for posting information in a misleading manner on its X account in 2022 regarding a search on the premises of AAP functionary and the then Delhi govt minister

The agency should act "impartially", the court observed.
The observations came on Thursday from the court of special judge Jitendra Singh while upholding the Feb 20 order of a trial court that there was no prima facie case to proceed against BJP parliamentarian Bansuri Swaraj under criminal defamation provisions. Jain had filed a defamation case against Swaraj over her comments made on the basis of ED's post.
"It is incumbent upon an investigative agency such as ED to act impartially and uphold the principles of fairness and due process.
Any dissemination of information, including but not limited to official social media platforms, must be accurate, non-misleading and free from sensationalism," the judge pointed out. The presentation of facts in a manner that is misleading, scandalous or intended to defame or politically prejudice a person would not only undermine the integrity of the agency but may also amount to an abuse of power and violation of the individual's fundamental rights, including the right to reputation under Article 21 of the Constitution, he opined.

On June 7, 2022, ED posted on X that it had conducted a search on the premises of Jain and others and various incriminating documents, including cash worth 2.85 crore and gold coins weighing 1.80kg, were seized. The judge said the manner in which the phrase "at the premises of Satyendar Kumar Jain and others" was used in the tweet tended to create an impression that the recoveries were made from the former minister's premises.
The subsequent inclusion of the phrase, "and others", in a subtle and ambiguous manner, following the explicit naming of Jain, failed to clearly attribute the recoveries to "others" whose residences were also raided, he added.
Jain, who was arrested in May 2022 on allegations of money laundering, had challenged the Feb 20 order by a magisterial court, declining to take cognisance of his defamation case against Swaraj. In his complaint, Jain alleged that Swaraj had made defamatory statements against him during an interview aired on Oct 5, 2023, on a news channel, to tarnish his image. He added that the statements were made in the context of an ED raid at his house.

The VP Road police arrested Abdul Kader, a friend and neighbour of the late drug smuggler Iqbal Mirchi on Wednesday based on the first information report (FIR) registered by the Enforcement Directorate (ED). Kader had allegedly encroached on the New Roshan Talkies in Girgaon that belonged to Mirchi. The accused demolished New Roshan Talkies and also tried to sell it for Rs 15 crore despite knowing that the ED had attached the property during an investigation into a 2020 money laundering case against Mirchi. The FIR was registered on Tuesday based on the complaint given by ED and the police arrested Kader from Mumbai. He was produced in court on Wednesday and remanded to police custody till August 8. Kader had transferred the property (Roshan Talkies) on his name a few years ago. A police officer said that earlier, Mirchi's brother-in-law Mukhtar Patka used to manage the Talkies till the pandemic. The demolition of the property came to the agency's notice last year when Mirchi's son filed an application in a tribunal seeking the removal of an illegal encroachment from the premises and requested the ED to take possession of the property. When ED officials reached the spot in December last year to take possession, they learnt that the theatre was demolished. The agency conducted an inquiry and after getting details about Kader, they approached VP Road police station and registered a case against Kader on Tuesday. The FIR was registered under several sections of the BNS related to criminal trespass, cheating, alteration or destruction of valuable security.

NEW DELHI: Brushing aside the allegation by opposition MPs Asaduddin Owaisi and Randeep Surjewala that the special intensive revision of electoral roll in Bihar is an exercise in disenfranchising minorities and precarious communities, the Election Commission on Wednesday asked them to get all such electors to file their claims and objections before Sept 1. "Mr Owaisi and Mr Surjewala should ensure that their state units and booth level agents (BLAs) facilitate those they complain have been wrongfully excluded to file their claims with the ERO to add them back in the electoral roll. Interestingly, even as the national party leaders have been complaining of alleged irregularities and imperfections in the roll, not a single claim or objection was filed by any of the 1.6 lakh party BLAs in the field, between publication of the roll on Aug 1 and 9 am on Wednesday," said an EC official. On the other hand, 3,659 individual electors directly filed their claims and objections during this period. Another 19,186 newly-eligible electors have also filed pleas for fresh enrolment through Form 6, along with the mandatory declaration. EC on Wednesday said it is revising the Bihar roll as per the Constitution and the extant laws, and with full transparency. EC said lists of electors reported by BLOs as dead, permanently shifted, having two votes and who could not be contacted after at least three visits of BLOs were shared with all political parties and their BLAs on or before July 20, giving them ample time to report any wrongful additions or deletions.

1 2 Pune: Pimpri Chinchwad police on Tuesday, arrested a 29-year-old criminal on police records and detained his three minor accomplices on the charge of thrashing and robbing a 30-year-old private security guard near Shinde Vasti in Ravet late on Sunday night. The gang threatened the victim with a sharp weapon and thrashed him with an umbrella before robbing Rs4,500 from him. The terrified victim approached the Ravet police on Tuesday and lodged a complaint against the suspects.
