House prosec: VP Sara's answer to impeach raps has no factual basis
House prosecution panel spokesperson Atty. Antonio Audie Bucoy was referring to the answer ad cautelam (with caution) filed by the Vice President on Monday asking the Senate impeachment court to junk the impeachment complaint against her mainly for violating the one year bar rule, the constitutional provision which only allows one complaint to be filed against an impeachable official in a year.
In the same answer, the Vice President said there is no impeachment complaint to begin with since the Senate impeachment court ordered the return of the Articles of Impeachment to the House of Representatives.
'Ad cautelam is for caution. So, ibig sabihin, hindi pa niya tinatanggap o kinikilala ang hurisdiksyon ng impeachment court. Sapagkat ayon sa rules, 'pag ikaw ay nag-file ng special appearance, dapat ilahad mo ang dahilan kung bakit mo kine-question ang jurisdiksyon ng husgado. Ang ginawa ng Pangalawang Pangulo, nag-file lang ng ad cautelam, entry of appearance, pero walang sinasabi kung anong dahilan,' Bucoy said at a press conference.
(She has yet to recognize the jurisdiction of the impeachment court. Based on the rules, if you file a special appearance, you state why you are questioning the jurisdiction of the court. What they did was simply file an ad cautelam answer without explaining why.)
''Yung kanyang sagot, wala ho siyang factual nor legal grounds ukol roon sa mga factual allegations ng impeachment complaint. It was all procedural [arguments]. This is wagging the dog, mas pinapalitaw na mas importante ang procedure kesa constitutional law and principles, substance. Ang importante is the substance. Those who cannot address the substance, they rely on technical procedures, which is what she did here,' Bucoy added.
(She did not cite facts or legal grounds to answer allegations in the impeachment complaints...making it appear as if procedure was better than substance. What is important is the substance.)
Bucoy also stressed that the impeachment complaint against the Vice President is fully compliant with the constitutional limit of one complaint per year because the three prior impeachment complaints against the Vice President were never initiated, meaning referred to the House Committee on Justice for deliberations.
Bucoy was referring to the three impeachment complaints filed by different groups and endorsed by various lawmakers against the Vice President in December 2024, mainly alleging betrayal of public trust due to the alleged misuse of over P612 million of confidential funds.
The impeachment complaints were filed after the House good government and public accountability inquiry revealed that based on the submissions of Office of the Vice President (OVP) and Department of Education under Vice President Duterte's tenure as Education chief to the Commission on Audit, the OVP and DepEd liquidated the P612 million of confidential funds it received from 2022 to 2023 with acknowledgement receipts containing wrong dates, signatories with no birth records, unnamed signatures, non-readable signatories, among others.
These three complaints, however, were not forwarded by the House Secretary General Reginald Velasco to the Office of the Speaker, Leyte Representative Martin Romualdez, a requirement for the complaint to be scheduled for House Committee on Justice-level deliberation.
A fourth impeachment complaint, however, was filed in February and gathered over 200 lawmakers as endorsers or way higher than one-third of all the House members needed for the complaint to be sent directly to the Senate for trial as stated in the 1987 Constitution.
'Under the [impeachment] rules po, and decided cases of the Supreme Court, initiation happens when the impeachment complaint is endorsed to the House Committee on Justice. This did not happen in the first three impeachment complaints,' Bucoy said.
'Now, this [fourth and] current impeachment complaint, hindi na kinakailangan dumaan doon because it was already endorsed by more than one-third of the House members. In that case, the impeachment complaint becomes the articles of impeachment itself. So, hindi ho na-violate yung one-year bar rule because 'yung tatlong impeachment complaint, hindi ho nakaabot eh doon sa referral to the Committee on Justice,' Bucoy added.
(The fourth impeachment complaint never needed to be referred to the House justice panel because it has been endorsed by more than one-third of all House members. Ergo, the one year bar rule was not violated because the first three impeachment complaints were never referred to the House Committee on Justice.)

DA chief: Rice tariff law ‘threatens to kill' local rice industry
Agriculture Secretary Francisco Tiu Laurel Jr. on Wednesday called for amending the Rice Tariffication Law (RTL), warning that it 'threatens to kill' the rice industry. During the hearing of the Senate committee on agriculture, food and agrarian reform, Tiu Laurel emphasized that the government must revisit, amend, and possibly replace laws that 'no longer serve [the] farmers and consumers.' 'Foremost among these is the Rice Tariffication Law. Though crafted with noble goals, I have to admit, it has faltered. By fully liberalizing rice imports, it unintentionally undermined the Department of Agriculture and the NFA, stripping us of the ability to intervene and protect this most vital of commodities,' he said. 'As currently written, the RTL does not reform the rice industry—it threatens to kill it,' he added. Enacted in 2019 to liberalize rice importation, the RTL empowers the President to halt imports under specific conditions. Before the RTL took effect and its amended version this year, the National Food Authority (NFA) could import rice to augment supply, allowing it to maintain a healthier buffer stock and intervene when prices surged. Earlier this month, Malacañang also admitted the government has encountered challenges in stabilizing the price of rice due to the RTL. The DA chief also lamented the devolution of agricultural extension services under the Local Government Code, which he said took from the agency 'the very foot soldiers we need to win a war against hunger.' 'Without them, the DA is just an office full of officers like generals, colonels , or majors without soldiers on the ground to fully implement its plans and vision for an agri-secure Philippines,' Tiu Laurel said. He also echoed the statement of panel vice chairperson Senator Rodante Marcoleta that the Philippines is still far from attaining food security. Escudero wants LGUs' participation in budget hearings
Senate President Francis 'Chiz' Escudero has recommended that governors and city mayors be invited to participate in the Senate's upcoming hearings on the proposed 2026 national budget. According to his office, Escudero made the suggestion to Senator Sherwin Gatchalian, chairman of the Senate committee on finance. 'Kung mga division heads ng maliliit na bureaus ay dumadalo sa budget hearings, bakit ang mga pinuno ng mga probinsya at malalaking lungsod ay hindi?' Escudero asked. (If division heads of small bureaus attend budget hearings, why don't the heads of provinces and big cities?) 'They have been sidelined for too long. It is now time to give them a seat at the table,' he added. The Senate leader emphasized that the feedback of local chief executives 'is too important to be ignored,' saying that they can even help 'vet and verify' whether the projects in the proposed budget truly respond to the needs of their constituents. 'The perspectives of leaders on the ground are invaluable in determining which projects are necessary and which are not. They can also help flag possible overpricing in the appropriations being requested,' Escudero said. 'One way to achieve this is by requiring the approval or endorsement of the respective Provincial Development Councils and the Regional Development Councils for all development projects so that, at the very least, each LGU will be informed and notified of the proposed programs and activities of the national government in the ensuing year,' he added. On August 13, the Department of Budget and Management turned over the copy of the P6.793-trillion 2026 National Expenditure Program to the Senate, which was personally received by Escudero. The same was also submitted to the House of Representatives. Politicians involved in anomalous flood control projects to be named — Erwin, Jinggoy
Senators Erwin Tulfo and Jinggoy Estrada said Wednesday that politicians who are linked to anomalous flood control projects will be identified in the hearings of the powerful Senate blue ribbon committee. Tulfo, vice chairperson of the panel, said that not only members of the House of Representatives will be named in the next hearings to come, but also local government officials who have had a hand in suspicious flood control projects. 'Yung mga contractor na 'yan, connected 'yan sa mga pulitiko na 'yan. Hindi lang congressman dito, mayroon ding mga governor diyan, may mga mayor din na sasabit diyan na sila mismo ang tumitira ng flood control pagbaba ng pondo sa kanilang lalawigan, sa kanilang probinsya. Sila na ang tumitira,' Tulfo said in a Super Radyo dzBB interview. (These contractors are connected to politicians. It's not just congressmen, but also governors and mayors who are behind the flood control projects who will be tagged.) ''Yung iba naman na mga mayor, mga contractor. Sila na rin ang gumagawa ng mga flood control. At kahit hindi sa bayan nila, kahit sa ibang bayan, pupunta ang kanyang kumpanya para gawin ang flood control na 'yan,' he added. Department of Public Works and Highways (DPWH) Secretary Manuel Bonoan also revealed in the hearing that there may be "ghost" flood control projects worth P5.9 billion that mar some areas in Bulacan. Parliamentary courtesy Estrada, meanwhile, explained that the Senate will not urge fellow lawmakers—particularly those from the lower chamber—to attend the hearings of the blue ribbon committee, but they may voluntarily do so if they want. 'Pwede naman sabihin ng contractor kung sino 'yung mga binibigyan nilang pulitiko,' the Senate President Pro Tempore said in a separate dzBB interview.
