors in redevelopment projects: a bonanza in locations where prices are between Rs 80,000 a sq ft to over Rs one lakh a sq ft. Architect Manoj Daisaria said because of the high FSI offered under these schemes, residents of housing societies are demanding 30-50% more space in the redeveloped property. On Bandra's sea-facing Carter Road, developer Anand Pandit recently signed an agreement with Shree Amrit Society, where actor Shah Rukh Khan has a flat, offering members an unprecedented 155% more space in the new tower. What makes this very lucrative is that it offers an FSI of 4 compared to the normal 2.5, which means the developer can construct 4,000 sq m on a redeveloped 1,000 sq m plot vis-a-vis just 2,500 sq m for a regular housing block. More than a hundred developers have taken advantage of this scheme. Not to be left behind, the BMC recently introduced something similar__Section 33 (20 B) of DCPR 2034 after the state modified it. "Give us Permanent Transit Camps (PTC) and take more FSI," was the message. Domnic Rommel, former president of CREDAI-MCHI, a body which represents developers, said most now prefer the BMC scheme. According to him, it can allow FSI of up to 5.4 (including fungible FSI). "This increases the financial viability, making redevelopment more economical compared to SRA's 33 (11)," he said. "A 5-storey building can go up to 25-27 floors if the road has more width (under 33(20B))," said Bandra-based developer Sharan Babani. In Bandra-Khar, most redeveloped buildings are about 70 metres tall (18-20 floors) now whereas old housing societies in this belt are barely two to seven floors high, he said. But Babani added that what's also changing—and often overlooked—is the density in these buildings. "Under regular schemes, there may have been only two apartments per floor, but with the higher FSI available under schemes like BMC's 33(20B), that can now increase to four or even five units per floor. This means double or more the number of families on the same footprint, dramatically altering the population density, infrastructure load, and local traffic patterns,'' he warned. Developer Sanjay Devnani said such schemes under 33 (11) and 33 (20 B) are a "win-win for all stakeholders; residents, builders and the approving authorities." "Now, a building which consumes 10,000 sq ft, is allowed 50,000 to 60,000 sq ft during redevelopment," he said. However, housing expert Chandrashekhar Prabhu said the planning authorities (BMC and SRA) seem more than willing to grant much more FSI than what is provided under the city's development control rules. "Though different ostensible reasons have been advanced to justify the windfall, the real reason appears to be the war to control the approval processes, and through them…to take kickbacks," he said. "The govt has realised that it failed when it came to building houses for slum dwellers and those displaced due to public projects. Instead of finding ways to utilise public lands effectively, the govt has now decided to shift the onus of providing accommodation for project-affected people and transit to the builders," added Prabhu. Property experts said the challenge is also to ensure that PTC tenements, which are rarely completed on time, are handed over to the authorities, and that the clubbed free sale buildings which are stuck without occupation certificates as a result, get approvals. "A lot of builders are now developing the PTCs on their own and not relying on unscrupulous SRA developers. That way they can complete the PTCs and hand them over, which then gets them the occupation certificate of the free sale buildings in prime areas," they said.
