NIA chargesheets Tamil Nadu man in ISIS radicalisation case
The accused, A Alfasith, hailing from Mayiladuthurai in Tamil Nadu, has been chargesheeted under various sections of the Indian Penal Code and sections 13 and 39 of the Unlawful Activities (Prevention) Act before the NIA Special Court in Poonamalle in Tamil Nadu. The chargesheet was filed on Friday.

The NIA said that Alfasith was closely associated with radicalised Islamists and die-hard supporters of ISIS, including Mohemmed Ashik and Sathik Batcha, who were involved in several
terror-related cases in Tamil Nadu
.
During the investigation, the NIA found sufficient evidence establishing that Alfasith and his associates circulated incriminating ISIS-related videos, documents, and images through social media platforms, targeting hundreds of young Muslim boys.
"They had created several WhatsApp and Telegram groups, such as 'Islamic State' and 'Black Flag Soldiers,' to promote unlawful activities threatening the unity, security, and communal harmony of the country," the NIA said in a statement.

The anti-terror agency further said that their agenda was to spread ISIS ideology and radicalise the vulnerable youth.
"Investigations further revealed that Alfasith followed the activities of the global terrorist group ISIS, and had downloaded incriminating videos and documents from the ISIS-operated Telegram Channel 'nashida33' (Al Wala Val Baro)," mentioned the NIA.
The NIA is continuing its investigation to uncover the larger conspiracy behind the case in Tamil Nadu.

She was headed home when she noticed a car following her. The two accused attempted to block her path and tried to enter her vehicle. Sections of kidnapping were added after criticism of police functioning. The Chandigarh Police filed a 200-page chargesheet in the case on September 20, 2017. A district court framed charges on October 13, 2017, and trial began on October 27, 2017. Ever since, there have been over 100 hearings in the trial court, but repeatedly adjourned on various grounds. In February this year, the case was transferred to the court of judicial magistrate first class where it is currently being heard. It will next come up for hearing on August 2.

A day after the arrest of Eknath Khadse's son-in-law in a drugs case, Shiv Sena (UBT) MP Sanjay Raut on Monday claimed the former Maharashtra minister was being targeted for linking BJP leader Girish Mahajan with an alleged honey trap scandal. Rohini Khadse is the state head of the NCP (SP) women's wing. "The entire matter is suspicious," Raut said. "Khadse has been talking about honey traps for the last three days. He is talking about the involvement of (state cabinet minister) Girish Mahajan in this but there is no probe related to it. Now that Khadse is talking, his son-in-law has been arrested," the Rajya Sabha member said. Such incidents were occurring everywhere in Maharashtra, Raut said. He also accused the police of having become a servant and targeting those who speak against the government. Mahajan recently accused Khadse of trying to malign his image by raising baseless allegations in connection with an alleged honeytrap scandal. The fight between Khadse, a BJP veteran who quit the party to join the then undivided NCP in 2020, and Mahajan is not new. Both belong to the Jalgaon district. "We followed a principle that family members (of political rivals) were never dragged. Unfortunately, people from the BJP are now targeting family members, maligning them," Raut charged. He claimed that after the arrest of Khadse's son-in-law, Mahajan was just short of breaking into a dance. NCP leader and former minister Nawab Malik's son-in-law was arrested in a similar NDPS (Narcotic Drugs and Psychotropic Substances (NDPS) Act case and so was actor Shahrukh Khan's son Aryan Khan, Raut pointed out.

Telangana HC suspends man's sentence over child's rape-murder; points out lapses in identification, prolonged incarceration
Emphasising significant concerns regarding the identification process conducted and the prolonged period of incarceration, the Telangana High Court recently suspended the sentence of a man convicted of raping and murdering a child in 2019, and granted him bail pending the appeal. The order, delivered on July 24 by a bench of Justices Moushumi Bhattacharya and B R Madhusudhan Rao, stated, '…the inordinate and unexplained delay of 150 days in conducting the Test Identification Parade, coupled with the circumstances in which the material witnesses…saw a person running away from the scene of offence without seeing his face, read with the conclusion of the Trial Court that it was not possible to identify the petitioner/accused from the video footage, nullifies the value of the Test Identification Parade.' The case stemmed from a complaint lodged on May 9, 2019, by the father of a 7-year-old boy, who was found dead with head injuries after being sent to a shop near their home the day before. The investigation led to the apprehension of the appellant on May 13 that year, based on CCTV footage and suspicion raised by a witness. The prosecution alleged that the appellant lured the deceased, committed unnatural sexual acts, and then fatally hit the child's head on the ground. The appellant was convicted on July 20, 2021, for offences under sections 363 (kidnapping), 377 (unnatural offences), and 302 (murder) of the Indian Penal Code (IPC), and Section 5(m) read with Section 6 of the Protection of Children from Sexual Offences (POCSO) Act. He was awarded multiple sentences for the offences, including rigorous imprisonment of five years, life imprisonment, and two sentences of 10 years each, all of which were directed to run concurrently. The division bench, however, noted several critical issues with the prosecution's case, one of them being that there were no eyewitnesses to the alleged unnatural sex, kidnapping, or murder. The court also highlighted the 'inordinate and unexplained delay' of 150 days in conducting the Test Identification Parade (TIP) after the accused's arrest. The court felt the identification of the appellant by the witnesses was unreliable due to the long delay, noting that the witnesses had only seen a person running away from the scene in the dark and provided a vague description. 'It is settled law that the Test Identification Parade should be held without any unreasonable delay after the arrest of the accused, which is necessary for eliminating the possibility of the accused being shown to the witnesses before the Test Identification Parade,' the order read. The court also found that the Investigating Officer was unable to determine the blood group of the deceased or the accused, nor confirm if the bloodstains on seized items belonged to the accused. The court referred to the precedent set in Batchu Ranga Rao and others v State of Andhra Pradesh, which provides guidelines for releasing accused persons who have been in custody for more than five years. As the appellant had been in jail for over six years as of the order date, the court found it to be sufficient grounds for granting bail. The bail was granted subject to several conditions, including furnishing of a personal bond of Rs 25,000 with two sureties.
